    ME2 Begins Building Pipeline in Lancaster County, PA

    Mariner East 2 (ME2), Sunoco Logistics Partner’s 350-mile NGL (natural gas liquids) pipeline that will run from Eastern Ohio to the Marcus Hook refinery near Philadelphia, has begun construction in northern Lancaster County, PA. Currently the work is getting done in the townships of Clay and West Cocalico. Which is great news. Here’s the even bigger news, that most mainstream news outlets are not reporting: “Officials for the two townships…[said] the pipeline faced no opposition.” Huh. Who woulda thunk? Lancaster County, home of the nutjobs who have threatened to establish an eco-terror camp to block Williams’ natural gas pipeline called Atlantic Sunrise–and yet with ME2, an NGL pipeline, no opposition. Nothing. Of course there are still pockets of resistance to ME2 (see today’s lead story about the eco-terrorists in Huntingdon County). But perhaps lack of opposition to ME2 in Lancaster County is a sign that Big Green is running out of steam (or money to pay protesters)…

    Sunoco Seeks Injunction Against Radicalized ME2 Pipe Protesters

    You may recall our story about the daughter of a Huntingdon County, PA landowner, radicalized by Big Green groups (as evidenced by her association with well known protesters previously arrested), who took to a tree on her mom’s property in order to illegally stop crews working on tree clearing for the Mariner East 2 pipeline (see PA Anti Literally Goes Up a Tree to Stop Mariner East 2 Pipeline). It ultimately didn’t matter, because Sunoco came back and cut down the few trees they need to cut anyway (see Sunoco Tricks Radicalized Protester – Returns and Cuts More Trees). In December, the up-a-tree girl and her mom (Elise and Ellen Gerhart), with lawyers and backing by Big Green money, launched a final “hail Mary” pass by appealing a case to the PA Commonwealth Court, asking the court to stop the ME2 project by claiming it doesn’t have the right to use eminent domain (see Desperate Antis Try One Last Legal Maneuver to Stop Mariner East 2). Like so many other “hail Mary” desperation passes, this one never found the arms of a receiver. In May, the court turned down the appeal (see Huntingdon Family Lawsuit Against ME2 Pipeline Fails, Game Over). With nothing left to do but break the law in an attempt to block the pipeline from their property, that’s just what the Gerharts have pledged to do. That is, invite in outside help (i.e. paid protesters) to block the path, so Sunoco Logistics Partners can’t build the pipeline across their property. Sunoco has asked a Huntingdon County judge to order the family and the outsiders to step aside, or be thrown in jail…

    Sunoco LP CEO Mike Hennigan Defects to MPLX/MarkWest Energy

    Mike Hennigan was, until late last year, president and CEO of Sunoco Logistics Partners–builder of the Mariner East pipeline projects and operator of the Marcus Hook refinery near Philadelphia. Sunoco LP has (for years) been a subsidiary of Energy Transfer (ET). Last November, ET announced it was combining two subsidiaries together into one operation–Sunoco LP and Energy Transfer Partners (see ETE Merging Sunoco Logistics and Energy Transfer Partners). Although on paper Sunoco LP swallowed ETP, the new entity retained the ETP name and ETP’s top management. Exactly how Mike fit into the new arrangement we’re not sure. We know his title became president for crude, liquids and refined products. We’re guessing Mike’s new role wasn’t as satisfying as the old role, because he’s jumping ship. Mike is leaving ET and moving to Marathon Petroleum, to become president of subsidiary MPLX. You may recall that MPLX is Marathon’s pipeline subsidiary which, in late 2015, bought out and merged in MarkWest Energy–a huge Marcellus/Utica player in the midstream space (see MarkWest Energy Investors/Unitholders Approve Merger with Marathon). So, in a nutshell, Mike Hennigan is leaving Sunoco LP to become the new head of MarkWest Energy…

