PA DEP Dings PGE for Causing Muddy Water in Loyalsock Creek
The Pennsylvania Dept. of Environmental Protection (DEP) has served a notice of violation of the PA Clean Streams Law to Pennsylvania General Energy (PGE) for causing sediment pollution in the Loyalsock Creek north of Montoursville (Lycoming County). PGE is constructing a natural gas pipeline, a freshwater pipeline, and withdraws fresh water for Marcellus Shale-related activities at the site. On September 5 (Labor Day), a heavy rainstorm caused the failure of erosion and sedimentation controls. A sediment plume appeared in Loyalsock Creek for several miles downstream of the construction site.

For the week of July 18-24, the three Marcellus/Utica states issued just 16 permits to drill new shale wells, down from 43 the prior week. Pennsylvania and West Virginia both issued eight new permits each. Ohio issued a big, fat, goose egg. PA issued three permits each to Greylock Energy (Green County) and Pennsylvania General Energy (Tioga County), and one each to EQT and Seneca Resources. WV issued four permits each to Jay-Bee Oil & Gas (Tyler County) and Tug Hill Operating (Wetzel County).
Last week both Pennsylvania and West Virginia received permits to drill new shale wells. Ohio was left out of the permit game for a second week in a row. PA received 19 new permits, with 9 going to Range Resources, 4 going to Seneca Resources, and a smattering of others. WV received 9 new permits, all of them in Tyler County and all but 2 given to Antero Resources.
Unrepentant. That’s the best single word we can think of describing the attitude of “leaders” in Grant Township (Indiana County, PA) who illegally passed their own set of environmental laws, violating the PA state constitution, in a bid to prevent a safe saltwater injection well from being built in a rural location in the town. Grant continues to use radicalized lawyers in their lawbreaking bid to prevent the well.

The Pennsylvania Dept. of Conservation and Natural Resources (DCNR) is grabbing more money that we think belongs to private landowners. This time from leasing land underneath the Youghiogheny River and Little Pine Creek. DCNR has leased 124.2 acres for a signing bonus of $496,800 (or $4,000 per acre). Plus the state’s customary royalty rate of 20% on anything produced. And no, the state does not allow post-production deductions–they get their full 20% royalty.
