Here we go again. In August a three-judge panel from the U.S. Court of Appeals for the District of Columbia ruled that the Federal Energy Regulatory Commission (FERC) had the right to approve Williams’ Atlantic Sunrise Pipeline project, including the right to use eminent domain to build it before details are finalized over compensation to landowners (see DC Court Upholds FERC Authority in Approving Atlantic Sunrise Pipe). The Sierra Club and other Big Green groups, with endless mountains of money from people like Mike Bloomberg and Tom Steyer, kept pushing and finally convinced the entire DC Circuit (all of the judges, call “en banc”) to rehear and reconsider the case already decided by three of their number.

Earlier this week MDN told you the great news that the Federal Energy Regulatory Commission (FERC) has green lighted construction of a compressor station in Weymouth, Mass., and that Enbridge (the builder) said they will begin construction any day now (see Stop Press! Enbridge to Begin Construction on Weymouth Compressor). Indeed, crews are at the site getting things ready, and that brought out “more than two dozen” (according to a CBS report) anti-fossil fuel protesters. Some of the protesters couldn’t help themselves and tripped over into committing a crime by blocking the entrance to the facility so crews could not come and go with equipment. Typical.

In what has to be the outrage of the century, Chester County, PA District Attorney Tom Hogan, drunk on his own power, has falsely charged both Energy Transfer (Sunoco Logistics Partners) and several PA constables (essentially off duty police officers) with bribery and conspiracy because the off-duty officers had the gall to moonlight as security to protect Mariner East pipeline workers from anti-fossil fuel crazies and wackos.

Pennsylvania Gov. Tom Wolf, a liberal Democrat who sometimes supports the shale gas industry (as long as he can tax it) has caved to demands from the Pittsburgh Post-Gazette to launch a “study” in a bid to “prove” cases of childhood cancer in southwestern PA can be tied to shale drilling in the region. A pair of studies, actually. The studies won’t be completed for three years, after Wolf is out of office, so he gets credit for caring, but he won’t be around for the fallout when it happens.

Last week Pennsylvania Attorney General Josh Shapiro sat down to talk with the editorial board/reporters of the Washington (PA) Observer-Reporter. He refused to confirm or deny he’s actively conducting a witch hunt of the PA Marcellus Shale industry, including trotting dozens of people before a grand jury–even though the media has been reporting on his grand jury fishing expedition since February (see PA AG Continues Marcellus Witch Hunt, Impanels Grand Jury). No worries. None other than the Deputy Secretary of the PA Dept. of Environmental Protection (head of the DEP’s Office of Oil and Gas Management) has confirmed he appeared before Shapiro’s witch hunt grand jury.

The Sierra Club is a radicalized, far left “environmental” group that seems to have endless mountains of cash to finance frivolous lawsuit after frivolous lawsuit against any project or company with the moniker “fossil fuel” attached to it. Anti-fossil fuel nutters who so often turn to criminal activity in the name of “protecting” the planet have struck again–this time at the Cricket Valley Energy Center in Dutchess County, NY. The natural gas-fired power plant is nearing completion and with every rivet punched and bolt that gets turned, it drives the nutters even more insane than they already are. Some 29 protesters, some of them not local, were arrested by Dutchess County sheriff’s deputies on Saturday for blocking the entrance to the facility. Four of them climbed a 275-foot smokestack to hang banners. We have the names and ages of all 29 who broke the law.

In September MDN told you about environmentalist wackos at the Bernheim Arboretum (about 25 miles from Louisville, Kentucky) who refuse to grant an easement for 4,000 feet of land they bought *after* the Louisville Gas and Electric Company (LG&E) already had a state-approved plan to build a new pipeline over that land as part of tiny 12-inch, 12-mile pipeline (see KY Utility Hints at Defunding Local Arboretum Blocking New Pipe). The Arboretum’s refusal, along with a few other property owners, means 62 homes and businesses have been denied the right to connect to LG&E’s local natgas utility system. Unfortunately the Kentucky Energy and Environment Cabinet (state agency) has just sided with the wackos.

A leftist anti-fossil group calling itself Protect PT, in Penn Township (Westmoreland County), PA, backed with big money from Big Green groups, continues to sue in an effort to block shale drilling in the township. And they keep losing their lawsuits. Protect PT has launched multiple challenges to a local Penn Township ordinance which allows Apex Energy and Huntley & Huntley to drill and operate wells.
