    Anti-Pipeline Jihadists Pressure FERC re Atlantic Bridge Project

    In January the Federal Energy Regulatory Commission (FERC) gave its final stamp of approval for Spectra Energy’s Atlantic Bridge project (see FERC Approves Atlantic Bridge Project for New England/Canada). Atlantic Bridge will beef up capacity on the Algonquin Gas Transmission and Maritimes & Northeast Pipeline systems–to move more Marcellus/Utica gas to New England and Canada. Anti-fossil fuel jihadists like Food & Water Watch and the two U.S. Senators from Massachusetts, Elizabeth “Pocahontas” Warren and Ed “inside trader” Markey are doing their best to stop the FERC-approved project (see Mass. Senators Ask FERC to Reverse Atlantic Bridge Certification). The newest attack comes from Food & Water Watch, attempting to pressure/bully FERC into stopping construction until a “re-hearing” request is decided. Groups that don’t like a FERC decision can file for a re-hearing. FERC has X many days to consider the request until it is automatically denied. Once a re-hearing request is denied by FERC, enviro-jihadists can then file a lawsuit in court to try and make their case–but not before the re-hearing is denied. Since FERC does not currently have a quorum of three Commissioners to decide a re-hearing request (after Norman “cry baby” Bay left in a huff), FWW and others are demanding FERC put the brakes on Atlantic Bridge construction projects…

    PennEast Celebrates Lawsuit Dismissal, Takes Swipe @ Riverkeeper

    As we reported yesterday, a federal judge dismissed a lawsuit filed a year ago by THE Delaware Riverkeeper against the Federal Energy Regulatory Commission (see Fed Judge Dismisses Dela. Riverkeeper Lawsuit Against FERC). The lawsuit aimed to shut down the entire agency by defunding it (see THE Delaware Riverkeeper Sues FERC, Tries to Close it Down). The lawsuit claimed FERC can’t objectively make decisions about projects like the Penn East Pipeline (running from the Wilkes-Barre area to New Jersey) because FERC derives some of its operating revenue from the projects it either approves or does not approve. In other words, Delaware Riverkeeper tried to shut down a national agency because they object to a single pipeline project. Liberal U.S. District Justice Tanya Chutkan found Riverkeeper’s arguments lacking, to say the least. It took a day, but PennEast released their own statement about Riverkeeper’s lawsuit going down in flames.     Fed Judge Dismisses Dela. Riverkeeper Lawsuit Against FERC

    It took a whole year, but a federal court has just thrown out a frivolous lawsuit filed by Maya van Rossum, THE Delaware Riverkeeper, which attempted to defund the Federal Energy Regulatory Commission (FERC). Last year MDN reported on the lawsuit filed by Maya and company–a lawsuit which aimed to shut down the entire agency by defunding it (see THE Delaware Riverkeeper Sues FERC, Tries to Close it Down). Delaware Riverkeeper filed their lawsuit against FERC in U.S. District Court for the District of Columbia–one of the most liberal jurisdictions in the country. The lawsuit claimed FERC can’t objectively make decisions about projects like the Penn East Pipeline (running from the Wilkes-Barre area to New Jersey) because FERC derives some of its operating revenue from the projects it either approves or does not approve.     NJ’s Lib Dem Senators Bash PennEast Pipe Over Arsenic “Concerns”

    New Jersey’s reliably lefty Democrat U.S. Senators, Cory Booker and Robert Menendez, played to their fringe, unhinged base of eco-nut supporters by sending a letter to the Federal Energy Regulatory Commission claiming the PennEast Pipeline project, due to run through a small portion of NJ, “may” cause problems with arsenic–as in releasing the toxic substance into drinking water supplies from digging trenches and erosion. It is a flat out, bogus, BS claim–and they know it. But they were put up to the letter-writing task by some of their Big Green donors, including ReThink Energy NJ and New Jersey Conservation Foundation. It’s nothing new that campaign contributions (i.e. bribes) buy you access. PennEast has responded that the issue has already been addressed in their application with FERC–there is a plan to monitor and protect against any potential disturbance of the ground that would cause arsenic levels to increase.     Potential FERC Com. Powleson Calls Anti-Fossil Fuelers “Jihadists”

