577 OH Utica Shale Wells Drilled – 0 Water Wells Contaminated

My water will be polluted! Don’t frack here! It’s the end of water as we know it!! Such are the refrains from anti-drillers–all of them not true. Want proof? Ohio has now drilled 577 Utica Shale wells over the past four years. The Ohio Dept. of Natural Resources’ Oil and Gas Resources Management division has investigated 183 water well contamination complaints related to drilling. Of those 183, six water wells were found to be adversely affected by drilling. But get this–none of them was from horizontal shale drilling–all six water well issues were caused by old vertical wells drilled in years gone by.

So let’s run those numbers: Of the 577 horizontal shale wells drilled so far in Ohio, there have been precisely zero nearby water wells adversely affected from that kind of drilling. Hmmm, sure paints a different picture than the doom-and-gloomer anti-drillers paint, doesn’t it?…

Electronic Permit Filing for Marcellus Drilling Coming Soon in WV

In December 2011 a special session of the West Virginia legislature took up and passed a new Marcellus drilling bill in record time–four days flat–although in reality it took most of 2011 to prepare the legislation. The WV Senate passed the “Horizontal Well Act” 33-0 and the House passed it 92-5. Gov. Earl Ray Tomblin signed it immediately. It’s now been nearly two years since then, time for a status report. WV Dept. of Environmental Protection (WVDEP) spokesman Tom Aluise says the new law is paying off. Aluise talked about a new electronic permit filing system on the way, and he identifies the top five counties in WV with Marcellus wells…

Information Lockdown at Heinz Endowments over Vagt Departure

Earlier this week MDN told you about the departure of Robert (“Bobby”) Vagt as president of the Heinz Endowments (see Bobby Vagt Out as Pres of Heinz Endowments – Fracking Connection?). It appears that at least one of the “green” board members of the Heinz Endowments (cough *Andre Heinz* cough) wasn’t happy that the family foundation decided to reach across the isle, under Vagt’s leadership, to work with the Marcellus Shale drilling industry on strict certification standards for drillers.

The problem is, no one knows for sure. It’s all still rumor and speculation. Heinz is being super tight-lipped and according to one reporter MDN spoke to, the organization is on “information lockdown” over this issue. Lights Turned Off, Door Closed – Good Night, Norse Energy

It’s a sad day for New York landowners–for everyone really. Norse Energy has converted from Chapter 11 bankruptcy, which means the courts protect you while you regroup, to Chapter 7, which means break it all up and sell off the pieces to the highest bidder. Norse has now literally, as well as figuratively, shut off the lights and closed the door behind them. The remaining eight employees of Norse have just been let go.

For years MDN has been writing about the plight of Norse and their inability to tap shale deposits under 130,000 acres of leased land in New York. The signs have been there for some time that Norse may face extinction if NY does not open up for shale drilling (see Norse Energy 2Q13: Concerned About Remaining ‘a Going Concern’). Thanks Gov. Andy! You sure know how to make NY “business friendly.” Norse announced the change to Chapter 7 last week in a very brief press release. Halcon Drilling 2 More Wells Near Lordstown, OH

Lights! Action! Noise! … No, it’s not the set of a Hollywood movie, but the resumption of drilling at a Utica Shale well site near Lordstown (Trumbull County), OH. Halcon Resources drilled one well at the “Kibler” site earlier this year, and during the drilling, neighbors complained about the nighttime noise and lights. That first Kibler well was so successful for Halcon, they’re back to drill two more on the same pad. This time, however, they double-dog promise to reduce the noise and lights by erecting a sound barrier and using directed lighting.

Still, some of the neighbors are not impressed and say they’d feel better if Halcon just walked over and talked to them about their plans…

Youngstown Hypocrites “Adjust” Language in Frack Ban Measure

In a transparently hypocritical move, anti-fossil fuel agitators who are placing a referendum on the ballot in Youngstown, OH for a second time this year have removed language that would have prevented one of the city’s biggest employers and businesses, Vallourec Star (manufactures steel pipes) from selling its pipes to the drilling industry. All other businesses that sell to the natural gas industry–you’re toast under the ban.

