Judge in XTO Criminal Spill Case Says Figure Out Your Own Charges

A small development in the shameful case brought by Pennsylvania’s anti-drilling Attorney General, Kathleen Kane, against XTO Energy over a four year-old accidental spill that she’s trying to prosecute as a crime (see PA AG Abuses Her Authority, Files Criminal Charges Against XTO). XTO filed paperwork with the court to ask for more information about the charges that have been made against them. Apparently environmental cases are quite complex and you don’t always know what, exactly, you’ve been charged with!

The judge in the case has denied XTO’s request to be told what, exactly, they’re being charged with. Last Thursday Lycoming County Judge Marc Lovecchio essentially told XTO, “You figure it out”…

Frack Sand Train Derails Near Allentown, 6 Cars Spill Near Homes

MDN is always a sucker for a good railroad story. We love how the fracking industry has breathed new life into the short line railroad business–especially in Pennsylvania. However, this particular railroad story is not such a happy one (although it could be worse).

Last Saturday a 45-car train for the Delaware-Lackawanna Railroad was pulling a load of frack sand through Northampton County (Allentown area) when six of the cars derailed, spilling sand. Even though the accident happened in a populated area near homes and businesses, because the train was going a very slow 5 miles per hour, no one was hurt and no homes or businesses were damaged. Cleanup of the mess is set to begin today…

Range Resources Fined $75K by PA DEP for Brine Spill

On Friday the Pennsylvania Dept. of Environmental Protection slapped Range Resources with a $75,000 fine for a brine spill of 3,066 gallons at its Cornwall Mountain Hunting Club Unit A well pad in Lewis Township, Lycoming County. The spill occurred in July 2012, but according to the DEP it took Range nearly a year to remediate the spill, resulting in the fine.

Williams Restores Service on Ruptured WV Pipeline, More Details

Last Friday MDN told you that Gastar had given a helpful update on the Williams 12-inch pipeline that had ruptured after a landslide in Marshall County, WV on April 5th (see Gastar Helpfully Provides Update on Williams WV Pipeline Outage). We gently prodded Williams and told the PR department it needs to get in gear and start talking. Well, they did. Friday afternoon Williams issued a short statement on their Williams in the Northeast website (see it below). According to the statement, full service was restored as of 1:30 pm Friday afternoon.

Now as for the rupture and explosion itself, we learn from a news story that the West Virginia Department of Environmental Protection continues their investigation. We also learn the explosion created a 10-foot crater and scorched trees for two acres around the blast site. Gastar Helpfully Provides Update on Williams WV Pipeline Outage

Last Saturday a 12-inch natural gas pipeline owned by Williams Partners in Marshall County, WV ruptured and caught fire, likely due to a landslide (see Williams Pipeline Rupture/Fire in Marshall County, WV). Not long after, one of (perhaps the) driller affected by the pipeline outage, Gastar, announced it had shut in their wells in the area–a necessary precaution to warn investors that certain targets may not be met because of the pipeline outage (see Gastar Shuts-in Marshall County Wells Due to Pipeline Explosion).

We continue to get our best information on the pipeline outage from…Gastar! We haven’t spotted a single public statement from Williams about the outage (Williams PR department, get on the ball!). Yesterday Gastar said most of their gas is flowing again, through a different Williams pipeline. Gastar also says Williams told them the ruptured/down pipeline should be repaired and operating again in “approximately three weeks.” Thanks Gastar, for keeping us up to date on the Williams pipeline…

PA DEP Says Chevron Blocked Access to Greene County Well Fire

On Feb. 11 Chevron’s Lanco 7H well in Greene County, PA exploded and caught fire. Although it’s not clear what caused the explosion, workers were connecting the well to a gathering pipeline (i.e. welding) and it’s not much of a stretch to connect the dots. One of the workers at the site tragically lost his life (see Remains of Chevron Contractor Found at Greene County Well Site). The fire at Lanco 7H spread to the well next it–Lanco 6H. After five days the twin fires were put out and eventually the wells were capped (see Chevron Well Fire Update: 2nd Well Capped, Work on 7 Wells Stopped).

Both the PA Dept. of Environmental Protection (DEP) and Chevron continue to investigate what went wrong. However, three weeks ago the DEP issued a preliminary Notice of Violation about the accident and fires (see it embedded below). The surprising revelation in the NOV is that Chevron blocked DEP personnel from accessing the site for two days while the fire burned. DEP personnel, by law, have carte blanche access to any well anywhere at any time. Chevron was no doubt trying to protect the DEP agents, however, blocking them from the site clearly rankled the agency and will now be part of a fine they eventually assess on Chevron…

WV Conference Speaker Says PA is Tops with Spill Containment Regs

The main focus for the West Virginia Oil and Natural Gas Association’s ShaleSafe Conference and Expo at Oglebay Park in Wheeling this week was silica dust exposure (see MDN’s related article published today). However, another session was a close second as Topic A–the session on spill containment. The sole presenter on spill containment was Beth Powell from New Pig Energy. Spill containment became a huge topic for everyone in West Virginia after a chemical spill related to coal mining affected the drinking water for 300,000 WV residents earlier this year. In the aftermath of that spill, the WV legislature passed new regulations for chemical storage tanks–regulations that affect not only the coal industry guilty of the spill, but also the shale drilling industry too (see Impact of WV’s New Chemical Tank Law on Marcellus Drillers).

