New FERC Quorum Votes Final Approval for NEXUS Pipeline
Two new members added to the Federal Energy Regulatory Commission by President Trump (Neil Chatterjee and Rob Powelson), added to the Obama-appointed member (Cheryl LaFleur) have not wasted any time in authorizing their first major pipeline project as a group. Last week the trio voted to approve the first major pipeline project since a quorum has been reestablished–NEXUS, a $2 billion, 255-mile interstate pipeline that will run from Ohio through Michigan and eventually to the Dawn Hub in Ontario, Canada. On August 4th, NEXUS, which is a jointly owned project between DTE Energy and Spectra Energy (now part of Enbridge), sent a letter to the new FERC quorum urging fast action (see NEXUS Pipeline to FERC: Please Approve Project – NOW). Perhaps the letter did the trick. On Friday, August 25th, the three issued a certificate of public convenience and necessity (full copy below) allowing the project to move forward. Because of the delay when FERC was without a quorum, NEXUS says the pipeline will now evaluate and supply a new construction schedule, but they do plan to have the pipeline up and running sometime in 2018…

The Washtenaw County (Michigan) Road Commission has written a letter to the Federal Energy Regulatory Commission (FERC), requesting FERC deny a certificate to build the NEXUS Pipeline because (they claim) NEXUS has bullied them. It seems the Road Commission has been working with NEXUS over the past year to prepare for the pipeline. The Road Commission wants NEXUS to jump through all sorts of hoops, do handstands, backflips, and in general, dance to the Road Commission’s tune. And because NEXUS isn’t willing to bend all the over backwards, the Road Commission is miffed. The Road Commission is the lord of their domain, and no outsider is going to do anything without their permission. So the Road Commission has run to mommy (FERC) and started bawling that NEXUS are meanies and they won’t pick up after themselves and they’re just BULLIES. So FERC should just go ahead and shut the whole $2 billion, 255-mile interstate pipeline project down (that will run from Ohio through Michigan)–because of one whiny Road Commission in one county…

We spotted an outrageously fake news story published in something called the Public News Service that quotes an organic farmer in northern Ohio who is opposed to the NEXUS Pipeline–a pipeline that won’t even cross her property. The litigious and environmentally radical Sierra Club, backed by Big Green money from billionaires like Tom Steyer, is attempting to block two important pipeline projects in the Marcellus: Dominion’s $5 billion, 594-mile Atlantic Coast Pipeline (ACP), a natural gas pipeline that will stretch from West Virginia through Virginia and into North Carolina; and DTE Energy/Spectra Energy’s NEXUS Pipeline, a $2 billion, 255-mile interstate pipeline that will run from Ohio through Michigan and eventually to the Dawn Hub in Ontario, Canada. It’s no secret groups like the Sierra Club have tried to stop such projects. But their latest strategy in opposing these two projects is worthy of examination. The Clubbers are claiming that ACP and NEXUS have an unfair competitive advantage over alternative energy sources, like wind and solar, and therefore should be stopped. That is, the Sierra Club is attempting to use U.S. antitrust laws dating back to the late 1800s in an attempt to claim these pipelines are anti-competitive and therefore should be canceled. Talk about chutzpah…