    Antis Score Small Victory Against ME2 Pipeline re Eminent Domain

    The radical Philadelphia-based Clean Air Council (CAC) has scored a very small, but notable, victory in it’s battle to block Sunoco Logistic Partners’ from building the Mariner East 2 Pipeline project. Last Thursday a judge with the Philadelphia Court of Common Pleas allowed a case filed by CAC to proceed. The case claims that Sunoco cannot use eminent domain powers granted by the State of Pennsylvania to force its way through properties where the landowner refuses to cooperate, because (CAC claims) the pipeline is technically not an intrastate pipeline (only located in PA), but is instead an interstate pipeline (crossing the border into Ohio). The judge said the case has enough merit that it can go to trial. We call it a small victory because Common Pleas court is the lowest trial court in the state. There are several layers higher where appealed cases are decided. This is more of a statement than a serious threat. But let’s play “what if.” What if CAC wins, and on appeal, wins again?…

    ME2 Drilling Leaks 575 Gal of Bentonite Mud into Delco Creek

    When pipeline companies lay a pipeline–they dig a trench. But what happens when you come to a road, or a river, or a creek or another structure where you can’t just dig a trench? For those places, you drill horizontally underground–kind of like what shale drillers do. When drilling horizontally underground, the drill bit gets hot and needs to be cooled, so drilling “mud” is piped in to cool the bit as it chews away. Drilling mud for pipelines is, essentially, bentonite–a nontoxic clay. Bentonite is used to make shampoo, deodorant, toothpaste and kitty litter. You’ve probably already used a product today that contains bentonite. Sometimes when drilling, the bentonite mud leaks out–traveling along cracks in the rock. It’s called an “inadvertent return” in the business. We call it a leak. Fortunately, bentonite can leak all day long and it doesn’t pollute anything. However, if enough of it leaks into a river, stream, or wetland (i.e. swamp), it can smother aquatic life. Poor little critters can’t breathe. And that’s not good. Such leaks are what have slowed down progress on building the Rover Pipeline in Ohio–where one such incident leaked 2 million gallons of drilling mud (see Rover Pipeline Accident Spills ~2M Gal. Drilling Mud in OH Swamp). A leak of 575 gallons of drilling mud into a creek is hardly worth mentioning, but it recently happened when Sunoco Logistics was drilling horizontally under the Chester Creek in Delaware County (near Philadelphia) for the Mariner East 2 pipeline project.     6 Middletown Antis Sue Sunoco LP to Stop Mariner East 2 Pipe

    As we reported last week, six anti-pipeline residents living near where the Mariner East 2 pipeline will pass asked the Middletown (Delaware County, PA) town council to reject the path of the pipeline near their property because it would, supposedly, pass closer than town code allows. At a meeting earlier in the week, town council told the residents they’re out of luck–the town will not pursue any action to block Mariner East 2. Period. The residents, amped up and agitated by Big Green groups, was rumored to be considering a lawsuit against the pipeline to force it to conform with Middletown’s ordinance. It’s no longer a rumor.     Energy Transfer 1Q17 – Updates on Rover, Mariner East 2 Pipelines

    Last week Energy Transfer Partners (ETP), the main operating division of Energy Transfer Equity (ETE), released its first quarter 2017 financial and operating update. ETP is the company that built the Dakota Access Pipeline, which was finally completed after Obama was ejected from office–and is right now building the Rover Pipeline. Another division of ETE was, until last month, Sunoco Logistics Partners. In April Sunoco LP was merged into ETP (see Sunoco Logistics Partners Ceases to Exist as of Today). Sunoco LP, now ETP, is building the Mariner East 2 (ME2) pipeline project. So as part of last week’s update, we got mini-updates on two critically important projects for the Marcellus/Utica: Rover and ME2. The Rover chatter indicates all systems are go and they are on track to have the project completed and in-service as far as the Midwest Hub in July, and the rest of the way to Michigan in November. ME2 chatter contained an interesting question and response. An analyst’s question seems to indicate that ETP (the Sunoco Logistics part of it) is considering a joint venture arrangement for the ME2 pipeline project. President & CEO of Sunoco LP (not sure what his title is now) Mike Hennigan was quick to tamp down that speculation. He didn’t deny it, saying the company is having “conversations”–but he did say their focus right now is to finish the darned thing. Get it built…

