Supporters Dominate 2nd FERC Hearing for Atlantic Sunrise Pipeline

The silent pipeline-supporting majority became more vocal last night at a second hearing in as many days for the Williams Atlantic Sunrise Pipeline. Monday night’s Federal Energy Regulatory Commission (FERC) public hearing was a circus-like freak show, complete with one crazy wearing a cape like he’s Superman (see Lancaster Antis Try to Bully Pipeline Supporters, FERC Reps). In contrast, last night’s FERC hearing at Lebanon Valley College in Annville was dominated by solid, clear-thinking residents who support the pipeline and the benefits it will bring to the community. Elizabeth Twp Rejects Clean Invenergy Power Plant at Dump Site

Invenergy is in the process of building a $500 million Marcellus gas-fired electric plant in Jessup (Lackawanna County), PA–near Scranton, PA in the northeastern part of the state (see PA DEP Approves Jessup, PA Marcellus Gas Electric Plant). When built, and every indication is that it will get built this year, the Jessup plant will be the largest gas-fired plant in the state, generating 1,480 megawatts of electricity by using clean-burning Marcellus Shale gas. With that successful project under way, Invenergy turned their attention to the southwestern part of PA and announced their desire/plan to build a second plant in Elizabeth Township, in Allegheny County (see Invenergy Eyes SWPA for Second Marcellus-Powered Electric Plant). The second plant would be much smaller, at 550 megawatts, and would be built on a brownfield site near Pittsburgh. Even though the site where Invenergy wants to build is a former landfill where fly ash was dumped, making it unusable for just about any other purpose, a group of local residents would prefer to keep it a contaminated dump rather than convert it to a beneficial use like generating electricity (see Invenergy Gets Pushback on Proposed Natgas Power Plant in SWPA). Anti fossil fuelers in Pennsylvania have gone so bizarrely off the rails they object to ANYTHING that uses, touches or mentions “natural gas.” They have, quite simply, left their senses. They are irrational. One of the latest examples is their total opposition to allowing new clean-burning natural gas-fired electric plants to be built. We told you in a companion story today that Elizabeth Township (near Pittsburgh) is refusing to site a natgas-fired electric plant on an old landfill site, suitable for no other purpose (see Elizabeth Twp Rejects Clean Invenergy Power Plant at Dump Site). The next battle will be at a hearing for a proposed plant in Cambria County. Competitive Power Ventures (CPV) is planning a $900 million natgas-fired power plant to be located off Route 271 near Vinco in Cambria County (see 2 Natgas-Fired Electric Power Plants Coming to Cambria County, PA). DTE Energy Wants Ratepayers to Pay if NEXUS Pipe is Unprofitable

DTE Energy is a Detroit-based energy company involved in the development and management of energy-related businesses and services nationwide. Its operating units include an electric utility serving 2.2 million customers in Southeastern Michigan, and a natural gas utility serving 1.2 million customers in Michigan. DTE’s businesses include power and industrial projects, natural gas pipelines, gathering and storage, and energy marketing and trading. DTE has its fingers in a lot of energy pies. DTE is one of the main customers for the 255-mile, $2 billion NEXUS interstate pipeline that will run from Ohio through Michigan and eventually to the Dawn Hub in Ontario, Canada (see Spectra Energy Files Formal FERC Application for NEXUS Pipeline). DTE is also one of the backers/partners in NEXUS–providing money for the project. Spectra Energy will be the managing partner that actually builds and maintains NEXUS. DTE has asked Michigan regulators for a guarantee that it can pass along NEXUS costs to gas and electric ratepayers IF the utility’s gas supply costs from NEXUS prove to be unprofitable. Lancaster Antis Try to Bully Pipeline Supporters, FERC Reps

MDN has attended several Federal Energy Regulatory Commission (FERC) “scoping hearings” in the past (see Vicariously Attend FERC Scoping Hearing on Constitution Pipeline). So we’ve seen first-hand the kind of antics that virulent anti-fossil fuelers engage in at such hearings. Which has led us to comment these hearings are often freak shows–a forum for these people to vent and verbally vomit all over FERC representatives. Such was the case last night in Lancaster, PA at a public hearing held by FERC for the much needed, largely noncontroversial Atlantic Sunrise Pipeline, to be built by Williams. A group of 250-350 (depending on the media source) showed up to listen, with some speaking, at last night’s hearing. Not all in the audience were antis–but many were. People who support the pipeline have better things to do with their time than listen to nutters bleat and blat and carry on. Let’s put the numbers in perspective. Lancaster and Lebanon counties have a combined total population of 653,000 residents. Of that, 350 showed up for the hearing. If all 350 were against the pipeline (which wasn’t the case, but bear with us), that would be .05% of the population–statistically zero. And yet this very small group with very big mouths get all of the media coverage from the event…

