STATE OF NEW YORK PUBLIC SERVICE COMMISSION CASE 10-T-0350 – Application of DMP New York, Inc. and Laser Northeast Gathering Company, LLC for a Certificate of Environmental Compatibility and Public Need Pursuant to Article VII to Construct a 16-Inch Natural Gas Gathering Pipeline to the Existing Millennium Pipeline in the Town of Windsor, Broome County CASE 10-G-0462 – DMP New York, Inc. and Laser Northeast Gathering Company, LLC – Petition for Order Granting a Certificate of Public Convenience and Necessity and Establishing a Lightened Regulatory Regime
NOTICE OF PUBLIC STATEMENT HEARINGS AND INFORMATIONAL FORUMS AND OPPORTUNITY FOR PUBLIC COMMENTS
PLEASE TAKE NOTICE that the New York State Public Service Commission will hold public statement hearings, and otherwise seeks public comments, on an application by DMP New York, Inc. (DMP) and Laser Northeast Gathering Company, LLC (Laser) pursuant to Section 121-a of the Public Service Law (PSL) for a certificate of environmental compatibility and public need to construct a 16-inch, 9.82-mile-long natural gas gathering pipeline, with an associated compressor station (Pipeline). The Pipeline is proposed to be located in the Town of Windsor (Windsor), Broome County, extending from the Commonwealth of Pennsylvania at the Pennsylvania / New York state line to the existing 30-inch natural gas pipeline of the Millennium Pipeline Company, LLC. Through the public statement hearings and other means the Commission also seeks public comments on a separate but related petition by DMP and Laser pursuant to PSL §68 asking the Commission: (1) to grant a certificate of public convenience and necessity to exercise rights Windsor has granted to Laser, under a Road Use Agreement, for the Pipeline to occupy and traverse roads under the control of Windsor; and (2) to determine that Laser and its operation of the Pipeline will be subject only to the lightened regulatory regime the Commission employs for competitive transmission facilities operated wholly in competitive wholesale markets.
The public statement hearings will be held before Administrative Law Judge Howard A. Jack. Each hearing will be preceded by an information session lasting up to one hour, at which staff of the Department of Public Service will describe the proposals and be available to respond to questions. Representatives of DMP and Laser will also be invited to be available at the information sessions to provide information about the proposals and to respond to questions.

It is not necessary to make an appointment in advance or to present written material in order to speak at a public statement hearing. Speakers will be called after completing request cards. All comments at the hearing will become part of the Commission’s formal record in these proceedings. Each hearing session will remain open for at least one hour. The afternoon session will not continue any later than 4:00 p.m. The evening session will continue until no later than when everyone wishing to speak has been heard or 10:00 p.m., whichever is earlier. If anyone wishing to speak has not had an opportunity to do so by the close of the evening session, other reasonable arrangements will be made to receive his or her comments.