    We can’t speak highly enough of Rob Powelson, member of the Pennsylvania Public Utility Commission (PUC) and currently the president of the National Association of Regulatory Utility Commissioners (NARUC). As we recently reported, Powelson is one of three names being rumored as a nominee to the Federal Energy Regulatory Commission (see Names Mentioned for 3rd FERC Post, Incl. PA’s Powelson). It can’t happen soon enough! Yesterday Rob spoke at the Upstream PA conference in State College. He didn’t beat around the bush. In a very frank talk, Rob said equated fossil fuel nutters with Islamic terrorists when he said, “The jihad has begun…At the Federal Energy Regulatory Commission groups actually show up at commissioners’ homes to make sure we don’t get this gas to market. How irresponsible is that?” So true. These anti wackos have more in common with anti-American terrorists than they do with common, decent, ordinary Americans.     Maryland’s Traitorous “Republican” Gov Caves, Supports Frack Ban

    There were early signs that Maryland’s newly elected “Republican” governor was weak on the subject of fracking, as we pointed out in 2015 when we said that then-new Gov. Larry Hogan, who was elected on a platform of supporting shale drilling, had decided to let a two-year moratorium on shale drilling become law without his signature (see Maryland’s Pusillanimous Gov Allows Frack Moratorium to Become Law). We should have know then that Hogan has no political courage. Recently environmental nutjobs in Maryland have turned up the heat, demanding a total and complete fracking ban by passing a law. The House passed a bill to ban fracking (see Maryland Democrat Lawmakers Continue to Torpedo Fracking). The bill has, so far, been stalled in the Senate. But maybe not for long. On Friday, Gov. Hogan, a spineless “Republican,” said he now supports a complete and total ban on fracking, forever, in his state. He’s “concerned” that if the Senate puts the measure out for a public vote/referendum, fracking in the state might actually happen one day.     “Religious” Anti-Fracking Protesters Arrested in Annapolis, Maryland

    There is a concerted effort by a small group of fossil fuel haters to strip away the Constitutional property rights of all Marylanders by passing a permanent ban on fracking in the state. They’ve already convinced the Maryland House to pass a ban bill. The haters spew outright lies about fracking and attract local media outlets with gullible reporters who never question their outlandish claims. While they make false claims about fracking, that it pollutes water, air and in general kills everything, make no mistake–the root of their objection is that fracking extracts fossil fuels which, in the religion of environmental extremists, causes man-made global warming. That is what animates them. Unfortunately, as we have previously observed, Christian pastors from liberal denominations are claiming that the issue of fracking is a “moral” issue, a “good vs. evil” conflict (see Global Warming Jumps the Shark – Into Maryland Churches).     NY’s AG Schneiderman Sowing the Seeds of His Own Destruction

    New York’s corrupt Attorney General, Eric Schneiderman, is getting desperate. We want to go on record as one of the first to say he’s sowing the seeds of his own destruction. Schneiderman is a train wreck waiting (and about) to happen. We refer, of course, to Schneiderman’s eerie similarity to Captain Ahab in Moby Dick in attempting to hunt down ExxonMobil, Schneiderman’s great white whale. Recently Schneiderman, in cooperation with a sycophantic mainstream media, released information that former CEO Rex Tillerson (now Secretary of State) had a second email account. But unlike Hillary Clinton, Tillerson’s second account was not on a private server and was not used (as Schneiderman alleges) to secretly discuss how Tillerson “knew” burning oil and other fossil fuels causes mythical man-made global warming. Schneiderman’s action in running to the press to “reveal” a “secret” email account is a faint–a way to misdirect people from the real story, which is that Schneiderman continues to refuse to disclose his own emails that prove this whole Exxon witch hunt began when Schneiderman colluded and closely coordinated with the Rockefeller Brothers Fund, Rockefeller Family Fund, and billionaire green activist Tom Steyer.     SC Antis File FERC Challenge to Stop Marcellus Pipe to Charleston