    PA Landowner Threatens to Go Up a Tree (Again) to Stop Pipeline

    Elise Gerhart has been up a tree before. You may recall our story about Elise, daughter of a Huntingdon County, PA landowner, radicalized by Big Green groups (as evidenced by her association with well known protesters previously arrested), who took to a tree on her mom’s property in order to illegally stop crews working on tree clearing for the Mariner East 2 pipeline (see PA Anti Literally Goes Up a Tree to Stop Mariner East 2 Pipeline). It ultimately didn’t matter, because Sunoco came back and cut down the few trees they need to cut anyway (see Sunoco Tricks Radicalized Protester – Returns and Cuts More Trees). Eventually law enforcement got around to arresting the daughter, and the mom (who also trespassed during tree clearing). Law enforcement also arrested a serial criminal trespasser/anti who aided and radicalized them. Unfortunately, in a miscarriage of justice, the charges against all three were dropped (see Charges Dismissed Against Tree Sitting Anti in Huntingdon County). That oversight will come back to bite law enforcement, because Elise plans to go up a tree again. Or maybe, since the trees are already cut down, she plans to chain herself to a bulldozer. Who knows.     High Stakes Game of Chicken Between Westinghouse & Mariner East 2

    Westinghouse Electric tried “an ambitious new approach to building nuclear power plants” by building sections of the plants in one location before sending them to the construction site for assembly. They tried the process with two nuke plants–one in Georgia and the other in South Carolina. The process they “innovated” failed and took the company down–into bankruptcy. What does that have to do with the Mariner East 2 (ME2) Pipeline project? Westinghouse Electric is headquartered just outside of Pittsburgh and owns a fair amount of land. Mariner East 2 intends to cross a portion of that land. Sunoco Logistics Partners, builder of ME2, attempted to negotiate a payment for an easement to cross Westinghouse’s land–but Westinghouse wanted more than ME2 offered. So ME2 filed paperwork to use eminent domain and “condemn” the Westinghouse property. In other words, let a judge decide how much is fair. Westinghouse joined the chorus that “ME2 isn’t really a public utility”–sounding no different than the Sierra Club and others who oppose the project. That strategy went nowhere, so Westinghouse eventually came back to the bargaining table and this time, worked out a deal–to sell some of their land to ME2. Now Westinghouse is asking the bankruptcy judge in charge of their case to approve the land sale, ahead of the judge’s decision on other matters to do with the bankruptcy.     Sunoco LP Hiring 50% Local to Build Mariner East 2 Pipeline

    As construction of the Mariner East 2 NGL (natural gas liquids) pipeline project heats up, thousands of Pennsylvanians are going back to work. Sunoco Logistics Partners (now called Energy Transfer Partners) said it would take some 8,000 workers to build the twin pipelines called Mariner East 2–from eastern Ohio through the state of Pennsylvania to the Marcus Hook refinery near Philadelphia. When Sunoco LP signed a deal to hire union workers for the pipeline, the deal stipulates half of the hires are local–from within PA. Sunoco has lived up to its word, as evidenced by the testimony of the Operating Engineer’s Union (Harrisburg) who has already seen 50 of its members hired to work on the project. What about the other half, the “foreigners” who come from other states? They’re brought in because of required specialized skills.     Antis Mad Middletown Won’t Block Mariner East 2 Pipe Near Homes

    Looks like Middletown Township, in Delaware County, PA (Philadelphia suburb), has finally faced reality that the Mariner East 2 Pipeline is coming through town. To be fair, town council came to that conclusion last September when they voted to grant easements to Sunoco Logistics Partners to build Mariner East 2 across four parcels of public land (see SEPA Town Votes to Allow Mariner East 2 Across Town Land). However, Middletown has still officially opposed the pipeline. In January Middletown colluded with other towns to pass a resolution opposing it–a totally empty gesture meant to placate a few disgruntled residents (see Towns Near Philly Collude with CAC to Block Mariner East 2 Pipe?). Those disgruntled residents are still not placated. Six residents living near where the pipeline will pass asked town council to reject the path of the pipeline near their property because it would, supposedly, pass closer than town code allows.     Sunoco Logistics Partners Ceases to Exist as of Today

