    Biden IRS 45V Tax Rule Endangers Hydrogen Hub Projects in M-U

    For months, MDN has told you about a problem brewing that will block new hydrogen projects from getting built in the Marcellus/Utica. It’s an obscure tax rule known as the 45V tax credit, part of the misnamed Inflation Reduction Act (IRA). The Bidenistas at the White House, Treasury Department, and Dept. of Energy proposed a new IRS rule in late December that the 45V tax credits (as provided for in the IRA) can only be used if the hydrogen produced is “green” — meaning NOT made from natural gas. In addition, the electricity used to produce the hydrogen can’t come from fossil fuel sources like natural gas (if you want the tax credit). Biden kneecapped the hydrogen hub projects in the M-U (see Biden’s Proposed IRA 45V Tax Credit “Kneecaps” ARCH2 Hydrogen Hub).

    Ohio Bill to Encourage New NatGas Pipelines Passes Committee Vote

    A new bill proposed by two Republican state lawmakers in Ohio, House Bill (HB) 349, makes it easier to site and build natural gas pipelines to areas of the state where pipelines currently don’t exist (see Ohio Bill Encourages New NatGas Pipelines to Spread Across State). The bill will stimulate new jobs by running pipelines to industrial parks and businesses not currently serviced by natgas. The aim is to stimulate new jobs and opportunities in the Buckeye State, a smart strategy. Good news: HR 349 was just passed by and reported out of the Ohio House Economic and Workforce Development Committee and will be voted on by the full House.

    Senate Confirms 3 New FERC Commissioners; Less Support for Dems

    In early March, President Joe Biden nominated three new candidates to become Federal Energy Regulatory Commission (FERC) commissioners (see Biden Announces 3 New FERC Commissioner Nominees, Finally). The three, two Democrats and one Republican, faced questions from the Senate Energy & Natural Resources Committee in a hearing held a few weeks later (see 3 FERC Nominees on the Hot Seat at Senate Hearing, No Fireworks). Last week, the Senate Energy and Natural Resources Committee overseeing their nominations and appointments voted to advance all three to a full floor vote (see U.S. Senate Energy Committee Approves 3 Biden FERC Nominees). The full vote happened this week, and all three were confirmed.

    Coterra Energy CEO Tom Jorden sat for an interview with Jim Cramer on CNBC’s Mad Money program Tuesday evening. During the interview, Jorden had an interesting comment and insight that has the power to change the natural gas market. Jorden said that data center operators (big computer server facilities) may cut supply agreements directly with natural gas companies to meet the growing power demands of the artificial intelligence boom. And it may happen a lot sooner than you think.

    Briggs v SWN Rule of Capture/Trespass Court Case Resurrected

    In January 2020, the Pennsylvania Supreme Court ruled in THE most consequential lawsuit for Marcellus Shale drilling we’ve seen, a case called Briggs v Southwestern Energy (see HUGE NEWS: PA Supreme Court Keeps ‘Rule of Capture’ for Fracking). The PA Supremes ruled in favor of Southwestern, retaining the “rule of capture” in the Keystone State. Little did we know, but in 2022, the Briggs filed a new lawsuit, call it “Briggs 2,” along the same lines, alleging that Southwestern’s drilling and fracking on a neighboring property has intruded (“trespassed”) under the property line and drained gas from the Briggs property. Here we go again…

    Reaction For and Against FERC Permission for MVP to Start Up

    Yesterday, MDN brought you the great news that the Federal Energy Regulatory Commission (FERC) had given permission to Mountain Valley Pipeline (MVP) late Tuesday to begin service along the 303-mile natural gas pipeline from northern West Virginia to southern Virginia (see FERC Grants Permission to Mountain Valley Pipeline to Start Flowing). As the reality of MVP coming online sets in, supporters are rejoicing, and irrational antis are bitterly complaining about their loss.

    Grid Operator Warns Climate Policies Pushing NY Toward Blackouts

    The grid operator overseeing New York State is warning that the Democrats’ green energy agenda is pushing the grid toward blackouts. The New York Independent System Operator (NYISO), which oversees and manages the state’s power grid, published its 2024 Power Trends report last week, assessing the outlook for energy supply and demand in the region over the next several years. The report warns that the electrification agenda pursued by New York Gov. Kathy Hochul and her fellow Democrats is pushing the state’s grid toward conditions for blackouts as soon as this summer.

