NY Judge Throws Out Binghamton Fracking Moratorium

The City Council for Binghamton, NY passed a de facto drilling moratorium at the end of December of 2011, just before the all-Democrat city council was about to be reconstituted with a few new Republican members (see this MDN story). At the time, Mayor Matthew Ryan and City Council were warned of possible litigation.

The law as passed was not (according to City Council and Ryan) an actual moratorium. Instead, they used the “police powers” of the city to enact a law instead of a zoning ordinance, believing it to be a clever legal maneuver insulating them from meeting the strict requirements for a true moratorium.

Yesterday New York Supreme Court Judge Ferris Lebous threw out the law as invalid, calling it what it really is: a moratorium. A copy of the judge’s ruling is embedded below. MDN will walk you through it…

Town of Chenango, NY Residents Sound Off on Fracking

Most townships in Broome County, NY have passed resolutions with language saying something to the effect of “Let’s let the state Dept. of Environmental Conservation do it’s job, we won’t pre-judge the outcome. We won’t enact a ban or moratorium ahead of the DEC.” And rightly or wrongly, both sides of the fracking debate take that to mean a show of support for drilling. The only municipality in Broome County to enact a moratorium (so far) is the City of Binghamton, which was done in an eleventh hour political stunt by Binghamton’s failed Mayor Matthew Ryan (see this MDN story). His folly is now costing city taxpayers big bucks to defend.

The first town in Broome County to consider a moratorium or outright ban on fracking is the Town of Chenango. Last night the town board held a public hearing to elicit comments from residents. MDN was there for a portion of it.

NY State Senator Receives Death Threats from Anti-Drillers

New York State Senator Tom Libous, from Binghamton, a leading politician in New York who supports shale gas drilling, reports he’s received death threats by out-of-control anti-drillers. You know, those peace-loving “civil” disobedient types? Yeah, those people.

Anti-Fracking Hippies Gather at Otsiningo Park Last Saturday

A group of 60s hippies and hippie wannabes gathered at Otsiningo Park (in Binghamton, NY) over the weekend to hold a press conference and make noise about fracking—anti, of course. Among them were failed Binghamton Mayor Matt Ryan, his failed sidekick (running for County Executive in a laughable campaign), Tarik Abdelazim, socialist Binghamton Council member Leah Webb and others. However, the better and frankly more perceptive coverage of the event, came from a former Press & Sun-Bulletin reporter who’s also anti-fracking, Tom Wilbur. Tom points out the rather small group assembled (maybe 100 people total, out of a metro area of 125,000), are signing pledges that if fracking is allowed in New York, they’re going to try and stop it using so-called “civil” disobedience (we’ve personally never seen the anti crowd act civilly!). In his coverage, Wilbur reaffirms what MDN has said for years now: These people are lost in the 1960s.

A Reasonable Anti-Driller in New York?!

Is there such a thing as a reasonable anti-driller? MDN doubted it, until we read a guest viewpoint in today’s Binghamton Press & Sun-Bulletin, by John Orzel. Mr. Orzel is a Democrat, former social studies teacher, resident of Broome County and running against Republican incumbent Tom Libous for the 52nd State Senate seat in New York.

Most anti-drillers attempt to obfuscate the fact they oppose drilling because of their bias against fossil fuels. Mr. Orzel owns up to it. Refreshing! He also owns up to the fact we still live in a free country with the best system known to exist for the fair distribution of wealth: capitalism. In MDN’s book, he constitutes one of the few examples of a reasonable, and truthful, anti-driller.

Anti-Drilling Group Gets Binghamton Univ. to Sign Petition

An anti-drilling group in the Town of Vestal, NY (Broome County) continues to agitate and pressure the town board to enact a moratorium on non-existent fracking in the town. (New York still does not allow high-volume horizontal fracking, and by all accounts, won’t any time soon.)

The latest tactic by Vestal Residents for Safe Energy (VeRSE) is to dupe get 60 Binghamton University employees to sign a petition requesting a fracking moratorium. VeRSE plans to present the petition at tonight’s town board meeting.

NY Fracking Fight Heads to Townships – Rest of the Story

An article in yesterday’s Wall Street Journal focuses on an issue MDN has covered for some time: how the fight over hydraulic fracturing in New York State has “gone local,” meaning it’s largely going to be decided town by town throughout the state.

The article notes a few statistics—about 100 or so towns have voted for either a short-term moratorium on fracking, or an outright ban. And about 60 or so towns have voted to “support” drilling. (Shameless self-promotion: MDN’s Marcellus and Utica Shale Databook Vol. 2 has the complete list of which towns have voted which way on the issue.)

