WV Chief of Homeland Security Not Concerned About Drill Cuttings

For all the hoopla from anti-drillers in West Virginia over radioactivity in drill cuttings (leftover rock and dirt from drilling the borehole), and the disposal of those cuttings in landfills, you would think the state is in imminent danger of becoming a nuclear waste dump–glowing in the dark and visible from satellites passing through the night sky (see WV Anti-Drillers Continue to Harp on Drill Cuttings in Landfills).

The chief of Homeland Security and Emergency Response for the West Virginia Dept. of Environmental Protection says the DEP recently tested drill cuttings from EQT heading to the landfill and found radiation levels to be so low, they were barely detectable. PA Farm Bureau Joins Chorus Against Chessy on Royalty Issue

The Pennsylvania Farm Bureau is adding its considerable weight behind the effort to pass new legislation that will guarantee landowners in the state don’t get shafted by companies like Chesapeake Energy when it comes to royalty payments. As MDN has previously reported, the royalty situation in PA has turned messy with claims that Chesapeake Energy has engaged in an elaborate scheme to pass post-production costs on to landowners–costs they technically don’t have a right to deduct (see Chesapeake Shafting Landowners out of Royalties Mess Gets Messier). What it means is that some landowners are getting peanuts–far below the state mandated 12.5% minimum royalty.

The Farm Bureau is up in arms because its members are up in arms–and so the organization is pushing for new legislation to plug the loophole that Chesapeake (and maybe others) are apparently exploiting…

CONSOL Gets FAA Clearance for Take Off with Pitt Airport Drilling

Really good news for CONSOL Energy and their CNX Gas subsidiary: The Federal Aviation Administration (FAA) has given their blessing for CONSOL’s plan to drill at Pittsburgh International Airport. Not only has the FAA granted it’s approval, so too has the federal Environmental Protection Agency, the U.S. Fish & Wildlife Service, the Federal Highway Administration and the U.S. Army Corps of Engineers.

For more than a year CONSOL has been working on a plan that will please everyone so they can drill on Pittsburgh Airport property–a plan that the Airport hopes will ultimately net them $1 billion or more (see CONSOL Energy Reveals Drilling Plan for Pittsburgh Airport). Just about every letter in the alphabet soup of Washington, DC agencies has now reviewed and approved CONSOL’s plan to drill at the Pittsburgh Airport. So, can we get drilling already?!…

Rogue Obama EPA Goes on Methane Witch Hunt

The recent Climate Action Plan to cut methane emissions emitted by the White House last week contains this ominous bullet point: “EPA will assess several potentially significant sources of methane and other emissions from the oil and gas sector. EPA will solicit input from independent experts through a series of technical white papers, and in the fall of 2014, EPA will determine how best to pursue further methane reductions from these sources.”(1) The good news is that the overbearing, out-of-control actions by the Obama EPA will only apply to drilling on federal lands. The bad news is that they will try to bully individual states to adopt the same new onerous regulations, thereby making federal regulations de facto in many locations.

New Hearing Dates for Hilcorp’s Forced Pooling Request in PA

Last October MDN told you about Hilcorp’s request to force some Pennsylvania landowners in Lawrence County, PA to allow Hilcorp to drill under (not on) their property in the Utica Shale layer (see Hilcorp Uses PA Forced Pooling Law Against Lawrence Cty Landowner). After much tooing and froing, the PA courts told the Dept. of Environmental Protection (DEP) that the DEP would need to make the decision (see Ironic: PA Enviro Court Forcing DEP to Rule on Forced Pooling). The DEP set a public hearing for March 25 & 26 in Lawrence County, and then postponed it (see Hilcorp Forced Pooling Hearing Postponed, More Landowners Added).

We finally have final final final hearing dates from the DEP–May 7 & 8. Here’s the lowdown from the DEP, in which they say the hearings will be conducted “like a trial”…

Rex Predicts Record 1Q14 Production, Bank Floats Extra $50M

Rex Energy’s banker apparently likes what it sees in the State College, PA-based Marcellus/Utica driller, so they’ve decided to raise Rex’s line of credit another $50 million (from $325 million to $350 million). And what’s not to like? Rex reported last week that they expect first quarter production to come in near the high end of their previous guidance numbers–close to the 118 million cubic feet per day number. Last week Rex also announced they’re adding a second drilling rig in their Butler, PA operation–and (most exciting to us) they’re drilling two stacked Upper Devonian Burkett/Marcellus tests in 2014, one of them with the new rig they’ve just added.

