OOGA’s 2015 Year in Review: No Hike in OH Severance Tax in 2016

David Hill, president of the Ohio Oil and Gas Association (OOGA), provides an enlightening “year in review” for 2015. As part of his summary of the issues facing the oil and gas industry in the Buckeye State, he offers this with respect to an impending increase in the severance tax: “I am pleased to report that it looks like we won’t have to discuss the severance tax for the next year or so.” Good news indeed for drillers in Ohio in 2016. As Hill says, the price of oil and natural gas have collapsed–oil because of a worldwide oversupply, and natural gas (in the northeast) because of lack of pipelines. We get a rather sobering assessment of the Utica Shale industry in Ohio from Shawn Bennett, executive vice president of the Ohio Oil & Gas Association (OOGA). Shawn tosses around phrases like “survival mode” and “significant turmoil” and “perfect storm” when talking about the Utica and what’s ahead in 2016. His advice? Federal Judge Rules for EQT in Ohio Lease Dispute – Ramifications

An important decision was recently made in a lease case in Ohio–a case which has implications for both drillers and landowners with Marcellus/Utica leases. Driller EQT signed a lease with Jefferson County, OH landowner Alex Cooper on Oct. 6, 2008. The initial term of the lease was for five years, with a five year extension IF EQT makes an extension payment. The lease also stipulates that EQT MUST drill a well on or before Oct 6, 2013–the end of the first term of the lease. EQT opted to extend the lease, making (or rather attempting to make) a payment to Cooper–but EQT did not drill a well by Oct 6, 2013. Cooper claimed since EQT hadn’t drilled, the lease expired on Oct 6, 2013 and he is free to lease again. The case ended up in Federal District Court for the Southern District of Ohio and U.S. District Judge Algenon Marbley decided in favor of EQT, even though the language in the lease stipulates a well MUST be drilled during the first term of the lease. ODNR Boss: Ohio Will be Net NatGas Exporter in 2016

Little-know fact: Ohio is the seventh most populous state in the U.S. The only states with more population are California, Texas, Florida, New York, Illinois and Pennsylvania. Another little-known fact: In 2015 Ohio produced enough natural gas to meet the needs of 95% of what the state uses. Just four years ago that number was 9%. The director of the Ohio Dept. of Natural Resources (ODNR), James Zehringer, predicts that next year Ohio will produce more natural gas than can be used by the entire state–making Ohio a net exporter of natgas. Zehringer issued a year-end message from ODNR to tout not only the enormous production coming from Ohio’s shale fields, but also the big emphasis his agency places on safety for people and the environment…

Scare Tactics re Ohio Injection Wells Continue, Aided by Newspaper

The Columbus Dispatch is doing its best to paint safe frack wastewater injection wells as dangerous underground dumps ready to spring a leak at any moment and contaminate life as we know it. They’ve brought out their biggest anti arguments in a recent “article” (i.e. propaganda) that focuses on Athens County, OH–hotbed of far-left liberalism and anti-drilling sentiment. The article, boiled down, goes like this: Athens is a dumping ground for frack wastewater via injection wells. It saw the highest volume of wastewater disposed of by injection wells in the state, and most of the wastewater came from operations outside of Ohio. Implied (but not stated) in the article: It’s time to shut down injection wells in Athens County…

Dominion East Ohio Gas Bills Fall 40% in 1 Year, Thx to Shale

Utility company Dominion East Ohio says it’s customers are benefiting from the low cost of natural gas, thanks to the Marcellus and Utica Shale. In fact, according to Dominion, the cost of the gas itself is down 53% this year over last–and the savings gets passed on to consumers. That’s really good news for those who heat and cool using natural gas. Just because the commodity itself is only half the price, doesn’t mean rate payers will see their bills go down by the same amount. There are two components to the price consumers pay: the commodity flowing through the pipes, and the pipes/infrastructure itself. 2016: Fewer Rigs Operating, Less Gas Flowing in Marcellus/Utica

This is the time of year when prognosticators come out of their prognostication holes to prognosticate about the rapidly-approaching New Year. Some of those predictions involve the Marcellus/Utica industry and what we may see coming our way in 2016. And what might we see? Most believe we’ll see cut-backs in drilling–most companies have announced such plans. However, one thing we won’t see is all drilling stop. As we highlight in a companion story today (see Why Do Marcellus Drillers Continue Drilling with Prices in the Basement?), drillers will keep drilling in the Marcellus in 2016. Perhaps not as much as they drilled in 2015–but make no mistake, the industry is not finished. CORN Questions Canadian Decision to Buy American NatGas via NEXUS

On Monday MDN told you that the Ontario Energy Board (OEB) has cleared the way for the Canadian portion of the NEXUS Gas Transmission pipeline by approving two 15-year contracts to use the pipeline to deliver natural gas to the Dawn Hub (see Canada Approves Marc/Utica NEXUS Pipeline to Dawn Hub in Ontario). A group of anti-fossil fuel radicals who call themselves CORN (Coalition to Reroute NEXUS) has popped up to manufacture a controversy where none exists. Apparently one or two staffers at the OEB offered a dissenting opinion (as is often the case) for why the two contracts for the NEXUS should not be granted. Somehow those internal documents were leaked to the CORNballs (our name for members of CORN) who are now attempting to claim the OEB ignored the recommendation of its own staff and approved the contracts when (according to CORN) it should not have. We wonder if the CORNballs know that an average 7 billion cubic feet of natural gas flows from Canada to the United States every day, and that an average 1.5 Bcf/d flows from the U.S. to Canada every day? Do they know that gas has been going back and forth across our border with Canada for decades? Why do they oppose this particular pathway of trade with Canada, which would strengthen ties with our friends to the north?…

