Landowners Settle with Chesapeake, O&G in Western PA Case

A lawsuit initiated by seven families in Beaver County, PA in March against Chesapeake Energy and O&G Investments of Wooster, Ohio has been settled. The landowners originally signed leases with O&G seven years ago, weren’t paid anything during those seven years, weren’t drilled on, and then O&G sold the leases to Chesapeake who tried to drill in order to hold the leases before they were set to expire. The families were rightly outraged by the treatment they received and sued to dissolve the leases (see this MDN story for background).

NY Judge Throws Out Binghamton Fracking Moratorium

The City Council for Binghamton, NY passed a de facto drilling moratorium at the end of December of 2011, just before the all-Democrat city council was about to be reconstituted with a few new Republican members (see this MDN story). At the time, Mayor Matthew Ryan and City Council were warned of possible litigation.

The law as passed was not (according to City Council and Ryan) an actual moratorium. Instead, they used the “police powers” of the city to enact a law instead of a zoning ordinance, believing it to be a clever legal maneuver insulating them from meeting the strict requirements for a true moratorium.

Yesterday New York Supreme Court Judge Ferris Lebous threw out the law as invalid, calling it what it really is: a moratorium. A copy of the judge’s ruling is embedded below. MDN will walk you through it…

NY AG Schneiderman Threatens New DRBC Lawsuit over Fracking

New York State Attorney General Eric Schneiderman tried to sue the Delaware River Basin Commission (DRBC) to force them to delay issuing drilling rules unless/until a comprehensive federal study of fracking was performed first. His frivolous lawsuit was tossed by a federal judge (see this MDN story).

Having his work repudiated by a federal judge apparently won’t stop Schneiderman from filing yet another frivolous lawsuit when and if the DRBC votes to approve Marcellus shale drilling rules. He’s keeping the threat alive:

Former Dimock Landowners Buy New Property…with Gas Lease

Dimock Proud, a group of landowners in the township of Dimock, PA who seek to defend their town’s reputation against unfair media attacks, recently reported that Craig and Julie Sautner, landowners in Dimock and some of the most vocal critics of Cabot Oil & Gas, settled their claim with Cabot, sold their property and left town (see this MDN story). PA Towns Complain about PUC Act 13 Zoning Review

The Pennsylvania townships that sued the state over the newly enacted Act 13 shale drilling law are feeling a little picked on at the moment. The lawsuit brought by seven townships earlier this year is about to go before the PA Supreme Court in a few weeks (see this MDN story). The case revolves around the right of local municipalities to pass and enforce their own zoning laws with respect to oil and gas drilling within their borders. The new Act 13 law provides a consistent set of zoning rules for all townships, replacing and superseding local laws. Some towns in western PA didn’t like it and sued.

Under Act 13, the Public Utility Commission (PUC) is empowered to review and decide whether or not towns are living up to the provisions of Act 13. If they are in violation, the towns won’t receive money from the new impact fee collected under Act 13 (part of a $200 million pot for this year). The current bone of contention is that the PUC is moving forward with reviews of zoning law in select towns, including four of the seven towns that brought the lawsuit. And those towns don’t like it—not one little bit.

Federal Judge Throws Out NY AG’s Lawsuit Against DRBC

Big news for landowners living in the Delaware River Basin area, especially for those in Wayne County, PA who want to see drilling in the Marcellus go forward: A federal judge has thrown out the lawsuit by New York Attorney General Eric T. Schneiderman that sought to force the Delaware River Basin Commission (DRBC) to conduct a “fuller assessment” of the potential impacts of shale gas drilling on New York City’s water supply before allowing any shale gas drilling in the basin.

Such an assessment would have meant years of additional studies and delays, especially harmful to landowners in Pennsylvania who happen to live in the DRBC’s jurisdiction and have seen no drilling for the past five years while their neighbors all around them have. This is a victory not only for landowners, but the DRBC itself, fighting the lawsuit.

NRDC Launches Lawyers to Oppose Fracking in 5 States

You have to say one thing about the increasingly shrill Natural Resources Defense Council (NRDC)—they don’t let an issue they can demagogue for money go to waste. For the NRDC, there’s money to be made in opposing fracking. Warning to the drilling industry: The NRDC is well-funded and is gunning for you. Their latest offensive? They’ve created something called the Community Fracking Defense Project whereby they’ll launch lawyers out into any township across New York, Pennsylvania, Ohio, Illinois and North Carolina to assist that town in opposing fracking. (Sorry West Virginia, you aren’t important enough for the NRDC to spend time and money on.)

The fight over fracking is about to go very local, and get very nasty, with the NRDC pumping millions into the effort to make mischief.

