NOTICE OF PUBLIC HEARING AND MEETING NOTICE OF POSSIBLE ENACTMENT CURATIVE AMENDMENT NEWTON TOWNSHIP NOTICE IS HEREBY GIVEN THAT THE BOARD OF SUPERVISORS OF NEWTON TOWNSHIP, LACKAWANNA COUNTY, PENNSYLVANIA, SHALL HOLD A PUBLIC HEARING TO RECEIVE COMMENTS PERTAINING TO A PROPOSED CURATIVE AMENDMENT TO NEWTON TOWNSHIP’S ZONING ORDINANCE, TO ADDRESS GAS AND OIL DEVELOPMENT, INCLUDING BUT NOT LIMITED TO DRILLING, RELATED ANCILLARY FACILITIES AND PIPELINES.

THE PUBLIC HEARING WILL BE HELD ON MONDAY, APRIL 30, 2012, AT 6:30 P.M., AT THE NEWTON TOWNSHIP MUNICIPAL BUILDING, LOCATED AT 1528 NEWTON RANSOM BOULEVARD, CLARKS SUMMIT, PENNSYLVANIA 18411.
FURTHER NOTICE IS HEREBY GIVEN THAT THE BOARD OF SUPERVISORS WILL CONSIDER ENACTMENT OF THE CURATIVE AMENDMENT AT A SEPARATE PUBLIC MEETING THAT WILL BE HELD IMMEDIATELY FOLLOWING THE REFERENCED HEARING, AT THE TOWNSHIP MUNICIPAL BUILDING AT THE ADDRESS STATED ABOVE. ALL INTERESTED PERSONS ARE INVITED TO ATTEND BOTH THE PUBLIC HEARING AND PUBLIC MEETING. THE CURATIVE AMENDMENT IS NEWTON TOWNSHIP ORDINANCE NO. 2012-1, entitled "AN ORDINANCE AMENDING THE NEWTON ZONING ORDINANCE OF OCTOBER 14, 1991, AS AMENDED."

The proposed Curative Amendment is for the purpose of amending the Township’s Zoning Ordinance to correct declared and stated invalidities as necessary to address gas and oil development within the Township. The Curative Amendment amends the following sections of the Zoning Ordinance:

ARTICLE II- Definitions,
Article III- Establishment of Districts, Section 313, Natural Resource Uses and Open Excavations, Article III- Establishment of Districts, Section 314, Buffer for Waterbodies and Wetlands,
Article III- Establishment of Districts, Section 315, Conditional Uses and Special Exceptions, Article III- Establishment of Districts, Section 316, Performance Standards Applicable to All Uses in All Districts,
Article III- Establishment of Districts, will Section 322, Environmental Impact Statement, subsection A,
Article IV, Residential Districts, R-1 -Single Family Residence District, Section 402, Schedule of Uses,
Article V- Business District (C-1) Section 502.7, Schedule of Uses, to include Gas Wells as a principal a permitted use;
Article V- Business District (C-2) Section 503.7, Schedule of Uses, to include Gas Wells as a principal a permitted use;
Article VI- Manufacturing District, (M-1) Section 602, Schedule of Uses, to include Gas Wells as a principal a permitted use;
Article VII- Agricultural District, (A-1) Section 702, Schedule of Uses, to include Gas Wells as a principal a permitted use;
Article VIII- Conservation District (S-1) Section 802, Schedule of Uses, to include Gas Wells as a principal a permitted use;
Article IV- Residential Districts, R-1 -Single Family Residence District, Section 402, Schedule of Uses, to include water and other fluid storage or impoundment areas used exclusively for oil and gas operations as a principal a permitted use;
Article V- Business District (C-1) Section 502.7, Schedule of Uses, to include water and other fluid storage or impoundment areas used exclusively for oil and gas operations as a principal a permitted use;
Article V- Business District (C-2) Section 503.7, Schedule of Uses, to include water and other fluid storage or impoundment areas used exclusively for oil and gas operations as a principal a permitted use;
Article VI- Manufacturing District, (M-1) Section 602, Schedule of Uses to include water and other fluid storage or impoundment areas used exclusively for oil and gas operations as a principal a permitted use;
Article VII-Agricultural District, (A-1) Section 702, Schedule of Uses, to include water and other fluid storage or impoundment areas used exclusively for oil and gas operations as a principal a permitted use;
Article IV- Residential Districts, R-1 -Single Family Residence District, Section 402, Schedule of Uses, to include a compressor station as a conditional use;
Article V- Business District (C-1) Section 502.7, Schedule of Uses, to include a compressor station as a conditional use;
Article V- Business District (C-2) Section 503.7, Schedule of Uses, to a compressor station as a conditional use;
Article VI- Manufacturing District, (M-1) Section 602, Schedule of Uses, to include a compressor station as a principal a permitted use;
Article VII- Agricultural District, (A-1) Section 702, Schedule of Uses, to include a compressor station as a principal a permitted use;
Article VIII- Conservation District (S-1) Section 802, Schedule of Uses, to include a compressor station as a principal a permitted use as a conditional use;
Article VI- Manufacturing District, (M-1) Section 602, Schedule of Uses, to include a processing plant as a principal a permitted use;
Article VII- Agricultural District, (A-1) Section 702, Schedule of Uses, to include a processing plant as a conditional use; and repealing of all other inconsistent ordinances.

A copy of the proposed Curative Amendment is available for inspection, upon request, at the Newton Township Municipal Building during regular business hours. A copy of the proposed Ordinance has also been provided to the newspaper in which this Notice appears. Copies of the proposed Curative Amendment may be obtained for a charge not greater than the cost necessary to produce the copies.