    In March 2016, Dominion filed an official application with the Federal Energy Regulatory Commission (FERC) for a 55-mile pipeline project called the Transco to Charleston Project (see Dominion Files Application to Move Marcellus Gas to Charleston, SC). As the name implies, it will be a short pipeline to connect the Transco pipeline, which is in the process of reversing flows to bring Marcellus and Utica Shale gas south. This new pipeline will grab Transco’s Marcellus/Utica gas and send it to the Charleston, SC area. The projected in-service date is November of this year. However, this project, like every square inch of every pipeline project in the Eastern U.S., faces opposition from nutty anti-drilling radicals who vow to try and stop it even if it gets FERC approval (see SC Antis Fuss Over Pipeline to Carry Marcellus Gas to Charleston). In February, just prior to Commissioner Norman Bay resigning and leaving FERC without a quorum, the three FERC Commissioners voted to grant Dominion the certificate to build the Transco to Charleston pipeline (see FERC Approves SC Pipeline to Flow Marcellus Gas to Charleston).     THE Dela. Riverkeeper Issues Final Orders to Minions re DRBC Mtg

    Today is the day that (some of) Maya’s minions will show up at a meeting of the Delaware River Basin Commission to attempt to bully DRBC staff during the public comments period.     Report by Philly Antis Proves Mariner East 2 Pipeline is Safe

    A group of anti-fossil fuel nutters from the Philadelphia suburb of Middletown, PA (Delaware County) spent good money to buy themselves a report from an “independent” consultant that they say proves the Mariner East 2 Pipeline is too dangerous to build through their township. We don’t know how much the Middletown Coalition for Community Safety blew on the study, but we do know that Middletown Township is blowing $45,000 of taxpayer’s hard-earned money for a similar study (see Middletown PA Decides to Blow $45K (not $100K) on Mariner 2 Study). The Middletown Coalition was antsy, they didn’t want to wait for the town study to be completed, and they couldn’t risk a truly independent study finding the pipeline will be safe. So the Coalition moved ahead, no doubt using money from Big Green organizations to produce a report titled “Hazard Calculations for the Mariner East II Pipeline” (full copy below). The Coalition asked Quest Consultants, an Oklahoma-based firm, to evaluate what would happen IF a bunch of unlikely events were to happen. The report concludes: “IF the pipe were to rupture in Middletown Township, and IF the pipeline were operating at 1,500 psi while transporting ethane, and IF the release were oriented near to horizontal in the direction of the wind, and IF there are few obstructions to vapor cloud dispersion, and IF the weather conditions were 5 mph winds and stable atmosphere, the flammable vapor cloud could extend up to 1,800 feet from the pipeline.” The huge, gaping omission, the question the report does not address, is this: How likely is it that any or all of those things would actually happen? Our answer: near zero percent. In other words, the report just released by the Middletown Coalition proves that ME2 is safe!…

    Trump Spanks Radicalized Kids re “Climate Change” Lawsuit

    In August 2015, MDN told you about a lawsuit brought by a group of left coast radicalized children who want to force the federal government to become communist and “force action” on mythical climate change (see Group of Kids Sues U.S. Govt to Force Action on “Climate Change”). In November 2016, a lefty judge cleared the lawsuit to move to trial.     WV Residents Sound Off on Mountain Valley Pipeline

    The Mountain Valley Pipeline (MVP) is a $3.5 billion, 301-mile pipeline that will run from Wetzel County, WV to the Transco Pipeline in Pittsylvania County, VA. The project, which filed an official application with the Federal Energy Regulatory Commission in October 2015, is being built by EQT, NextEra Energy and several other partners. The project has faced stiff opposition from landowners in West Virginia (see Mountain Valley Pipeline Sues 103 WV Landowners for Survey Access). Last week the West Virginia Dept. of Environmental Protection held three public hearings on the project. As usual, the root of opposition against the pipeline is based on an irrational hatred of fossil fuels. One of the speakers at the Clarksburg hearing, a retired liberal Democrat school teacher, believes man-made global warming is a disaster in the making and this pipeline will contribute to the problem.     Mind-Numbed Antis Need Maya’s Instructions re DRBC Mar 15 Mtg