You see, it’s OK to profit from the drilling industry, it’s OK to use the cheap natural gas that comes from the drilling industry to heat homes and use for cooking–just don’t drill anywhere near me for that gas. It’s called “good for thee but not for me.” It’s hypocrisy on glorious display. If the dunderheads prevail in hoodwinking enough voters to pass the ban, we hope and trust Vallourec will still make good on their threat to move outside of the city limits–denying the city millions in tax revenue. And we trust the anti-frackers will turn off the natural gas spigot heating their homes–after all, it comes from fracking. Throw another log on the fire Wilma!…

When Do/Don’t Municipal Frack Bans Violate the U.S. Constitution?

When do (and when don’t) municipal bans on natural gas drilling violate the U.S. Constitution? It’s a sticky question and it takes an ace legal mind to tackle this broad and complex topic. An ace attorney has done just that. MDN friend and litigator Ken Kamlet from the Binghamton law firm Hinman, Howard & Kattell (HHK) does a deep dive on the topic of when town bans violate the Constitution. This is not a theoretical exercise for Kamlet. The lawyers at HHK are currently suing (on behalf of landowners) the village of Sidney, NY (Delaware County) over a ban they passed in February 2013 (Exclusive: Sidney, NY Sued by Landowners over Fracking Moratorium).

Are Marcellus Drilling Regs Killing Conventional Drilling in PA?

A pair of north central PA Republicans from the Pennsylvania House of Representatives along with “hundreds” of independent oil producers are sending a message to PA politicians and regulators: You can’t use the same broad brush you’re using with unconventional shale drilling to paint the traditional conventional drilling in the state. The independents say that new regulations crafted for Marcellus Shale (deep) drilling should not apply to conventional (shallow) drilling and if this ongoing “unfair” situation continues, it will drive conventional drilling in the state, which has been around for 150 years, out of existence.

Do the independents have a point? Are they an “apple” being regulated by unfair and overly strict “orange” standards? Or to change up the metaphors, is this a case of the buggy whip industry grumbling about those newfangled automobiles?…

ecorpStim Tries to Interest France in Waterless Fracking Tech

In April, MDN told you about progress with a new waterless method of fracking that uses 100% nonflammable propane fracking fluid. The technique was developed by eCORP Stimulation Technologies, a subsidiary of eCORP International (see Non-Flammable Liquid Propane Used for 100% Waterless Fracking). ecorpStim, as they call themselves, doesn’t seem to have had much luck in finding drillers in the U.S. to use their technology–no doubt because it’s so cheap to use water for fracking.

Sensing there may be an opportunity, ecorpStim recently went on a field trip–to France–to present their technological “break through” to members of the French Parliament. You may recall the French Supreme Court recently upheld a countrywide ban on hydraulic fracturing–at least fracking that uses water (see France’s Fracking Ban ‘Absolute’ After Court Upholds Law). Since water fracking isn’t an option in France, ecorpStim is hoping the French will consider a slightly more expensive, non-water option for fracking…

Radioactive Bilge Emanates from ‘Radioactive Waste Alert’ in OH

Unfortunately the old Chinese proverb has come true: We live in interesting times. We live in a day and age when thinking, contemplation and logic are foreign concepts to many people. Instead, we get the pablum of headlines, sound bites and billboards. The latest pristine example of non-thinking comes from a billboard near Columbus, OH that targets a business doing great work for the shale drilling industry by recycling drill cuttings–the leftover dirt and rock from drilling a bore hole.

The billboard (see our Pinterest pics on right) says, “Don’t Frack My Water – Protect Columbus” and is sponsored by “RadioactiveWasteAlert.org” with a picture of a girl drinking what appears to be contaminated water from a bottle with a radioactive symbol on the side. It’s aimed at stopping Ohio Soil Recycling from doing the important work that they do (see OH Company Turns Drill Cuttings into Clean Fill Dirt in 24 Hours). What’s the average Columbus commuter going to think? Hopefully at least some of them won’t fall for this cheap shot–this un-thinking gimmick–from a fringe group of anti-fossil fuel nutters…

Bobby Vagt Out as Pres of Heinz Endowments – Fracking Connection?

