Labor Dept. Unfairly Targets Marcellus Industry in SWPA & WV

The U.S. Labor Department is on a witch hunt, unfairly targeting not only the Marcellus/Utica drilling industry–but any company in the entire supply chain that benefits from drilling, including hotels, restaurants and convenience stores. When you have the full force and backing of an out-of-control president like B.H. Obama, you get kind of drunk on your own power. That seems to be what has happened at the Labor Department. The Department of Labor’s wage and hour division in Pittsburgh has been targeting Marcellus-related companies since 2012, arriving for surprise audits of how companies classify employees–and how they pay them (particularly overtime payments). The jack boots have investigated 395 companies in three years and assessed $10 million in wages, civil penalties and liquidated damages and spurred a number of lawsuits by employees (and even the Labor Dept. itself) against employers. One question: Why hasn’t the Labor Department launched ANY investigations into the employment practices of Big Green organizations like the Sierra Club, THE Delaware Riverkeeper, William Penn Foundation, Heinz Endowments, PennFuture, Clean Air Council, Food & Water Watch and a myriad of other such organizations where wild-eyed zealots appear to work 24/7 for weeks on end in their mission to end all fossil fuels? Did Antero Pull the Rug Out from Under Fairmont Brine Processing?

MDN brought you the news today that Antero Resources is building its own frack wastewater treatment facility in Doddridge County, WV (see today’s lead story). It’s great news–great for Antero, but not great for some. One company feels betrayed by the announcement–Fairmont Brine Processing. Let’s back up. In December MDN told you the story of Fairmont Brine Processing, once called AOP Clearwater (see New Brine Processing Plant Coming to Panhandle of WV). Fairmont operates a small wastewater processing plant in Marion County, WV and has spent $2 million on engineering work and plans to build a new, larger facility near Wheeling, WV. Fairmont’s #1 customer is Antero Resources. All along Fairmont has been sharing plans and inside information with Antero to be sure the new facility they build meets Antero’s needs. WV Shale Drillers: New Safety Regs on the Way in 2016

Drillers in West Virginia–you’re on notice that Gov. Earl Ray Tomblin thinks it’s time to make shale drilling in the Mountain State safer than it is right now. Translation: new regulations will be coming at you in the 2016 legislative session. Tomblin formed the 19-member Oil and Natural Gas Industry Safety Commission with an executive order (see WV Establishes New Commission to Study Drilling/Pipeline Safety). The aim of the group is to present a list of recommendations in a final report on Nov. 16–a list that will be used to craft new rules and regulations and laws to be presented during next year’s legislative session. Cenergy Expands in WV for 4th Time; Gov Tomblin Celebrates

Founded in 2006, Cenergy is a West Virginia-based contractor for the natural gas industry providing turn-key facility and equipment engineering and fabrication for natural gas producers in West Virginia, Ohio and Pennsylvania. The Cabell County company last week held a grand opening for an expansion at its Milton, WV facility. Special guest of honor: WV Gov. Earl Ray Tomblin. Gov. Tomblin was there to brag that WV held on to Cenergy and the extra jobs that come with the new expansion. Baker Hughes July Rig Counts – U.S. May have Bottomed, but Not NE

On Friday Baker Hughes, which is being forced into a merger with Halliburton by the end of this year/early next year, issued a summary of rig counts last Friday. At first blush it appears to be good news, but when you dig under the surface, it’s not–at least for the Marcellus/Utica. The international rig count was 1,118, down 28 from the 1,146 counted in June 2015. However, the average U.S. rig count for July 2015 was 866, up 5 from the 861 counted in June 2015. It appears we’ve turned the corner on how low rig counts will go–we’ve bottomed and are either holding steady (in the U.S.), or perhaps every so slightly gaining ground again. But then we ran the numbers for the Marcellus/Utica and found rig counts continue to decline month over month…

World Oil’s Drilling Forecast for Marcellus/Utica Balance of 2015

World Oil is out with a wide ranging forecast for what will happen for the balance of 2015 in the upstream (drilling) sector of the oil and gas industry. Using surveys of both major and smaller drillers, World Oil confirms what we already knew: driller will spend less in 2015 than they did in 2014 on drilling new wells–on average 34.2% less (because of low commodity prices). Rogersville Shale Secrets Exposed – Appalachia’s “Next Big Thing”?

WV Northern Panhandle Production Rockets 3X from 2012 to 2014

Natural gas production in the northern panhandle area of West Virginia is rapidly expanding–nearly 3 times in 2014 what it was in 2012, according to West Virginia Geological and Economic Survey statistics. In Ohio, Marshall, Wetzel, Brooke, Tyler and Hancock counties natural gas production was 123.8 billion cubic feet in 2012. In 2014, that number ballooned to 346.7 Bcf. What about 2015 and beyond? WV Congressman Says Obama Purposely Not Enforcing Pipeline Safety

Congressman David McKinley, Republican from West Virginia, recently expressed his frustration with the Obama Administration and their lack of action in enforcing the 2011 Pipeline Safety Bill. McKinley said pipelines are safe but because Obama isn’t interested in promoting the image of safe pipelines (because it leads to more natural gas use), the Obama Administration is intentionally dragging its feet as it so often does when it doesn’t want to enforce laws Congress has passed that the lawless Lord B.H.O. disagrees with. WV DEP Study Finds Drilling Cuttings in Landfills are Safe