4 Common Sense Energy Bills Advance in PA Legislature

As the fiscal year in Pennsylvania draws to an end, PA legislators in both the House and Senate are working on a number of proposed new laws that will make the Keystone State less onerous for energy producers and more business-friendly in general to drillers and those in the Marcellus Shale industry. Four such bills are actively making their way through the legislative process and look promising: Senate Bill (SB) 1195 extends the review period for legislators to review Wolf’s idiotic plan to comply with Obama’s onerous Clean Power Plan; SB 279 establishes a council to help the Dept. of Environmental Protection (DEP) to get its head straight when it comes to crafting new drilling regulations for conventional (non-shale) drillers; SB 562 provides for more transparency and timely communication, preventing Big Green organizations from pushing through new regulations with the DEP in the dead of night as they do now; and SB 805 will allow large energy users to opt out of state-sponsored energy efficiency programs–because those users are already more efficient that the state-run programs. Time to Fire Cindy Dunn, Last of Wolf Admin’s PennFuture Radicals

When the disastrous Tom Wolf set up his administration upon winning the governorship, three members of his cabinet were all from the same radical, Big Green group: PennFuture. There was Wolf’s Secretary of Policy, John Hanger (now gone, supposedly to spend more time with his wife and daughter in Massachusetts); Wolf’s Secretary of the Dept. of Environmental Protection, John Quigley (fired for conspiring with Big Green groups and getting caught doing it); and Wolf’s Secretary of the Dept. of Conservation and Natural Resources (DCNR), Cindy Dunn. She’s still around, but as MDN friend Tom Shepstone writes, it’s now time to fire her too. CRS Report: An Overview of Air Quality Issues in Natural Gas Systems

The Congressional Research Service (CRS) works exclusively for the United States Congress, providing policy and legal analysis to committees and Members of both the House and Senate, regardless of party affiliation. As a legislative branch agency within the Library of Congress, CRS has been a valued and respected resource on Capitol Hill for more than a century. Recently CRS wrote and published a report titled “An Overview of Air Quality Issues in Natural Gas Systems” (full copy below). The report looks at federal, state and local activities to help control air pollution from oil and gas–both drilling and pipelines. Without taking sides, this report provides information on the natural gas industry and the types and sources of air pollutants caused by the industry. The report examines the role of the federal government in regulating these emissions, including provisions in the Clean Air Act and EPA’s onerous regulatory activities. Wolf Really Didn’t Wise Up, He Just Took Half a Loaf re Drilling Regs

Yesterday MDN held out hope that PA’s far-left Governor, Tom Wolf, had actually wised up with respect to blocking new drilling regulations for conventional drillers in the state (see Wolf Wises Up – Agrees to Block/Rework Conventional Drilling Regs). We thought perhaps the Wolf was learning to moderate his hard-left stances and work with the more reasonable Republican Party to advance the state. Ha ha ha. We should have known better. How very Pollyanna of us. We spotted an article in the Pittsburgh Post-Gazette that gives us the real reason Wolf agreed to sign off on a deal to block new Article 78 regulations for conventional drillers: Because if he didn’t, Republicans AND Democrats were waiting to block ALL of the new drilling regs–including regs for shale drillers. Members of his own party told him they would vote to override his veto, if it came to that. Wolf knew he had lost the fight and rather than go down to defeat, he grabbed onto a half a loaf–allowing shale regs to advance–to salvage what little reputation he has left…

