VA Newspaper Takes AG to Task for Decision Allowing Fracking Bans

Earlier this week MDN told you about Virginia’s far-left Democrat Attorney General Mark Herring giving local municipalities the “right” to regulate and ban fracking (see Virginia AG Says Localities Can “Regulate” & “Prohibit”). What we didn’t know is that Herring’s “opinion” which is taken as law completely contradicts and undoes an opinion issued by his Republican predecessor, Ken Cuccinelli, who wrote that while municipalities can limit drilling to areas zoned for it, they can’t outright ban it. Herring, bowing to pressure from the kook fringe of his party, aims to change it. What gives us comfort is that we’re not the only ones to notice that Herring has stepped WAY over the line on this. None other than the editorial writers for the Norfolk Virginian-Pilot wrote an editorial yesterday that calls Herring to task for his recent overreach opinion on fracking…

Virginia AG Says Localities Can “Regulate” & “Prohibit” Fracking

Apparently Virginia’s Attorney General, Mark Herring, believes every county and town in the Old Dominion is populated with oil and gas experts. How else could he issue an advisory opinion that, in his opinion, every municipality in the state has the authority to regulate and/or prohibit fracking within its jurisdiction? Every other oil and gas producing state, save a bad decision made by New York’s highest court, says oil and gas regulation is solely under the purview of the state–and for good reason. The state employs oil and gas experts who know what they’re doing–what’s safe and what isn’t. How the process works. What pollutes and what doesn’t pollute. Researcher Uses Official UVA Email to Oppose Dominion Pipeline

The $5 billion, 550-mile Atlantic Coast Pipeline project is scheduled to pass from West Virginia through Virginia and into North Carolina bringing cheap, abundant Marcellus and Utica Shale gas to the southeast (see Dominion Commits to Major New Marcellus/Utica Pipeline Project). Many Democrats support the project, including Virginia Gov. Terry McAuliffe. But not all Dems support it. As with all proposed pipeline projects in the northeast/mid-Atlantic area, there are fossil fuel haters (global warmists) who oppose it simply because it’s a fossil fuel. One of those organizations is The Dominion Pipeline Monitoring Coalition, a group set up and run by a retired University of Virginia environmental scientist Rick Webb. Although Rick retired last year, he continues to participate in supporting several research projects at UVA, including the Shenandoah Watershed Study (SWAS) and the Virginia Trout Streams Sensitivity Study (VTSSS). Rick recently sent MDN (and other media outlets) an email from his official UVA email account to promote his anti-Atlantic Coast Pipeline group. We wonder if UVA supports Rick’s anti-pipeline activities and knows that he is using his UVA email account (with an implied connection that UVA supports what he’s doing) to denigrate Dominion?…

USGS Says There’s Plenty More Fossil Fuels to Come in Appalachia

There were plenty of fossil fuels in the past 150 years in Appalachia–an area stretching from the northeast to the south–and there’s plenty more where those came from. That’s the conclusion from an updated series of papers collected together in a new U.S. Geological Survey Professional Paper (#1708) called “Coal and Petroleum Resources in the Appalachian Basin: Distribution, Geologic Framework, and Geochemical Character” (free access, linked below). The USGS says, “Professional Paper 1708 is a modern, indepth collection of reports, cross sections, and maps that describe the geology of the Appalachian basin and its fossil fuel resources. Grimm’s Fairy Tale: Big Tobacco + Big Oil Give Birth to….Solar?

Here’s one weird and twisted bedtime story: Once upon a time there was a filthy Big Tobacco company. Big Tobacco hooked up with a wealthy (and equally filthy) Big Oil company and they had a baby. And the baby was…….solar panels?? Yep. Philip Morris, one of the largest cigarette manufacturers in the world has contracted with Dominion, one of the biggest utility/midstream companies in the Marcellus/Utica region, to install 8,000 solar panels at the Philip Morris facility in Chesterfield County, VA so they can make more cigs. It will be the largest solar installation to date in the state of Virginia. The only problem here is that the “bad guys” (Big Tobacco and Big Oil) are the heroes by installing solar instead of using natural gas. This is a real dilemma for the anti-drilling/anti-pipeline gang in the Old Dominion State. It may cause a brain hemorrhage…

WV to VA Mountain Valley Pipeline Changing Routes?

