Just last week, with respect to the sale of the Buffalo “Marcellus” Bills to East Resources CEO Terry Pegula, we said the following tongue-in-cheek: “What’s interesting to us is that there’s zero talk about how Marcellus “blood money” has purchased the Bills. No talk that Pegula is an evil, nasty fracker….The talk, universally, is of a really great guy with a big heart that’s whip smart and committed to the Buffalo region (he previously bought the NHL Buffalo Sabres team). Crestwood Midstream Marcellus Volume Up 10%, New NEPA Pipeline

Crestwood Midstream filed their latest quarterly operations update yesterday, for third quarter 2014. Crestwood has pipeline gathering/processing systems in three major U.S. shale gas plays: the Marcellus, the Niobrara and the Barnett. They also have an oil pipeline gathering system in the Bakken Shale. The Marcellus is the largest of their natgas gathering systems, and according to the update, flows for the Marcellus system were up another 10% in 3Q14. At one point, the system hit a new daily average high of 700 million cubic feet per day (Mmcf/d). With a couple of new compressor stations coming online, the system will have a capacity of 875 Mmcf/d…

Corbett Starting to Cave on Taxing Natgas? Sort of…

In a fight for his political life, PA Gov. Tom Corbett is dipping his toe in waters he has, until now, not been willing to enter. In an interview with the anti-drilling PBS reporters at StateImpact Pennsylvania, Corbett talked about the possibility of a “transmission tax” on natural gas. He still doesn’t support a severance tax (thank God), but he is talking about a new tax on gas flowing through pipelines in the state. Dangerous talk, if you ask us. Corbett’s best shot at re-election is to NOT cave on the issue of unfairly taxing the drilling industry so grubby politicians in Harrisburg can redistribute the wealth, spending it on their own pet projects (pork barreling)…

Important Landowner/Driller Case Heads to PA Supreme Court

A Pennsylvania landowner signed a lease with Cabot Oil & Gas in 2007. Part of the way through the lease, before Cabot initiated drilling, the landowner sued Cabot to dissolve the lease, citing certain reasons that they believe justified that action. The case went to court and the court eventually threw out the landowner’s case, meaning the lease is still in effect. Cabot then filed a counterclaim to have the lease term extended, something called an “equitable extension of lease terms.” In other words, once sued, the lease term should go on pause, and because they won, Cabot should then be able to un-pause the lease term and continue (which would otherwise have expired due to the long time it takes for court cases to play out). The court did not grant Cabot’s request and the case has now been appealed all the way to the PA Supreme Court. The decision will set an important precedent for both landowners and drillers…

MSC Pushes Back Against NEPA Newspaper Sham Editorial on Exports

Three cheers for Marcellus Shale Coalition president David Spigelmyer for responding to a bone-headed editorial that recently appeared in the Wilkes-Barre, PA Times Leader castigating potential natural gas exports and denigrating the entire Marcellus Shale industry. The “reporters” of the Times Leader, in their sycophantic zeal and eagerness to obsequiously seek favor with their favorite candidate, Tom Wolf, ran an editorial titled, “Our Opinion: Exporting Pennsylvania’s natural gas to the globe defies good sense” in which they take pot shots at the men and women of the Marcellus along with mis-characterizing the issue of Marcellus gas exports. Mr. Spigelmyer had the ~~balls~~ intestinal fortitude to verbally slap them across the face and tell them to grow up…

Update on PennEast Pipeline–Its Physical & Emotional Path

The anti-drilling nutters at the Sierra Club (we call them Sierra Clubbers, you know, people who like to go “clubbing“?) have apparently polled a new phrase that they think is a winner. They’ve found when you say magic words, like “pipeline x will leave a nasty, ugly scar that’s irreversible” on Old Mother Nature, that gets low information people really fired up. So that’s the new phrase they toss around for projects like the recently announced PennEast Pipeline (see 3rd New NEPA Marcellus Pipeline Proposed, Connects to Trenton, NJ). PennEast will run from Wilkes-Barre, PA all the way to a spot near Trenton, NJ. Communities along the proposed route have been organizing meetings with the express purpose of castigating and ridiculing the proposed $1 billion project. “Not in my back yard!” they yell. The Sierra Clubbers helpfully sprinkle magic words like “scar the earth” which whips them up into even more of frenzy. So UGI and the four other partners in the project have abruptly stopped attending those meetings and will, instead, host their own meetings in an attempt to keep anti-drillers from trying to manipulate people’s emotions. DEP to DePasquale: Problems Fixed Years Ago, Where Have You Been?

