WV Drillers Say Permits Take Too Long to Get Approved

West Virginia drillers were not happy last year that it was taking three, sometimes four months to get a new Marcellus or Utica Shale drilling permit approved by the state Dept. of Environmental Protection (DEP). DEP Secretary Randy Huffman pledged to trim that number to 60 days. However, he now says 75 days is a more realistic target for drilling approvals given the complexities of horizontal drilling.

WV Drillers Have 2 Weeks to Review Complex New Air Pollution Regs

The West Virginia Dept. of Environmental Protection’s Division of Air Quality recently issued a draft document of new and revised regulations for controlling air pollution from oil and gas drilling well sites—and it’s a doozy. At 135 pages long (full copy embedded below), good luck reading, deciphering, and preparing to make intelligent comments on it—all by April 29th! (Railroading?) It appears to MDN the draft regulations are mostly aimed at complying with new rules issued by the federal EPA.

Second Death from Flash Fire at WV Pipeline Station

A second man has now died from injuries received last Thursday in a flash fire at a “pig receiving station” along a Eureka Hunter pipeline near Wick (Tyler County), WV (see Flash Fire at Pipeline Station in WV Kills 1, Injures 3 Others for our original report and background details).

Flash Fire at Pipeline Station in WV Kills 1, Injures 3 Others

A flash fire at a "pig receiving station" along a Eureka Hunter pipeline near Wick (Tyler County), WV last Thursday evening seriously injured three people requiring they be airlifted to Pittsburgh. A fourth person was taken to a local hospital. Sadly, one of the seriously injured workers, 56-year-old Bruce Phipps of Marietta, Ohio, died late Friday night. Pipeline Inspection Gauges (or Pigs) are used for pipeline cleaning, inspection and maintenance, and fluid batching in pipelines. A pig is pushed along the inside of a pipeline by the flow of liquid or gas. A pig launching station is used to insert the pig into a pipeline using a series of valves and hatches. The pig is pushed through the pipeline by the liquid or gas stream to the pig receiving station.

It was at such a receiving station where the flash fire occurred. According to news accounts, the flash fire was under control within 15 minutes…

WV “Forced Pooling with a Twist” Dies in Senate for 2013

Less than two weeks ago, MDN reported that "forced pooling" in very limited circumstances may soon be approved in West Virginia, in cases where the mineral rights owner for land adjacent to already-leased land either can’t be determined or can’t be found (see WV Legislation Would Create Forced Pooling – with a Twist). MDN thought the proposal was a common sense approach to solve an existing problem. However, the WV Senate apparently did not agree.

Senate Bill 616 never even made it to committee for consideration. It’s now a dead issue for this session of the legislature, which is nearing the end of its 60-day term for this year:

Antero Res 2nd Marcellus Driller to Use 100% NatGas Rig Engines

The parade of rig conversions in the Marcellus Shale to run on liquefied natural gas (LNG) continues. MDN previously told you about first EQT, then CONSOL switching to duel-fuel LNG/diesel engines. After EQT and CONSOL, Seneca Resources started to convert drilling rigs to run on 100% LNG (see Seneca Boasts First 100% LNG-Powered Drill Rig in Marcellus). You may now add Antero Resources to the club.

Antero recently converted the first of three rigs in West Virginia to run on 100% natural gas engines manufactured (as they were for Seneca) by General Electric. The engines will run on LNG, propane or even dry "field gas" that comes from the well itself. Kewl. From the Antero/GE press release:

Baker Hughes Rig Counts Hit New Low, But There’s More to Story…

Will NatGas Processed at New Natrium, WV Plant End Up in Asia?

Dominion, via it’s Blueracer Midstream joint venture with Caiman Energy, is building a $1.5 billion natural gas liquids processing plant in Natrium, WV. The plant is a bit behind schedule but due to go online later this spring (see Natrium, WV NGL Plant Behind Schedule, Will Open “Late Spring”). Dominion is also set to build a liquefied natural gas (LNG) export facility in Cove Point, MD as soon as certain government approvals are issued. They will invest a staggering $3.4-$3.8 billion to build it (see Dominion’s Cove Point LNG Facility Achieves Important Milestones).

With Dominion building both the Natrium and Cove Point facilities, it only makes sense some of the Utica and Marcellus natural gas that flows through the Natrium facility for processing will end up at Cove Point, and then on to either Japan or India:

District Court Judge Asks WV Supremes to Rule in Surface Rights Case

Waaaay back in July 2011 MDN told you about an interesting legal case in West Virginia in which a surface rights landowner was suing XTO because XTO is (in the opinion of the landowner) abusing the right to set up a well pad on his surface in order to get gas not only under the surface of his property, but also from his neighbors’ property (see WV Marcellus Legal Battle over Well Pads: Surface Rights Owners v. Mineral Rights Owners). The surface landowner, Richard Cain, acknowledges law and precedent allows XTO to set up a well on his land in order to get the gas under his land—but Cain maintains XTO isn’t really all that interested in getting it from under his land, but simply wants to use his convenient location to reach other nearby properties. Cain gets all of the headaches and none of the royalty money. Kind of a raw deal, from his perspective. Can’t blame him.

There is a new development in the case. The judge presiding over the case, U.S. District Judge Irene Keeley, has formally asked the WV Supreme Court to rule on the key question in the case since it will set a precedent (and has far-reaching consequences) for the entire state…

Feds Want to Force PA (Others?) to File Monthly Production Reports

Pennsylvania, Ohio and West Virginia state governments watch out—the federal government is making noise about requiring you to provide monthly production reports for oil and gas production. The AP says the feds are working on a “proposal” to have Pennsylvania in particular move to a monthly reporting system. When was the last time the federal government ever “proposed” something that wasn’t actually “required”? But we digress… Apparently, the Marcellus Shale Coalition is on board with this “proposal” as well…

New Landowner Group Forms in Tyler County, WV

A new West Virginia landowner group has formed in Tyler County with a mission to educate landowners and non-landowners alike, and to benefit landowners that join the group by pooling their property together to negotiate a lease. The new group, called the Middle Island Marcellus and Utica Mineral and Landowners Group, currently has 85 members and 8,000 acres. Landowners in Tyler are fortunate to be located in an area where both the Marcellus and Utica are oil and liquids rich.