In 2014 the West Virginia legislature enacted a law that requires the WV Dept. of Environmental Protection (WVDEP) to conduct a study of the impact from disposing drill cuttings and drilling waste (leftover rock and dirt) from natural gas well sites in landfills. Anti-drillers spin tales of glowing in the dark from irradiation and horrible, cancer-causing, death-inducing chemicals leaking from landfills that accept drill cuttings and drilling waste. So members of the WVDEP and a number of outside researchers from several WV universities worked on this important research project that would, once and for all, evaluate the risk from landfills that accept drill cuttings. In early July the WVDEP released the completed study (full copy below). There have been a precious few media reports about the findings from this momentous research project. Why? Because the study “found little concern” regarding leachate associated with “drill cuttings that were placed in approved and permitted landfills, once that leachate was processed through a correctly operated treatment facility.” That is, there is no issue with accepting drill cuttings in WV landfills–contrary to the blathering of anti-drillers…

WV Establishes New Commission to Study Drilling/Pipeline Safety

West Virginia Gov. Earl Ray Tomblin has, as he promised in his 2015 State of the State address, formed a new commission on oil and natural gas safety to study and make recommendations on how the industry in the Mountain State can get better at safety. Translation: What new laws and regulations can the state adopt to make things safer without destroying the industry in the process? New EIA Monthly Report Breaks Out Natgas Production by PA/OH/WV

Our favorite government agency, the U.S. Energy Information Administration (EIA), has just replaced a previous monthly report with a new report that will be of keen interest to MDN readers. It used to be that the EIA produced the Monthly Natural Gas Gross Production Report. That report is no more. Instead, it has been replaced by the Monthly Crude Oil and Natural Gas Production report. The old report tracked and reported natgas production by state/region for LA, NM, OK, TX, WY and the Federal Gulf of Mexico. Those locations were, traditionally, where the vast majority of natural gas was produced in the U.S. But with the shale revolution, that’s now changed–dramatically. In addition to reporting monthly natgas production by state for the traditional locations, the EIA is adding 10 new states to the monthly report: AR, CA, CO, KS, MT, ND, OH, PA, UT and WV. Yep–where the super producing shale plays are located, including PA, OH and WV where the Marcellus/Utica is located. WVONGA Says Rogersville Shale Drilling in WV is “When” not “If”

To date, the shale revolution in West Virginia has been largely confined to the northern panhandle and north/central parts of the state, where first the Marcellus and increasingly the Utica Shale layers are targeted. Left out of the shale revolution has been southern WV. But that will one day change, according to Corky DeMarco, executive director of the West Virginia Oil and Natural Gas Association. No, the Marcellus/Utica are not the focus in the southern part of the state. In the south it will be the Rogersville Shale, and according to DeMarco, it’s more of a “when” rather than an “if” drilling will happen in the Rogersville Shale in WV. When will it happen? The southern part of the state will experience the economic bonanza being experienced in the northern part of the state. What will it take for Rogersville drilling to begin? Higher natgas prices…

Columbia Pipeline Board Approves 2 Projects from NE to Gulf Coast

In August 2014, MDN told you that Columbia Pipeline Group, a division of NiSource, had decided to move forward with investing $1.75 billion dollars for two new projects: the Leach XPress and Rayne XPress pipeline projects (see Columbia Gas: $1.75B for 2 Projects to Send Marcellus Gas to Gulf). Leach Xpress will begin in Marshall County, West Virginia, cross Ohio and end up in Leach, Kentucky. Rayne Xpress will beef up an existing pipeline from Leach, Kentucky that goes all the way to Rayne, Louisiana with new compressor stations and looping. The two projects together mean up to 2.7 billion cubic feet per day (Bcf/d) of natural gas can move through the entire system–from West Virginia to the Gulf Coast and all point in between. We commented on the funny name “Leach” for a pipeline. Looks like the marketers at Columbia thought twice about it because the name has changed–for both projects. At least we think so. Yesterday Columbia issued a press release to announce the board of directors has signed off on $2.7 billion worth of investment in two projects: Moutaineer XPress and Gulf XPress. Descriptions for the two projects are almost identical to the descriptions for the Leach and Rayne XPress projects. About the only difference is that the price tag went up for the pair of projects by a billion bucks. The key takeaway from the announcement for us? The capacity to move another 2.7 Bcf/d of Marcellus and Utica Shale gas out of the northeast is on the way in the next couple of years…

WV Gov Tomblin Not Ready to Give Up on Odebrecht Ethane Cracker

West Virginia Gov. Earl Ray Tomblin, the man who has worked hard to land an ethane cracker plant for his state, is still hopeful that WV will get them a cracker. In a wide-ranging talk at the Wheeling Rotary Club on Monday, Tomblin said Odebrecht, the Brazilian company that announced its interest in building an ethane cracker complex near Parkersburg, WV, continues to move forward with the project–“but at a slower pace.” That certainly is a bit of good news. We’ve not heard anything about Odebrecht advancing the ball on their project since the company announced in April, “the original configuration…needs to be re-evaluated, and a final investment decision on the project will require more diligence.” We took that to mean they’ve hit the pause button (see Odebrect Pushes the Pause Button on WV Ethane Cracker). But Tomblin and his administration don’t view it the same way. Instead of hitting the brakes, Tomblin says Odebrecht has simply reduced pressure on the gas pedal a bit…
