McKean County Injection Well Operating Without Permit from PA DEP
On May 14, the Pennsylvania Department of Environmental Protection (DEP) issued a notice of violation to Sandstone Development LLC for operating the McKay 7A conventional well as an oil and gas wastewater injection disposal site in McKean County without a state permit. Which may sound like a major, flagrant (intentional) violation. But it’s not. Sandstone holds a federal EPA permit allowing daily injections of up to 10,500 gallons. Sandstone said it was unaware that, in addition to the federal EPA permit, it is also required to seek and obtain a state DEP permit for the same thing. The highly functional and responsible Susquehanna River Basin Commission (SRBC), unlike its highly dysfunctional and irresponsible counterpart, the Delaware River Basin Commission (DRBC), continues to support the shale energy industry by approving water withdrawals and consumptive use requests for responsible and safe shale drilling. The SRBC published a notice in the December 6 Pennsylvania Bulletin that the Executive Director of the SRBC approved and/or renewed 76 general water use permits from September 1 through October 31 for individual shale gas well drilling pads in Blair, Bradford, Cameron, Centre, Clearfield, Clinton, Elk, Huntingdon, Lycoming, McKean, Sullivan, Susquehanna and Tioga counties in Pennsylvania and one permit to withdraw water in Steuben County, New York. 
Pennsylvania’s Attorney General, Dave Sunday, pretends to be a Republican, but he’s really a Democrat. He’s also anti-shale, as evidenced by a wild attack against Seneca Resources launched on Friday. Sunday’s office filed three separate criminal complaints against Seneca, charging the company with 64 counts of criminal violations of the Solid Waste Management Act and 36 counts of criminal violations of the Clean Streams Law. Sunday, like his left-wing predecessors, is turning what should be regulatory enforcement actions into crimes. No wonder some drillers are saying “screw you” to Pennsylvania and moving their drilling operations to West Virginia and Ohio. 
On September 24, the U.S. Environmental Protection Agency (EPA) granted Sandstone Development, LLC a permit for an oil and gas wastewater injection well in Lafayette Township, in McKean County. The permit authorizes Sandstone to inject up to 10,500 gallons per day of produced fluids from the McKay 7A conventional well to enhance oil and gas recovery in the McKay Lease area. Injection will occur into the Upper Devonian Kane Sandstone Formation at depths between 2,295 and 2,315 feet. A public hearing on the permit application was conducted in May.

The radicalized Environmental Defense Fund (EDF), in partnership with the equally radicalized Moms Clean Air Force (MCAF), is joining forces with the Pennsylvania Department of Environmental Protection (DEP), the U.S. Department of Energy (DOE), and (very oddly) McGill University, which is located in Montreal, Quebec (Canada) to launch a project to identify and “facilitate remediation of” orphan and abandoned oil and gas wells across Western Pennsylvania. The group will fly specially outfitted drones about 100 feet above ground in Clarion, Venango, and McKean counties in western PA to try and identify and catalog orphaned and abandoned oil and gas wells.

Here’s a story that escaped our radar…until now. Catalyst Energy, Inc., proposes converting an existing gas production well on Route 646 in Cyclone (Keating Township in McKean County, PA) into a shale wastewater injection well. The well would handle up to 30 truckloads of wastewater per day. The prospect of the traffic and location near some homes did not sit well with some local residents. However, the PA Dept. of Environmental Protection (DEP) approved the plan on Jan. 11, although it didn’t publicly announce the approval until Tuesday, Jan. 23.
New shale permits issued for Nov 27 – Dec 3 in the Marcellus/Utica were much improved over the previous few weeks. There were 25 new permits issued last week versus 14 issued two weeks ago and just one new permit three weeks ago. So the trend is our friend! Last week’s permit tally included 15 new permits in Pennsylvania, 8 new permits in Ohio, and 2 new permits in West Virginia. Three companies tied for top place with 4 permits each: Seneca Resources in PA, Ascent Resources and Encino Energy in OH.