The Pennsylvania Dept. of Environmental Protection (DEP) is, once again, defending itself from baseless allegations from PA’s pro-wind (and anti-natural-gas) Auditor General, Eugene DePasquale (Democrat). As MDN readers know, DePasquale, upon taking office, set out to castigate and denigrate the fine men and women of the DEP by conducting a years long study of the department’s ancient history and then claiming the DEP wasn’t ready to handle the sudden onslaught of Marcellus drilling in the state–as if any department could have foreseen it (see Anti-Drilling PA Auditor General Criticizes DEP in “Report”). Major Milestone: PA PUC Rules Mariner East IS a Public Utility

Sunoco Logistics is not home free yet–but almost. As MDN readers will know, for some time anti-drillers have attempted to prevent Sunoco Logistics from repurposing their 400+ mile Mariner East pipeline that stretches from western PA to Philadelphia to begin flowing natural gas liquids–ethane and propane. The legal tussle has been over whether or not the pipeline is a “public utility” with the right of eminent domain and the right to be exempt from local zoning ordinances. Bear in mind the Mariner East pipeline has been in the ground for decades, always considered a public utility in years gone by. Local municipalities are now seeking to stop a string of 18 pump and 17 value stations (in 31 locations) that will be needed along the pipeline’s route in order to flow the ethane and propane. So the municipalities launched a legal fight to remove Mariner East’s classification as a public utility. Yesterday the Commissioners of the PA Public Utility Commission put that issue to rest once and for all…

Sleazy: PA Dem Senators Use Unpublished “Study” to Smear Shale Drilling

A group of PA Democrat Senators are, once again, denigrating the miracle of Marcellus Shale drilling in their state. Only this time it’s even sleazier and lower than usual. This time they’re hinting that results from a so-called “study” not released to the public supposedly show that in two Marcellus Shale counties the average number of hospitalizations among the population has gone up versus a single, cherry-picked county with no Marcellus drilling. What is outrageous is that the senators leaked that tiny little bit of information at a hearing, but have not provided any of the details–nor have they provided the study itself. So our hall of shame goes to state Sen. John Yudichak, D-Plymouth Township, state Sen. Lisa Boscola, D-Bethlehem Township, and state Sen. John Wozniak, D-Johnstown who ran a Dem hearing yesterday to attack shale drilling. Also in the hall of shame is Trevor M. Penning, professor of pharmacology and director of University of Pennsylvania’s Center of Excellence in Environmental Toxicology for testifying (colluding) at that hearing providing only partial information. PA Democrats Introduce 5% Severance Tax to Kill Shale Drilling

Voters in Pennsylvania stand on a precipice. If they elect a Democrat governor and restore Democrat control to the PA House and Senate, there is no doubt a severance tax will be enacted on shale drilling, *in addition to* the existing impact fee that has now collected over $630 million in three years. Such a tax would be an unmitigated disaster. It would almost completely stop shale drilling in Pennsylvania–and no, it’s not an empty threat or hyperbole to say so. It is reality. Need evidence? Last week PA’s Democrats introduced yet another bill that would implement a severance tax–HB 2508 (see it below). Fortunately the existing Act 13 has a provision that if a severance tax is ever enacted, the impact fee disappears. However, you can count on the Dems to repeal that part of the Act 13 law and double-dip on the drilling industry, thereby killing shale drilling in PA…

PA AG Casts Doubt on DEP’s Response to Water Complaints in New ‘Guide’

As MDN reported in July, Pennsylvania’s sleazy Auditor General, Eugene DePasquale (Democrat) went on a two-year witch hunt to find any little dust bunny he could to denigrate another state agency, the Dept. of Environmental Protection (see Anti-Drilling PA Auditor General Criticizes DEP in “Report”). As we stated at the time, many of the things he criticized the DEP about occurred under the watch of Democrat Gov. Ed Rendel and then-Sec. of the DEP John Hanger. GAO Issues Report on Class II Injection Well Fluid Info Collection

Several anti-drilling U.S. senators and congressman requested that the Government Accountability Office (GAO) conduct research and issue a report to describe what information the federal EPA and the individual states collect from class II injection well operators on the characteristics of injected fluids. That is, the Dems wanted the GAO to write a book report on just how nasty and vile the chemicals are from oil and gas drilling that get injected deep into the earth, never to return, and how those nasty chemicals may one day pollute all of our drinking water supplies.