Judge Lets PA Anti-Driller Sip More Lattes, Attorney Claims “Big Win”

Last Monday a little known anti-driller with a potty mouth from northeast PA–Vera Scroggins–had her day in court. You may recall that Vera had repeatedly trespassed on drilling sites owned by Cabot Oil & Gas in Susquehanna County and a judge slapped her with a restraining order last year. Vera said the court order prevented her from sipping lattes at the local Price Chopper grocery store (land leased by Cabot) so she got herself a lawyer from the American Civil Liberties Union and asked the judge to reconsider (see PA Anti-Drilling Activist Asks Court to Lift Cabot Restraining Order). Cabot had no objections as long as she’s still barred from active drill sites and Cabot offices. So the judge, late last week, did just that–he tweaked the restraining order to allow Vera to go sip her lattes, but nothing else has changed. That is, she’s still barred from trespassing on active drill sites and Cabot office property.

One of Vera’s attorneys claims the judge’s decision is a “big win.” Er, OK. Whatever. What Vera actually won was exactly nothing, except another 5 minutes of “fame” in local media around Montrose–population 1,617…

Eureka Hunter Gets New $117M Line of Credit, Expansion Continues

Eureka Hunter Pipeline, a subsidiary of Magnum Hunter, is a small but growing midstream company with most of its operations in West Virginia (see these MDN articles about Eureka Hunter and their recent expansion). Apparently they plan to keep on growing. Today Eureka Hunter announced they’ve got a new line of credit at the bank–for a cool $117 million. Their line of credit can grow to $150 million under the right conditions.

Magnum Hunter CEO Gary Evans says the new credit line means MH itself won’t have to float cash to the midstream subsidiary like it does now–meaning more flexibility and Eureka Hunter can expand faster. And that’s a good thing! Here’s the Eureka Hunter announcement posted today:

17-Mile Gas Pipeline in Steuben County, NY Makes Progress

Empire Pipeline, a subsidiary of National Fuel Gas Company (which also owns driller Seneca Resources) is asking the Federal Energy Regulatory Commission (FERC) for approval on a new 17-mile pipeline in Steuben County, NY. The project is called the Tuscorara Lateral Project and will cost a projected $43 million. The pipeline will connect a gas storage field and compressor station in Tuscarora, NY (also owned by National Fuel Gas) with the existing Empire Pipeline network–a network that stretches from Buffalo to Syracuse and down to Corning. This “little” piece of pipeline will open up much needed extra volumes of natural gas for Upstate New Yorkers.

Empire/National Fuel is now negotiating with landowners to run the pipe under their property. They hope to begin building later this year and have the pipeline in service in November 2015. Noble Energy Donates $250K to WV Community College Program

Noble Energy certainly live up to it’s name of “noble.” Earlier this week Noble announced a $250,000 one-time gift to the West Virginia Community College’s new Appalachian Petroleum Technology Training Center. The Center offers one-year certifications and two-year degrees in petroleum technology–just one of 14 programs in the country like it. MDN previously wrote about the new program in May 2013 (see New Appalachian Petroleum Technology Training Center in WV). Graduates coming from the program have the ability to earn between $60,000-$100,000 per year–starting! It’s a fabulous program and Noble has really stepped up to the plate to ensure the program not only survives, but thrives–so kudos to Noble.

Antero to Provide 50% Ethane Needed at Parkersburg Cracker Plant

The ethane cracker plant planned for Parkersburg (Wood County), WV, to be built by Odebrecht and operated by Odebrecht subsidiary Braskem America, took another giant step closer to reality yesterday. Powerhouse Marcellus/Utica driller Antero Resources announced they will provide 30,000 barrels per day of ethane for the proposed new plant when/if it gets built. That’s half of what the plant needs to operate. Antero Resources CEO Paul Rady was joined by Odebrecht VP of business development David Peebles on stage at the Marcellus to Manufacturing Ethane Development Conference at the Charleston Civic Center for the big announcement yesterday. WV Gov. Earl Ray Tomblin took to the stage to crow about the deal too (he’s earned the right).