    PA DEP Customer Service Advisory Board…Has No Customers on It

    Only in the dysfunctional Josh Shapiro administration. Yesterday, the Pennsylvania Dept. of Environmental Protection (DEP) announced it had added a Customer Experience Management Advisory Council (CXMAC) to advise the DEP’s Acting Secretary and so-called Chief Customer Experience Officer on strategies and improvements to enhance service delivery to the public. The thing is, none of the board members are actual customers of the DEP! There are no oil and gas members on the board. There are no members of the public on the board. Only well-connected people from private businesses, non-profit organizations, and (worst of the worst) other government agencies landed a spot on the board. Some people actually think PA Gov. Josh Shapiro is presidential material. What a joke!

    Digging Deeper into EIA’s Replacement for Drilling Prod. Report

    Yesterday, MDN told you that the U.S. Energy Information Administration (EIA) has decided not to produce its monthly Drilling Productivity Report (DPR), a report that delves into the latest numbers for each of the seven major shale plays in the U.S. (see Biden EIA Dumps Detailed Monthly U.S. Shale Drilling Report). Instead, EIA said it would publish the data found in the DPR in the monthly Short-Term Energy Outlook (STEO). Yesterday, the EIA published a blog post to say the change has resulted in *expanded* coverage of oil and natgas production, which we found odd.

    Venture Global Announces LNG Deal with DTEK of Ukraine

    Venture Global has been screwing its contracted customers by denying LNG shipments to them from its Calcasieu Pass (CP) LNG export facility for over two years, instead shipping over 200 cargoes to other buyers (at higher prices) rather than honoring its contracts. So why in the world would ANYONE sign a new deal with Venture Global for LNG shipments, given the company’s history of screwing its contracted customers? As Phineas Taylor Barnum is reputed to have said, “There’s a sucker born every minute.” This time, it’s DTEK Group of Ukraine.

    FERC Grants Permission to Mountain Valley Pipeline to Start Flowing

    Wonder of wonders. Yesterday, the Federal Energy Regulatory Commission (FERC) granted its permission for the 303-mile Mountain Valley Pipeline (MVP) to begin flowing natural gas. YES!!!! We are elated! Finally, nine years after MVP filed for permission to build, the pipeline is now (or soon will be) flowing Marcellus/Utica gas to the Southern U.S. This is a great day for all of the Marcellus/Utica.

    Continued Concerns with Water Wells Near EQT Frac-Out in Greene Co.

    In July 2022, MDN brought you news of a possible frac-out, or “inadvertent return” that happens when drilling mud pops out of places where it’s not supposed to — places outside the borehole being drilled (see Possible Frac-Out Reported at EQT Well Site in Greene County, PA). A landowner who lives near a well being drilled and fracked by EQT in Greene County complained her water well was fouled by EQT’s drilling and that a nearby abandoned well was releasing fluids and natural gas. According to the PA Dept. of Environmental Protection (DEP), EQT confirmed some of its fluids were “communicating” with the abandoned well. A year later, in August of 2023, the nearby community of New Freeport, where the frac-out happened, said the situation remained unresolved (see Possible Frac-Out Near EQT Pad in Greene County…One Year Later). However, on November 29, 2023, the Pennsylvania Environmental Hearing Board (EHB) accepted a settlement agreement between the PA Dept. of Environmental Protection (DEP) and EQT involving appeals of DEP actions related to the frac-out, settling the matter. Or so it seemed…

    June STEO Predicts Marcellus/Utica Production to Fall 4% in 2024

    Once a month, the U.S. Energy Information Administration (EIA) analysts issue the agency’s Short-Term Energy Outlook (STEO), their best guess about where energy prices and production will go in the next 12 months. We sometimes poke good-natured fun at the EIA because their predictions go up in one month, and in the next month, they go down, etc. What about the latest STEO dart board, published yesterday? EIA predicts the average spot price for natural gas will be $2.50/MMBtu in 2024, up $0.30 from its prediction just last month (see May STEO Predicts NatGas Production to Fall Slightly in 2Q). The agency also raised the average spot price prediction for gas in 2025. Last month, it was $3.10; this month, it was $3.20.

    Biden EIA Dumps Detailed Monthly U.S. Shale Drilling Report

    It is the sad end of an era brought about by the Bidenistas at the U.S. Energy Information Administration (EIA). For years, since the very first Drilling Productivity Report (DPR) issued by the EIA, MDN has brought you the monthly DPR, a report that delves into the latest numbers for each of the seven major shale plays in the U.S. The monthly DPR reported estimates of production for each play each month, along with DUC (drilled but uncompleted well) counts and other vital statistics. But, no more. We checked the EIA’s DPR report page today and found this notice: “Beginning June 11, 2024, we will publish the shale gas tight oil production data and Drilling Productivity Report data in the Short-Term Energy Outlook (STEO) data tables. These improvements will provide a disaggregated STEO forecast for oil and natural gas production in different regions of the United States.”