In August MDN told you about a shake-up taking place at the Heinz Endowments with the firing of “longtime head” of environmental grant making for the Heinz Endowments, Caren Glotfelty (see Heinz Endowments Fires Head of Enviro Grants – Change Coming?). The story is an important one because of the role played by the Heinz Endowments in funding anti-fracking causes. Earlier this year, president of the Heinz Endowments, Bobby Vagt, dared to strike up first a conversation, then a pact, with drillers and a few other brave environmental organizations to found the Center for Sustainable Shale Development (see Important: Drillers & Enviros Form New Group, Launch Cert Program). Apparently Vagt’s “sell-out” to the drilling industry was the beginning of the end and the enviro-nut long knives came out for him (see Heinz Endowments President Owns $1.2M in Kinder Morgan Stock).

In what appears to be a move by one of the Endowments’ board members–one of the Heinz boys, Andre–Vagt announced he is “retiring” from his job as president of the Endowments. Looks like the long knives finally found their mark…

Can Donald Trump Save Fracking in NY?

While NY Gov. Andrew Cuomo continues to delay his decision about whether to go up against the nutjobs of his own party–to “man up” and allow fracking, or not–he continues to dream about running for president in 2016. But before he can do that, he has to win re-election as governor of NY next year, in 2014. A shoo-in? A fait accompli? Foregone conclusion? Don’t be so sure. There are a LOT of angry landowners in Upstate NY. And now, there’s Donald Trump.

Rumors are circulating that NY state Republicans are teeing up Trump to run against Cuomo next year, and so far, Trump is not saying “no” to the idea. Could it be that Trump will be the savior of fracking in NY?…

Tipping Point: More NatGas Now Produced by Shale than Conventional

According to energy consulting firm PIRA Energy Group, the United States has reached a tipping point: We now produce more natural gas from shale deposits and “tight gas” formations (i.e. “unconventional sources”) than we do from traditional, conventional sources.

In a wide ranging article (below), PIRA and others quoted talk about the tremendous drop in prices for natural gas and gas liquids, the startling turnaround in chemical manufacturing in this country (because of the abundance of cheap natural gas and feedstocks like ethane), and the importance of the Marcellus/Utica in this whole equation. Hint: Nearly 1/3 of the natural gas being produced from shale comes from the Marcellus/Utica…

Purdue Researchers: Shale Energy Adds $478B Per Year to US Economy

Researchers at Purdue University recently presented the results from two studies analyzing the economics of shale energy and its impact on the U.S. economy (summary embedded below). They discussed their findings at the annual North American joint conference of the United States and International Associations for Energy Economics in Anchorage, Alaska (in July). What did the Purdue researchers find?

Purdue researchers found that shale oil and gas will increase the gross domestic product (GDP) of the United States by an average of 3.5% per year through 2035. In raw numbers, that means each and every year shale is adding $478 billion to our economy–a number so large it’s breathtaking. It seems to MDN that shale energy is single-handedly keeping our country out of yet another recession…

Home Rule Case Before OH Supreme Court – Background

In 2004 the Ohio legislature passed a law that gives “sole and exclusive authority to regulate the permitting, location and spacing of oil and gas wells” to the Ohio Dept. of Natural Resources (ODNR). However, like Pennsylvania, New York and West Virginia, local municipalities have bridled against a law that says locals have no say in where an oil or gas well may be drilled. And like those other Marcellus/Utica states, Ohio municipalities have sued to overturn the law.

In June MDN told you the Ohio Supreme Court has accepted a case that challenges the 2004 Ohio law restricting so-called “home rule” or the right for municipalities to zone oil and gas wells (see Home Rule Case Heads to Ohio Supreme Court). MSC Releases Recommended Practices for Drilling & Completions

There are the rules and regulations that drillers must follow, issued by state laws and by regulatory agencies like the PA Dept. of Environmental Protection, the WV Dept. of Environmental Protection, and the Ohio Dept. of Natural Resources. The rules & regs are non-negotiable. But then there are “best” or “recommended” practices–those things drillers can and should do that go above and beyond the letter of the law. The Marcellus Shale Coalition, whose members are many of the largest energy companies in the world, has issued seven such “recommended practices” documents to date for its members. They’ve just released the eighth, titled “Recommended Practices for Drilling and Completions.”

This latest set of practices is arguably one of the most important, affecting how drillers drill–everything from spacing to safety to well control technologies…