Wolf Wises Up – Agrees to Block/Rework Conventional Drilling Regs

While not wanting to look he’s caved, Pennsylvania Gov. Tom Wolf caved and in a deal with PA legislators agreed to support amended legislation that will allow some new Article 78 drilling regulations to go forward (for shale drillers) while other Article 78 regs will not (for conventional drillers). Yesterday the PA House Environmental Resources and Energy Committee approved amendments to Senate Bill 279 that prohibit the state Dept. of Environmental Protection (DEP) from implementing new Article 78 rules for conventional drillers. Committee Chairm John Maher (Republican) let it leak that Wolf has cut a deal to support the amended bill, much to the consternation of Rep. Greg Vitali and his buddies in the Big Green movement. Will they now brand Wolf as an environmental “apostate”–using John Quigley’s language? Perhaps! For more than a year Wolf has been recalcitrant when it comes to the budget and just about every other initiative where the Executive and Legislative branches must cooperate. Pennsylvania State Rep. Greg Vitali, a far-left Democrat from the Philadelphia area, is attacking his own governor, the most liberal governor in the U.S., Tom Wolf (according to InsideGov), for not being liberal enough when it comes to the environment. Vitali staged a press conference yesterday and essentially announced open warfare on Wolf. Vitali is still PO’d (personally offended) over the firing of Dept. of Environmental Protection (DEP) Secretary John Quigley (see Smoking Gun: Copy of the Email that Got John Quigley Fired). You may recall that Quigley was fired not for using a profanity-laced email to his Big Green friends in the radical environmental movement–but because he used a private email account to send the email, unethical in the extreme, and perhaps illegal (we hope someone is investigating). But sycophantic reporters refuse to focus on the true reason for Quigley’s firing–his off-the-reservation actions–and instead attempt to prop him up and say “he was too effective.” That’s the coordinated storyline being pedaled by lefties like Vitali. After the bombshell “resignation” announcement the Dems, including Jan Jarrett, tried to blame Democrat Sen. John Yudichak from Luzerne County, PA for Quigley’s firing (see PA Radical Enviros Blame Democrat Senator for Quigley Firing). Dems love to blame-shift. It’s A.O.K. for the out-of-control Attorney General from New York, Eric Schneiderman, to go fishing and request all sorts of internal documents and communications from Exxon Mobil in his witch hunt to persecute (not prosecute) the oil giant because they don’t believe strongly enough as he does in the fairy tale of man-made global warming. Schneiderman and his cronies in other states are trying to shake down Exxon in a massive scheme, claiming the company “knew” mankind is causing global warming by burning fossil fuels that Exxon extracts from the ground (see Climate Change Hucksters, Incl. NY AG & Al Gore, Threaten O&G and Rise of the New (Environmental) Nazis – Free Speech Under Attack). But when the U.S. Congress tells Scheiderman it wants HIS internal communication documents to see how he is colluding with Big Green groups who are prodding him along in his witch hunt efforts, Scheiderman clams up and claims Congress has no right to go fishing in HIS communications pond. PennFuture Bullies PA Town over Lack of Fracking Ordinance

In May 2015 MDN reported that after more than two years of acrimony and lawsuits between Range Resources and Mt. Pleasant (Washington County), PA., Range agreed to close four freshwater ponds (called “impoundments,” not to be confused with wastewater impoundments) the company was using to drill wells in nearby non-Mt. Pleasant locations (see Range Capitulates, Closing 4 Freshwater Ponds in Mt. Pleasant, PA). Mt. Pleasant is one of the original seven selfish towns that sued PA to overturn portions of the Act 13 oil and gas law. They won. Sooner or later a company can take a hint that a township is anti-business, so Range left town. Mt. Pleasant never followed up their victory in 2013 to fix a “hole” in their zoning ordinances. Not that it makes a whole lot of difference. MDN notices two permits issued in Mt. Pleasant Township in early 2015, and nothing since then, according to our Databook series. But the radicals at PennFuture have noticed. Even with little-to-no drilling, PennFuture is threatening to sue Mt. Pleasant unless they adopt far more restrictive ordinances on shale drilling in the town. Which points out PennFuture’s hypocrisy. It’s OK for a town to pass really restrictive zoning laws, but if the town chooses to not pass such laws, which is allowable under the Act 13 court case decision, that’s not OK by PennFuture. The door only swings one way for the radicals of PennFuture…

Any Day Now PA House May Vote to Kill Article 78 Drilling Regs

We are close to the endgame with respect to Pennsylvania adopting onerous new drilling regulations rammed through by the former Secretary of the Dept. of Environmental Protection, John Quigley. MDN reported in April that the state’s Independent Regulatory Review Commission (IRRC) voted to approve the new regulations (see PA Drillers Lose Vote to Stop Onerous New Regs in Partisan 3-2 Vote). The only thing stopping the regs from becoming law is a vote by the full PA House and Senate, which would send the measure to Gov. Wolf who would, in all likelihood, veto the “no go” resolution. Then the House and Senate would need to vote to override Wolf’s veto. It is a game of political chicken. Wolf is already an unmitigated disaster in his first year as governor. Can he afford to have the legislature override a veto, making him look even weaker than he already looks? The House has until June 13, next Monday, to vote against these onerous new regulations. Then the Senate has either 10 legislative days, or 30 calendar days (whichever is longer) to vote. This is a real nail-biter!…