Turns Out “Foreigners” Working in OH are a Good Thing After All

For years MDN has poked fun at RINO Ohio Gov. John Kasich for his jingoistic talk about not wanting “foreigners” in his state working at Utica drilling sites (see this story from three years ago – OH Gov. Kasich Continues Trash Talk Out-of-State Workers). Don’t tell Kasich, because he hates hearing this, but some are now saying that because Ohio has been employing “foreigners” from exotic places like Texas and Louisiana to work at Utica drilling sites, it has actually turned out to benefit the state. Why? Because in this downturn Ohio businesses are not as adversely affected. If all of those people now laid off had been Ohioans, the Ohio economy would have taken a much harder hit than it has. That’s one of the points in a Cleveland Plain Dealer article. Another point in the article is that because the Ohio Utica is much smaller and was just ramping up as the current price crash hit, when prices recover (and they will recover, eventually), Ohio will take off much faster than the big, old, decrepit Marcellus in Pennsylvania…

Really Cool Maps & Charts Detailing Utica Drilling in Ohio

In reading a story in the Cleveland Plain Dealer about the prospects for the Utica to rebound when prices recover (see today’s companion story Turns Out “Foreigners” Working in OH are a Good Thing After All), we came across several charts and maps that are embedded in the article, and shareable. It’s a great series. Columbus Law Firm: How to Get the Best Pipeline Easement Deal

Goldman & Braunstein is a Columbus, OH law firm that’s carved a niche out of representing landowners in eminent domain disputes with pipeline companies. Earlier this year the firm asked the Federal Energy Regulatory Commission to disallow Energy Transfer Partners’ use of eminent domain in building the ET Rover pipeline (see OH Law Firm Asks FERC to Stop ET Rover Pipeline Eminent Domain). Michael Braunstein and Bill Goldman are at it again. Last week they held a meeting in Huron County, OH to advise landowners who potentially face eminent domain action by the NEXUS Gas Transmission pipeline project. They offer some good counsel. But make no mistake–they’re there to drum up business. Goldman & Braunstein do not say landowners can block the pipeline from coming through their property. What they do say is that their firm can get landowners a better deal, and ensure pipeline installation is “put in properly” by using (yep) Goldman & Braunstein. The firm believes landowners should be paid “over $100 per foot” for any deal they do with NEXUS. That’s the highest per-foot price we’ve ever heard of when it comes to pipeline easements. If they can pull that off, more power to ’em!…

Scottish Company Buys OH Construction Co for Utica/Marcellus Work

Wood Group, a $7 billion energy services company headquartered in Aberdeen, Scotland, announced this morning they are purchasing Kelchner Inc., a privately-owned construction firm. Kelchner is located in Ohio and concentrates on providing civil engineering and construction services for midstream and upstream companies in the Marcellus/Utica. Terms of the deal were not disclosed, but Kelchner generated sales of $93 million last year and Wood just got done buying a similar company along the Texas Gulf Coast by the name of Infinity Group for $150 million. So it wouldn’t surprise us if they paid a similar amount for Kelchner…

Don’t Know Jack: Politician Lobbies for High OH Severance Tax

The Marcellus and Utica Shale industry, like all shale industries in the U.S., is getting clobbered. Prices are at historic lows for natural gas–with no prospects it will go higher anytime soon (see Natural Gas Prices Hits 14-Year Low – When Will it Rebound?). Drillers (otherwise known as producers or E&Ps) can’t make a profit. Those who are making a profit are realizing profits that are razor thin–like break-even. So what does a “brilliant” politician like Ohio State Rep. Jack Cera (Democrat) lobby and advocate and agitate for? Raising the severance tax on shale drillers in Ohio. How utterly dense can you possibly be to not see that doing such a thing in this low-price climate would essentially shut down the Utica industry in the state? Or perhaps that’s what Jack really wants?…

Poly(ethylene) Wants a Cracker: OH Study Predicts Ethane Tsunami

A researcher and “Executive in Residence” from Cleveland State University, Andrew Thomas, writes about a new study produced by the University “to better understand the ramifications of huge quantities of natural gas and liquid ethane being produced in Ohio.” Unfortunately we were unable to track down a copy of the full study and its results, but we do have the summary as contributed by Thomas in writing for Crain’s Cleveland Business. And wow, what insights we gain! Thomas says the study he worked on concludes that even in this down market, Ohio’s production of natural gas liquids (NGLs), specifically ethane, is on a rocket ride to the moon. He says, “Ohio’s about to see an ethane tsunami.” He also says if all four ethane crackers that have been floated as possibilities for the region get built, that would only sop up one-third of the ethane supply projected to be produced in the Marcellus/Utica.
