    PA Commonwealth Court Keeps Chesapeake Royalty Lawsuit Alive

    In December 2017, a Bradford County, PA judge turned down Chesapeake Energy’s attempt to wiggle out of a royalty lawsuit on a technicality (see Bradford County, PA Judge Keeps Chesapeake Royalty Lawsuit Alive). However, the judge punted the case to a higher court, Commonwealth Court, to settle what he calls “novel questions of law”–rather than spending more time and money on such issues at the county court level.     PA DEP Signals Approval for Adelphia Gateway Pipe Near Philly

    In January the Federal Energy Regulatory Commission (FERC) issued a favorable environmental assessment for New Jersey Resources’ Adelphia Gateway pipeline project in the Philadelphia area (see Adelphia Gateway Pipe Enviro Assessment Approved by FERC). On Saturday, the Pennsylvania Dept. of Environmental Protection (DEP) indicated it will soon issue a federal “401” Clean Water Act stream crossing permit for the project.

    On Friday MDN told you that Consolidated Edison’s deadline to apply to be added as a natural gas customer in Westchester County had arrived (see Moratorium on New Gas Hookups in Westchester County Begins Today). We also told you about a last minute “program” (i.e. bribe) of $250 million of state taxpayer money that could be used in Westchester to hopefully convince Con Ed to not go forward with their new customer moratorium.     NH Granite Bridge Pipeline Unicorn – Still Alive, Cost Up 30%

    Last May, Liberty Utilities, located and operating in New Hampshire, announced a new pipeline project called Granite Bridge–27 miles of new natural gas pipeline to be buried along Route 101 from Stratham to Manchester, along with an LNG storage facility located midway along the pipeline (see Liberty Utilities Floats Plan for 27-Mile Pipeline in Southern NH). The project faces more regulatory approvals, but the new/good news is that it continues to make progress.