But the pure numbers of “100 against, 60 for” does not come anywhere close to telling the whole story…

Anti-Fracking Doctor Unsuccessful at Vestal, NY Board Meeting

Several doctors from the Broome County Medical Society (BCMS) attended a Vestal (Broome County, NY) Town Board meeting on Monday to ask them to vote for a delay in hydraulic fracturing until a so-called independent health study can be completed. One of those doctors was Niru Anne, a cancer doctor at Lourdes Hospital in Binghamton and vice president of BCMS.

DTE Moves Forward with Bluestone Gathering Pipeline in NE PA

In July of 2011 DTE Energy announced they would file to build a 37-mile natural gas gathering pipeline through the Town of Sanford (Broome County, NY) as well as the towns of New Milford, Harford, Thompson, Jackson, Lenox and Harmony in Susquehanna County, PA. Dubbed the Bluestone Pipeline, the new gathering pipeline will hook to Marcellus gas wells along its route and connect to both the Millennium and the Tennessee interstate pipelines. (A data sheet issued in July 2011 showing the route of the pipeline is embedded below.)

DTE, under their subsidiary Bluestone Gas Corporation, filed a proposal on August 9 to move forward with building the pipeline. The New York State Public Service Commission is now accepting public comment on the proposed pipeline and its route until August 31. From the Public Service Commission press release:

Broome County, NY Township to Hold Hearing on Drilling Ban

In a completely unexpected move, the Town of Chenango (Broome County, NY) has scheduled a public hearing on October 1st to consider a proposed one-year moratorium on natural gas drilling. That is, a couple of town board members in Chenango may ruin the ability for all landowners in the the town to allow drilling on or under their land for the foreseeable future. This is bad news for landowners in Chenango (not far from where MDN is written).

Broome County is likely one of the places where initial permits to drill will be issued, but DEC Commissioner Joe Martens and Gov. Andrew Cuomo have both said communities that don’t want drilling won’t get it. A vote to ban it—even temporarily—is a loud and clear message to the DEC to stay away.

NY Anti-Drillers Target Cuomo Big Money Supporters

Anti-drilling groups from the Southern Tier of New York State sent a letter to the top 1,000 big money contributors to Gov. Andrew Cuomo yesterday asking them to pressure Cuomo to ban fracking in the state. The letter was a joint effort of New York Residents Against Drilling (NYRAD), Walter Hang from Toxics Targeting, and the Mayor of Binghamton, Matt Ryan.

Williams Holds Public Sessions for New Constitution Pipeline

MDN editor Jim Willis attended a “meet and greet” session by Williams about their proposed new Constitution Pipeline. This is a first-hand account of that meeting.

Gas production from northeastern Pennsylvania’s Marcellus Shale is so plentiful, new pipelines are necessary to move it to market. That was the message from Williams Corporation last Wednesday night at the West Windsor Fire Hall located just miles outside of Binghamton, NY.

Williams was on hand to discuss the proposed Constitution Pipeline, a joint venture between Williams and Cabot Oil & Gas to build a 121-mile pipeline from the Marcellus-rich area of Susquehanna County, PA north to Schoharie County, NY.

He writes about a major landowner rally in Broome County called Vote4Energy, held at the Broome-Tioga Sports Park near Whitney Point on Sunday, July 15. The rally turned out thousands, dwarfing recent anti-drilling rallies held in the area. The media was invited, but they were a no-show. Vic does a great job of pointing out the hypocrisy.

Battle Royale in NY Townships – Support or Ban Fracking?

Many townships in the Southern Tier area of New York State want Gov. Andrew Cuomo and the Department of Environmental Conservation to know they support responsible gas drilling. Tuesday night the town board in Bainbridge (Chenango County) voted to adopt a resolution supporting drilling (if by support you mean let’s wait until the DEC issues its new rules). The towns of Preston and Guilford, also Chenango County, both voted to approve the resolution Wednesday night. The resolution was slated for a vote in both Afton and Oxford townships (again, Chenango County), but MDN does not have details yet on the outcomes there—although it was likely positive.

A copy of the resolution as adopted in May by the Town of Windsor, in Broome County, NY, is embedded below. That same resolution, more or less, is what the other towns are adopting.

Paladino Says NY Sen. Libous (Ab)using Fracking to Fundraise

Carl Paladino, a conservative who ran as the Republican candidate against Democrat Andrew Cuomo in the 2010 gubernatorial election in New York, isn’t a fan of New York State Senator Tom Libous. Libous is a Binghamton resident and the number two senator in the Republican-controlled (yes you read that right, Republican-controlled) New York State Senate.

If fracking begins in New York, much of it will be in the counties Libous represents. He’s been on record mostly supporting fracking in New York State, but there have been the odd statements here and there when he seems to back away from a full-throated endorsement. Paladino says Libous is a RINO (Republican In Name Only) who is manipulating the fracking issue to get more campaign money. Ouch. Tell us what you really think Carl!