It was just Monday of last week that MDN observed that the Odebrect cracker plant just “feels” like it’s going to happen (see Odebrecht’s WV Ethane Cracker has The Big Mo–Momentum). Yesterday’s Antero announcement is more evidence of that. County Officials Meet with Shell on PA Cracker, Come Away Hopeful

Seems like it’s “cracker day” at MDN. Long before Odebrecht announced their potential ethane cracker plant for Parkersburg, WV, Shell announced plans to build a cracker in Pennsylvania. In fact it was exactly two years ago this month that Shell announced the location would be Monaca (Beaver County), PA (see Shell Announces Location of Ethane Cracker Plant). PA state legislators eventually voted on a package of significant tax breaks for the proposed new plant (see PA Legislature Reaches Deal on Tax Credit for Cracker Plant). However, since that time, it seems like the PA cracker deal has cycled through highs and lows as to whether it would actually get built (see PA Ethane Cracker – On Again, Off Again…Now On Again?).

More recently MDN told you the pendulum had swung back to the pessimistic side (see Shell’s Shale Pessimism Signals Worry for Some re PA Cracker). But what’s this? Last week some 30 Beaver County officials met with Shell about the proposed ethane cracker plant and left that meeting feeling “hopeful”–which is a good sign. Shell told the officials about moving forward with plans to move a portion of a local roadway, relocate power lines and other big-ticket projects that Shell would not be spending money on unless there is serious interest in moving forward. NY Update: Norse/JLCNY Lawsuit Hearing Date Set for April 25

Sadly, politics in New York State have become so corrupt that even the State Attorney General, Eric Schneiderman, actively works against the interests of the people he’s sworn to protect–the citizens of New York State. Late last year Norse Energy sued Gov. Andrew Cuomo, DEC Commissioner Joe Martens and State Health Commissioner Nirav Shah over their collusion to stop shale drilling in the state (see Norse Energy Sues Gov. Cuomo to Force Release of Fracking Regs). Later, the 70,000-member Joint Landowners Coalition of New York joined that lawsuit (see D-Day: JLCNY Files Lawsuit Today Against Cuomo, Martens, Shah).

How has AG Schneiderman reacted? By filing to dismiss the lawsuits and delay (see NY Attorney General Files to Dismiss Norse Lawsuit, More Delays). It’s utterly shameful. The lawsuit was scheduled for a hearing first in January, then moved to February, then March, and now April. It appears Norse and the JLCNY, whose cases are now tied together, will finally get a hearing at the end of April–on the 25th…

MWCD Close to Signing Utica Lease for Piedmont Lake, OH Property

In early January MDN brought you the delicious news that the Muskigum Watershed Conservancy District (MWCD) is planning to lease a large tract of District-owned land in and around Piedmont Lake (in Belmont, Guernsey and Harrison counties) for Utica Shale drilling (see MWCD Open House on Leasing Piedmont Lake Property for Drilling). The original 6,600 acres has now turned into 6,700 acres and the lessor will be Antero Resources, according to an announcement issued by the MWCD last Friday.

According to the MWCD board, they will likely vote on the lease at their next meeting scheduled for April 18. An update on the Piedmont Lake lease from the MWCD is below, along with the draft copy of the lease from Antero. Noticeably missing from the draft lease are the terms…

Cracker Plant Talk Spurs Economic Growth in Beaver County, PA

Over the past couple of years the prospects for an ethane cracker plant in Beaver County, PA have swung from wild optimism to wild pessimism and everything in between. Most recently the pendulum has once again tilted negative (see Shell’s Shale Pessimism Signals Worry for Some re PA Cracker). But don’t talk negative to the businesses setting up shop and expanding in Beaver County. The mere talk that it’s possible Shell will build the $2-$3 billion ethane cracker in Monaca has caused a significant uptick in the local economy. One Realtor has said for businesses looking to get a piece of the coming economic pie–you’re already late! Many have already grabbed up space and it’s increasingly difficult to find commercial real estate in the county.

Utica Driller Halcon Resources Up for Sale According to CEO

MDN recently reported that Halcon Resources has stopped drilling on their leased land in the Utica Shale (see Halcon Resources Stops Drilling, Gives Up on the Utica Shale). Halcon’s blunt-talking CEO, Floyd Wilson, famously said he didn’t want to drill any more underperforming (he used more colorful language) wells in the Ohio’s northern Utica and instead seemed to say the company’s focus would be further south. Then the company said nyet–no more wells drilled in 2014 in the Utica. From Wilson’s remarks yesterday at the Howard Weil energy conference in New Orleans, it appears that Halcon may not drill any more wells in the Ohio Utica…ever.

Wilson said yesterday at the investor’s conference that it is his end-game to sell Halcon to a bigger fish. Wilson started Halcon 2011. In order to sell the company, he’s working to make it more attractive to investors. Wilson knows a thing or two about building energy companies and selling them–he built up and sold Petrohawk Energy to BHP Billiton Plc in 2011 for $12.1 billion.