Last October the Mountain Valley Pipeline, a 330-mile project that will run from Wetzel County, WV to Pittsylvania County, VA, completed a successful open season to sign up potential customers (see EQT’s WV to VA Pipeline Open Season a Success, FERC Filing in Oct). The current path will take it through Giles, Montgomery, Roanoke and Franklin counties before ending at the Transco pipeline in Pittsylvania County. VA May Repeal Law Allowing Pipelines Access without Permission

Accessing a landowner’s property without permission, and later (potentially) forcing that landowner to allow a pipeline across the property via eminent domain have never been supported by MDN. Neither, it seems, is it supported by other pro-drillers, especially those in Virginia. State Sen. Emmett Hanger from Augusta County, VA (located in the Shenandoah Valley on the western edge of VA) is a conservative, business-friendly and pro-drilling Republican. Hanger, like MDN, supports Dominion’s $5 billion Atlantic Coast Pipeline (see Enormous Benefits for All Virginians from Atlantic Coast Pipeline). But Hanger, also like MDN, is not in favor of access without permission. Hanger is attempting to get a 2004 Virginia law repealed that allows access to private property without permission so Dominion (and others) can survey the property for pipeline routes. Rural Virginians Want Internet, but Not Natgas Energy to Access It

The publisher of Virginia Business, Bernie Niemeier, has a fascinating perspective on Dominion’s proposed $4.5 billion Atlantic Coast Pipeline project that would run through the Old Dominion state. Niemeier supports the pipeline, not the least of which because it will provide a huge economic boost ($450 million in direct benefit to the economy) and a jobs creator (2,800 jobs to build it). Niemeier notes the rapid objections to the pipeline–the “not here, not now, not ever” crowd that has come out of the woodwork. He compares their knee-jerk objections to efforts to build out internet access in rural areas, another project that would cut through the same “wilderness” areas and cause environmental “damage”. Dominion Sues VA Landowners to Allow Survey for Pipeline

In September, Dominion committed full force to building a 550-mile, $5 billion natural gas pipeline that will run from West Virginia, through Virginia and into North Carolina (see Dominion Commits to Major New Marcellus/Utica Pipeline Project). The project, called the Atlantic Coast Pipeline, will transport Marcellus and Utica Shale gas to the southeast. In November, Dominion asked the Federal Energy Regulatory Commission (FERC) to begin an environmental review of the project (see Dominion Asks FERC to Start Environmental Review of SE Pipeline). In order to do a proper review and to finalize plans for the route, Dominion surveyors need to get on property of landowners in Virginia who have, so far, refused them entry. Dominion Awards $1M in Grants to Colleges in Marcellus/Utica

Each year Dominion, a major midstream and utility company with operations throughout the northeast, donates money in education grants via their Dominion Foundation to schools ranging from pre-K through college in the states where Dominion does business: Ohio, Connecticut, Maryland, North Carolina, Pennsylvania, Virginia, West Virginia, and the District of Columbia. Dominion, you may recall, is the company building the East Coast’s first LNG export facility, investing $3.4-$3.8 billion (see Dominion Breaks Ground on Cove Point, MD LNG Export Facility). They also want to build the 550-mile, $5 billion Atlantic Coast Pipeline from WV to NC (see Dominion Asks FERC to Start Environmental Review of SE Pipeline). The company pumps a lot of money back into local communities where they operate with their investments. They also pump a good bit back via charitable contributions, including $1 million for colleges in the Marcellus/Utica region in 2014…

Trout Unlimited Volunteers to Watch GWNF for Fracking Effects

Two anti-drilling groups with benign-sounding names, Trout Unlimted and Wild Virginia, are training volunteers to monitor streams for effects from (so far) non-existent shale drilling in the George Washington National Forest. Trout Unlimited has been doing this sort of training/testing for years in places like the Delaware River Basin (see TU: Just Eyeball Those Streams, You Know What Shouldn’t Be There).