Anti-Fracking Group Sues NY Gov. Cuomo & DEC over FOIL Request

Talk about an ill-advised strategy… Even though New York Gov. Cuomo’s office and the state Dept. of Environmental Conservation (DEC) has been holding secret meetings with anti-drillers, asking for their opinions and advice on how to proceed with fracking in New York State, some of those same groups have turned around and sued Gov. Cuomo and the state claiming a Freedom of Information Law (FOIL) request they made earlier this year for the records about meetings between the governor, the DEC and the drilling industry have not been fully disclosed.

Hello anti-drillers! This is not how you win friends and influence people (like Andy) to your cause. The topper? The group suing isn’t even from New York.

Cowardly “Me Too” Towns Support Act 13 Lawsuit in 11th Hour

Pennsylvania’s Act 13 shale drilling law, passed earlier this year, is facing a stiff legal challenge to a key provision in the law. The only part of the law challenged in court is the part replacing the ability of local municipalities to enact zoning ordinances to control where, and if, drilling happens within their borders. Act 13 substitutes a common set of zoning restrictions—drilling must be at least X feet from water wells, schools, etc. Seven brave townships in PA sued to have that provision overturned. MDN says “brave” not because we necessarily support their effort, but in contrast to the cowardly towns and cities and organizations who haven’t put up their own money and time but instead have issued press releases to support the seven who have.

Who are the cowardly towns and organizations? Let’s name some names, shall we?

Columbia Gas & Hilcorp Meet with Landowners in Brinker Field

More than 50 years ago, landowners in a 35,000 acre area of Columbiana County, Ohio signed a lease with Columbia Gas that allows Columbia to store natural gas supplies in the Berea Sandstone formation. Known as the Brinker property back then, today it’s referred to as the Brinker Storage Field. The lease that was signed, and passed on to new landowners purchasing “Brinker” property, means landowners won’t see a penny from drilling that’s about to begin on their property by Hilcorp Energy (see this MDN story for more background). South Fayette, PA Accuses PUC of Persecuting Them over Act 13

South Fayette in Allegheny County, PA is one of the seven towns that sued the state of PA over the new Act 13 drilling law that stripped away local municipalities’ ability to zone for oil and gas development. The Act 13 law substitutes a new “one size fits all” statewide version of zoning. The Act 13 lawsuit will be heard by the PA State Supreme Court in mid-October.

A South Fayette resident requested the state Public Utility Commission (PUC), charged with reviewing and determining whether or not local municipalities are in compliance with Act 13 with regard to their zoning laws, asked the PUC to investigate, which they are doing (see this MDN story). A resident of Robinson Township also asked the PUC to investigate that town’s ordinances, making Robinson the second case of PUC review (see this Pittsburgh Post-Gazette story). Attorneys for South Fayette have responded to the review by accusing the PUC of “professional persecution,” “malicious intent,” and taking an “aggressive stance” against the town.

PA Lawyers in Act 13 Lawsuit Say State Legislature has “Supreme Authority”

A quick update on the Act 13 lawsuit before the Pennsylvania Supreme Court: Lawyers for the state, on behalf of the governor, the Dept. of Environmental Protection and the Public Utility Commission, filed a 45-page brief yesterday defending the law. The seven towns suing the state to overturn the zoning portions of Act 13 (the part that disallows local municipal control over the siting of drilling and compressor plants, etc.) will file their brief later this month.

NY Fracking Fight Heads to Townships – Rest of the Story

An article in yesterday’s Wall Street Journal focuses on an issue MDN has covered for some time: how the fight over hydraulic fracturing in New York State has “gone local,” meaning it’s largely going to be decided town by town throughout the state.

The article notes a few statistics—about 100 or so towns have voted for either a short-term moratorium on fracking, or an outright ban. And about 60 or so towns have voted to “support” drilling. (Shameless self-promotion: MDN’s Marcellus and Utica Shale Databook Vol. 2 has the complete list of which towns have voted which way on the issue.)

But the pure numbers of “100 against, 60 for” does not come anywhere close to telling the whole story…

South Fayette, PA First Town Challenged Under Act 13

Pennsylvania towns that have ordinances conflicting with the new state drilling law known as Act 13 run the risk of not receiving their portion of a new impact fee being collected by the state—unless they revise their laws to not conflict with Act 13. The first town to be challenged under this provision is South Fayette, in Allegheny County (Pittsburgh area). A resident of South Fayette wrote to the Public Utility Commission (PUC), the agency charged with policing compliance with Act 13, to complain that several town ordinances violate Act 13.