    The Delaware River Basin Commission (DRBC), charged with overseeing potential impacts on the Delaware River and the various tributaries that feed it, has stepped outside of its legal bounds with plans to review the PennEast Pipeline, part of which will run through the Delaware River Basin area. In 2014 the DRBC tried to tell PennEast and its sponsors that the pipeline will need their approval before it can be built (see DRBC Tells PennEast They Need DRBC (Not Just FERC) Approval). There’s just one teeny tiny problem with the DRBC’s plan. It’s called the U.S. Constitution. PennEast is permitted solely by the Federal Energy Regulatory Commission (FERC), not any other agency including the quasi-governmental DRBC. No matter, the DRBC is plowing ahead with its plan and will hold a public hearing this Wednesday, March 15. We previously shared with you the secret marching orders from anti-pipeline Nazis called THE Delaware Riverkeeper (see THE Delaware Riverkeeper Plans to Pack DRBC Hearing to Oppose PennEast). Our insider has sent us two more communications from Riverkeeper to the apparently mind-numbed robots they call supporters. The first email went out last Wednesday with instructions for the protesters who will attend the meeting. Riverkeeper is providing comments for them to read at the hearing. All of it 100% scripted. The follow-up email on Friday had to re-instruct the faithful. Apparently there was confusion and Riverkeeper had to tell them, once again, that they are to read from what THE Delaware Riverkeeper herself (Maya van Rossum) has written. Listen up stupids: you read what Maya wrote–you don’t depart from the script–or you risk her considerable wrath.     Antis Attempt to Stop Atlantic Sunrise Pipe by Attacking FERC Order

    Sometimes this regulatory stuff gives us a headache. Like today. A common practice by anti-fossil fuel nutters when opposing a pipeline project at the Federal Energy Regulatory Commission (FERC) is to request a “re-hearing” on a decision FERC has made to authorize a project. It’s just standard operating procedure. If the antis can get FERC to agree to a re-hearing, it effectively slows, even stops, an active pipeline project. So in an effort to prevent important projects from being slowed or stopped, FERC developed something called a “tolling order”–which grants FERC more time to consider whether or not a full re-hearing is justified. During the time of the tolling order (which can last up to six months), work on a pipeline continues. Sometimes the work even gets completed! Which of course drives the antis bonkers. Antis claim FERC uses tolling orders to avoid lawsuits. You see, antis can’t take their frivolous cases to a court until FERC has officially denied a re-hearing request. So by using a tolling order, FERC can drag out the process of deciding to deny a re-hearing, avoiding the inevitable frivolous lawsuit that comes with it, and work on important projects gets done. This is how things must operate in our litigious society that tolerates the antics of anti-fossil fuelers (with seemingly bottomless pockets of money to litigate every project). New wrinkle: When FERC Commissioner Norman “cry baby” Bay resigned in a huff effective Feb. 3, it left FERC without enough Commissioners (without a quorum) to vote on tolling orders, re-hearing requests, etc. So on Feb. 3, before Bay left, the existing three Commissioners delegated their authority over re-hearings and tolling orders to FERC staffers–until a new Commissioner is appointed and sworn in. Antis against Atlantic Sunrise are using the delegated tolling order issue against FERC in their attempt to stop commencement of construction on Williams’ Atlantic Sunrise Pipeline project, claiming they are being deprived of their “due process”…

    West Goshen’s Last Stand to Stop Mariner East 2 Pipeline

    There are a few last, desperate gasps at attempting to stop Sunoco Logistics Partners’ Mariner East 2 natural gas liquids (NGL) pipeline from being built. The pipeline is currently under construction (see Mariner East 2 Pipeline Constructions Begins Across PA). Even though trees are getting cut and pipeline is being laid, that doesn’t stop libs in places like West Goshen Township (Chester County, near Philadelphia) from attempting to deny Sunoco a zoning permit for a valve on the pipeline. Sunoco has politely, but firmly, told West Goshen the pipeline doesn’t need a permit from the town to install a valve because it’s a state-permitted project. In other words, go pound sand. Sunoco plans to move forward, at the appropriate time, with installation and wants assurances from West Goshen the town won’t send in a local cop to stop them. It could get messy…
