Biden EPA Restarts Corrupt Practice of Sue & Settle with Big Green
There is a practice called “sue and settle” used by swamp dwellers in the federal government, financed by taxpayers (you) that will make your blood boil. It’s not new. It’s been going on for years. Sue and settle was frequently used during the bad Obama years. When Donald J. Trump took over at the White House he brought in Oklahoma Attorney General Scott Pruitt to run the Environmental Protection Agency (EPA) where sue and settle was the normal routine. Scott drained the swamp and stopped the practice. Guess what? Like a bad yeast infection, the swamp dwellers are back and they’re bringing back sue and settle to the EPA. Surprised? We aren’t.

Tennessee Gas Pipeline’s (TGP) plan to flow more Marcellus gas to Westchester and New York City is called the East 300 Upgrade Project. The project involves upgrades at two existing compressor stations (in Pennsylvania), along with building a brand new compressor station in West Milford (Passaic County), just across the border and not far from Westchester County, NY. Radicalized fossil fuel haters at Food & Water Watch, one of the worst of the worst anti groups, is challenging the all-electric, no-emissions compressor station planned for Passaic County in New Jersey Supreme Court.
Because of constant court challenges, the Trump administration completed a redo of the U.S. Army Corps of Engineers Nationwide Permit 12 (NWP12), a general permit used in constructing pipelines, just prior to leaving office. From the beginning of the Biden administration, anti-fossil fuel fanatics have attacked NWP12, hoping they can cancel it or otherwise make it so onerous nobody will use it (see 
Amtrak has a project underway to renovate and update its 30th Street Station in Philadelphia, PA. Amtrak cut a deal with Philadelphia Gas Works (PGW), the largest municipal-owned natural gas utility in the country, to switch and use onsite gas boilers at the renovated station for some (not all) of the heat. Anti-fossil fuel fanatics are predictably having a cow over the plan. The Philly-based Clean Air Council (CAC), funded with money from Big Green groups, is gearing up to fight the use of natural gas boilers.

It’s always a sad day when radical Big Green groups win a victory over American energy. Such has happened with the New Fortress Energy (NFE) LNG plant proposed for Wyalusing in Bradford County, PA. Three Big Green groups challenged an extension for a permit previously issued for a new liquefaction facility proposed by NFE located in northeastern PA. NFE has caved and agreed that should it proceed with the project, it will need to file all over again and get a new permit–which doesn’t look likely.

Back in the late 1970s when failed President Jimmy Carter faced an oil shortage situation, he recommended people turn down their thermostats and wear sweaters. The left always operates from a “shortage” paradigm rather than an abundance paradigm. Today, history repeats itself. The leftists that infest the International Energy Agency (IEA) told us last year that new oil and gas exploration should immediately stop worldwide (meaning in the U.S.) to save Planet Earth from Global Warming monsters (see 
The left always fights dirty. One of their favorite tactics is to demand a change in the rules of the game when they are losing. Free enterprise, allowing the best companies and best solutions to win based on economics, doesn’t work in the world of leftwing radicals. They seek to skew things–change the rules–tie a 50-pound weight on the back of the runner next to them in order to give themselves an advantage in a race. Which is exactly what’s happening in New England, where UNRELIABLE renewables (solar and wind) are complaining to FERC and FERC’s Chairman, Richard “Dick” Glick, a former wind lobbyist, that electricity auctions are awarded to natgas-fired power plants instead of so-called renewables because natgas is 100% reliable and renewables are not. Time to change the rules.
MDN friend Mark Caskey, president and founder of Steel Nation, a company that builds steel buildings used for natural gas compressor and transmission stations, penned an op-ed for the Pittsburgh Tribune-Review to respond to lies being published by the leftist group Earthworks. On March 8 a paid anti-fossil fuel “petrochemicals campaigner” published a column in the Tribune-Review regurgitating Big Green lies that fossil fuels are evil and that calls by PA shale drillers to increase domestic energy output is somehow bad. The answer for lefties is always the same–renewable nirvana will ride in to save the day. It’s been fun watching the enviro-left soil themselves over the sudden and dramatic shift in public favorable attitudes toward fossil energy. There is no disputing that if the U.S. was energy independent, as it was under Donald Trump, Putin’s invasion of Ukraine would not be having the impact on oil and gas prices that it has had. Republicans (even a few Democrats) are loudly proclaiming we need to ramp up American oil and natural gas drilling once again. This has the lefties doing all sorts of mental gymnastics to try and explain how increasing oil and gas drilling here would be a bad thing. It’s actually quite funny!