Ms. Powell had some interesting things to say about spill containment–and she should know since well pad containment systems are New Pig’s business. Among her comments, Powell said Pennsylvania’s Dept. of Environmental Protection (DEP) regulations are far more strict than either West Virginia or Ohio when it comes to spills and spill containment. Now that’s something you don’t hear from anti-drillers in PA who try to paint the DEP as lax, derelict in their duty, and in bed with the drilling industry…

Gastar Shuts-in Marshall County Wells Due to Pipeline Explosion

Last Saturday morning a Williams pipeline in Marshall County, WV ruptured and caught fire (see Williams Pipeline Rupture/Fire in Marshall County, WV). We still don’t know the cause for sure, but it’s looking like there was a small landslide from a hill that triggered the rupture and explosion.

Already that single 12-inch pipeline is having an effect on some Williams customers. Gastar Exploration with wells in Marshall County issued a statement on Monday to say they’ve had “shut-in” their wells in the area because of the pipeline outage. Anti-Drilling Groups Want PA DEP to Investigate 2-Yr Old EQT Spill

It’s always a sad day when we report the death of a shale worker in the Marcellus or Utica. David Zamora, a 43 year-old father of a 10 year-old son, was killed on Saturday when a piece of equipment crushed him at a Rice Energy drill site in Belmont County, OH.

Williams Pipeline Rupture/Fire in Marshall County, WV

A 12-inch natural gas pipeline owned by Williams Partners in Marshall County, WV ruptured and caught fire Saturday morning around 8 am. The early reporting says a landslide from a nearby hill caused the rupture, which happened to a section of pipeline between Waymans Ridge and Middle Grave Creek. Some residents living near the pipeline were evacuated as a safety precaution.

Sunoco Logistics Oil Pipeline Leaks 20K Gal in OH Nature Preserve

Last Tuesday Sunoco Logistics discovered a 5-inch crack leaking crude oil from their Mid-Valley Pipeline–and the oil was leaking into the Oak Glen Nature Preserve just west of Cincinnati, OH. Ouch. Initial reports were that 10,000 gallons of oil had leaked before the pipeline between Hebron, KY and Lima, OH was shut off. That estimate has been doubled–it’s now thought more than 20,000 gallons of oil leaked. Double ouch.

What does this have to do with Marcellus/Utica shale drilling? Not much. It’s possible some of the oil comes from Ohio–more likely from other locations (we don’t know). Sunoco Logistics is the company that has built (and is building) the Mariner West and Mariner East ethane/NGL pipelines–but it’s a stretch to compare those gas pipelines with the Mid-Valley oil pipeline. The connection between the oil spill and northeast shale drilling is this: MDN editor Jim Willis first learned about the leak at the Oil & Gas Awards’ “Conference for Excellence” last week in Pittsburgh. Jim was sitting next to an official from McCutcheon Enterprises–one of the companies called in to clean up the mess–who told Jim about the spill and his company’s rapid response to work on getting it cleaned up…

Anti-Drillers Attack Crude-by-Rail Traveling Through PA

The leftist anti-drillers at the Pennsylvania news organization called PublicSource, backed by the likes of Teresa Heinz Kerry, is taking aim at shale-produced crude oil that travels by railroad. In a hit piece in which they begin by doing a bait-and-switch, starting with a derailment of ethanol (nothing at all to do with oil or gas), they then parry and say derailments of oil in Pennsylvania are an imminent threat and danger to PA residents. The hue and cry has gone up: Either have the feds regulate shale oil on railroads out of existence, or preferably just stop shipping crude by rail. Who wants all that nasty crude from North Dakota anyway? Funny how the answer is always the same no matter the question: just stop extracting fossil fuels.

Williams Pipeline Connection in NEPA Leaks Brine Near Local Lake

A Williams pipeline in Susquehanna County, PA used to carry brine (salty water from the depths that comes out long after fracking is done and over) was found leaking earlier this week. A pipeline interchange leaked an unspecified amount of brine and left what appeared to be a copper-colored dust over land owned by the Loomis Lake Association.

The Lake Association is understandably concerned that some of the brine may have leaked into the lake itself. Daily testing is underway to determine if the brine reached the lake. Williams has cleaned up the leftover dust–and the PA Dept. of Environmental Protection is investigating. No one is panicking, but everyone is on high alert and keeping a close eye on the situation…

NTSB Faults NiSource/Columbia for WV Pipeline Explosion in 2012

On December 11, 2012, a portion of the Columbia Gas Transmission pipeline (owned by Nisource) exploded near Sissonville, WV, 10 miles north of Charleston. The resulting fire burned for more than an hour and shut down a portion of nearby Interstate 77 for days (see Columbia NatGas Pipeline Explodes Near Charleston, WV). It’s been a long time coming, but on Monday the National Transportation Safety Board (NTSB), that did a full investigation of the explosion, turned in their final report. It was pretty damning for NiSource/Columbia. The conclusions of the investigators are that a) the pipe had corroded in that section–a long time ago, and b) Columbia hadn’t inspected that section of pipeline since (unbelievably) 1988. In other words, it was an accident waiting to happen.
