City of Binghamton Gets Sued Over Fracking Ban

Binghamton Mayor Matt Ryan’s folly, a symbolic ban on hydraulic fracturing within the city, has now come back to bite him in the rear end. His folly will cost Binghamton City taxpayers a lot of money as the city has now been sued over their illegal ban, passed at the eleventh hour last December before Ryan was about to lose a majority of support from the Binghamton City Council in January (voters tossing out some of the all-Democrat council members in the last election).

The Binghamton law firm Hinman, Howard & Kattell filed a lawsuit on Wednesday in state Supreme Court on behalf of five plaintiffs to overturn the Binghamton ban.

Norse Energy Shutting Down NY Office, Moving to Houston

For more than year, MDN has periodically reported on Norse Energy as they have struggled to hold on, waiting for New York State to finally start issuing horizontal hydraulic fracturing drilling permits (see MDN’s coverage here). Norse’s strategy has been to roll the dice that New York will allow shale gas drilling. Drilling is always risky, but betting the company on New York politicians is truly a Las Vegas kind of gamble.

In order to keep going, Norse has sold off various assets over the past year. According to their first quarter 2012 update (see below), they at least have enough money in the bank to keep their U.S. operations going through the third quarter of this year. And they still have a controlling interest in 135,000 acres in New York, much of it in the Marcellus and Utica Shale play areas, should New York finally get off the dime. But in a sign that they may be giving up on the Empire State, Norse is shutting down it’s New York office and heading back to Houston.

NYS Comptroller DiNapoli Letter: Chesapeake Needs New Board

Anti-drilling New York State Comptroller Thomas DiNapoli is once again going after Chesapeake Energy. Like many Democrats, he’s not one to waste a good crisis. You may recall that DiNapoli previously scolded Chesapeake over its Founders Well Participation Program (FWPP) that allowed CEO Aubrey McClendon, the guy who founded the company, to participate in each well drilled, with up to 2.5 percent ownership (see this MDN story).

Now that the board has rescinded the FWPP program after next year, DiNapoli needs something else to target, so he’s lobbying to have a new board of directors installed and sent an open letter to shareholders calling for just that (see the letter embedded below).

UB Backs Away from Own Shale Institute’s New Study

A few weeks ago the new natural gas institute at SUNY University at Buffalo (UB) released a 52-page study that found environmental problems caused by Marcellus Shale gas drilling in Pennsylvania were isolated, mostly minor and on the decline (see this MDN story for a copy of the study). The high priests of the enviro-left could not let a study favorable to the drilling industry stand, so a fast and furious mud-slinging contest began to see if they could besmirch, ridicule, criticize and otherwise try to blunt the effect of such a study. Their concerted (and coordinated?) campaign is having an effect.

The University at Buffalo is now distancing itself from the study, even though the study was rigorous and academically sound. Such are the vagaries (and lack of intestinal fortitude) in academe.

NY DEC Chief Martens Says Fracking Can be Done Safely

Finally, one thing that Joe Martens has said publicly that MDN fully agrees with. Martens, for those new to the drilling debate in New York, is the Commissioner of the Department of Environmental Conservation—the organization that is tasked with regulating oil and gas drilling in the state. Martens is also the former long-time president of the Open Spaces Institute, an organization dedicated to stopping development of land. Strange choice by Andy Cuomo to run the organization tasked with developing the state’s land. But whatever.

FERC Approves Spectra Energy’s $1.2B NYC Natural Gas Pipeline

Spectra Energy’s proposed $1.2 billion natural gas pipeline for New York City finally won approval from the Federal Energy Regulatory Commission (FERC) on Monday. The 20-mile new pipeline to be built will connect New York to New Jersey and deliver 800 million cubic feet of natural gas per day to homes and businesses in New York. Most of the gas will come from the Marcellus Shale. It will ease the energy needs of New York because starting in 2015 the City will no longer allow No. 6 fuel oil to be burned.

The new pipeline and the energy it will deliver by saving all that oil burning will be the equivalent of taking 1 million cars off the road. That’s a good thing, right? So how have some New Yorkers responded? Thankful that they too will be able to access cleaner burning, lower cost natural gas? Thankful that this new pipeline will result in cleaner air? You guessed it—they don’t want it!

NY Towns Pass Resolution They WON’T Ban Fracking

NY Coalition Releases Declaration of Landowner Rights

Yesterday, the Joint Landowners Coalition of New York (JLCNY) launched a new public relations offensive in Albany, NY aimed at catching the attention of lawmakers. President of the JLCNY, Dan Fitzsimmons, along with other leaders of the coalition and state senators Tom Libous (R-Binghamton) and Tom O’Mara (R-Big Flats), delivered a “Declaration of Landowner Rights” to lawmakers. The Declaration (a copy is embedded below) contains six points that the JLCNY says are constitutionally protected under federal and state law, and they are reasserting and claiming those rights.

Anti-Drillers Target Conventional NatGas Drilling in NY

The anti-drillers in New York are not content to block horizontal drilling. They increasingly have turned their attention to conventional, vertical natural gas drilling as their target, trying to shut down or otherwise harass an industry that has been safely operating in the state for decades.

The latest attempt is a sham “report” by the anti-drilling group Environmental Advocates of New York. This new “report” says wastewater disposal from conventional, vertical wells is too lax in the state. They want conventional drilling wastewater to be classified as a hazardous substance with cradle-to-grave tracking of all water used in any oil and gas drilling in the state—which is just another way of strangling an industry that has been an important part of the state’s economy for the past 100+ years.

Cornell Veterinarians Say Fracking Poisons Animals & People

Another day, another attempt by the anti-drilling left to scare people. Honestly, when will the general public wake up to these pathetic attempts to stop drilling?

The latest attempt is from two Cornell professors—from the veterinary department—who came to Endicott, NY to warn people that fracking will poison their cows and horses and chickens and dogs and cats, oh my! (Perhaps the good profs should make a trip to PA, just across the border, where fracking is everywhere and the animals are just fine.)

Folk Legend Peter Yarrow Joins Anti-Fracking Protest in NY

Tioga County, NY Lease Deal with eCORP Falls Apart

It looks like it’s time to put away the champagne bottle and glasses that New Yorkers had brought out to toast a deal in Tioga County, NY that would use LPG (waterless) fracking and perhaps herald an early end to more than four years of a horizontal drilling moratorium.

In March, MDN reported on a deal announced between eCORP International and the Tioga County (NY) Landowners Group, also known as Southern Tier Energy Partners (STEP), to lease 135,000 acres in Tioga County with an eye to using LPG waterless fracking (see this MDN story). After the initial announcement, eCORP released another press statement outlining the deal that both sides had supposedly worked out, a somewhat complicated arrangement in which the approximately 2,000 landowners would be split into 13 independent operating companies and would become part-owners in those companies (see this MDN story).