    As of today, the nameplate on the door that says “Sunoco Logistics Partners” is getting changed to “Energy Transfer Partners” (ETP). On paper (and for investors) Sunoco LP & ETP have been different companies, but functionally both companies have co-existed under the Energy Transfer Equity (ETE) umbrella for years–essentially as different divisions of the same company. Sunoco LP is (currently) best known for its Mariner East pipeline projects–along with the Marcus Hook refinery/terminal. ETP is (currently) best known for the recently completed Dakota Access Pipeline. Sunoco LP’s headquarters will move from Newtown Square, PA to combine with ETP’s HQ in Dallas, TX. For investors, Sunoco LP will stop trading at close of business today and become part of the ETP ticker symbol as of Monday. Shareholders for both companies approved the paper merger on Wednesday…

    Anti-Govt Radicals Begin 24/7 Tree Sit in PA to Block ME2 Pipe

    A group of radical (we’d call them criminal) environmentalists–some of the same ones who broke the law in North Dakota while “protesting” the Dakota Access Pipeline (DAPL)–are now trying to replicate the DAPL “protest” (i.e. illegal action) against Sunoco Logistics’ Mariner East 2 pipeline in Pennsylvania. The radical group Earth First! recently issued a “call to action”–their version of ringing the dinner bell for hungry dogs to come running from all other the country (even from other countries). The “call to action” invites hippies and hippie wannabes (those who can put down their bongs for five minutes) to come to Huntingdon County, PA–to Camp White Pine–to stretch wires and ropes from tree to tree and sit, suspended, to prevent crews from clearing trees in the path of the pipeline. According to Mob Rule Now! (aka Democracy Now!), the nutters have now “launched ongoing 24-hour tree-sits” to stop Mariner East 2…

    Mariner East 1 Sprang a Small NGL Leak Near Philly, on Apr 1

    The Mariner East 1 pipeline sprung a small leak and spilled 20 barrels (~840 gallons) of ethane and propane in Berks County, near Philadelphia, on April 1. Sunoco Logistics Partners, builder and maintainer of the pipeline, shut it down and fixed it over the next several days. The entire episode, which happened 20 days ago, is only now coming to light. Sunoco is being criticized by antis for not taking out a major advertising campaign to announce the leak. Sunoco says they alerted the National Response Center (NRC), the proper federal authority (a program of the U.S. Coast Guard). Apparently it is the job of the NRC to alert the public. Although this was a small leak which was quickly contained and with no long-term effects, Sunoco seems to have missed an important life lesson: He who gets there with the bad news first, wins. Sunoco LP should have (in our opinion) been more proactive in publicly announcing the leak and the steps taken to contain and fix it–and to reassure folks that measures will be taken to prevent any such leaks in the future. There would have been a day or two of hit pieces by “mainstream” media, and then the story would have disappeared. Now, the story will linger and be used against the company should any more minor spills happen…

    OH Lawsuit Tries, Fails to Stop Mariner East 2 Pipeline

    The Mariner East 2 (ME2) Pipeline has always been a story about Pennsylvania. Almost always. ME2 is actually two pipelines, laid side by side, that are meant to carry natural gas liquids (propane and butane) from southwestern Pennsylvania and eastern Ohio all the way across PA to the Philadelphia area–terminating at the Marcus Hook refinery/terminal. Most (not all) of the NGLs are exported to other countries. And therein lies the bone of contention. ME2 was granted status as a public utility and with it, the right to use eminent domain to force landowners to allow the pipeline across their property. Some landowners resisted, and (with help from anti groups) sued, repeatedly, claiming there is no public benefit from NGLs that get exported to other countries. They do have a point. So ME2 built four “off ramps” in PA–points where propane and butane will be purchased and used locally, which helps justify the public utility/eminent domain claim. Until now we’ve always read about lawsuits against ME2 originating in PA, where 95% of the pipeline will be built. However, there was a vigorous challenge to ME2 in Ohio on the same grounds–that ME2 is not in the public interest. That lawsuit argued, among other things, there are no “off ramps” in Ohio where the NGLs will be sold and used. However, a lower court and then an appeals court didn’t buy that argument and ruled against the landowner and in favor of ME2. That case appears dead, but it was appealed to the Ohio Supreme Court (no decision yet on hearing the case).
