    Shoe Now on Other Foot: Landowners Sue Martian Anti-Drillers

Twelve (12) leaseholders and a real estate developer in Middlesex and Adams Townships, in Butler County, PA (near the Mars School District) have filed a lawsuit against local anti-drillers as well as against THE Delaware Riverkeeper and the Philadelphia-based Clean Air Council, suing them for damages because their ongoing frivolous lawsuits have keep the leaseholders from realizing profits from their leased land. And get this, the Martians and Big Green groups being sued are upset, saying their free speech rights are being infringed. Talk about nuts! It’s OK for anti-drillers to launch lawsuit after lawsuit, but as soon as someone pushes back and files a lawsuit against them, they start squealing like little piglets…

    NJ Antis Change Gear, Hire Quiet Guy to Head Anti-Pipeline Effort

    Anti-drillers in New Jersey must be growing tired of the angry demeanor of their current “movement leaders”–people like Maya van Rossum from THE Delaware Riverkeeper. So they’re putting their chips on a quieter, gentler anti-driller they hope will be more effective in stopping projects like the PennEast Pipeline. NJ antis have hired Thomas Gilbert, 45, a “longtime activist known for his land preservation work” to become the campaign director at New Jersey Conservation Foundation, starting June 15. They’re hoping the NJ Conservation Foundation can be “the one ring to rule them all” by organizing together disparate anti groups to defeat projects like PennEast. Anti-drillers have tried the go-it-alone, not-nice route–so this time they want to try the let’s-all-cooperate-nicey-nice route. It’s the same old hardened anti-drilling philosophy dressed up in a nicer package. But make no mistake–they want to end the use of fossil fuels in New Jersey–and that’s why Gilbert has been hired…

    MA Bill Prevents Pipeline Costs from Passing to Electric Customers

    Part of the opposition to pipelines in states like Massachusetts centers on the issue of whether or not the gas flowing through the pipeline will get exported. For sure the majority of the gas will be used in places like Massachusetts–and some of that will go to consumers–but a great deal of it will go to electric generating plants, to lower the incredibly high cost of electricity in New England. Because the customers for the gas are electric utilities, and because the utilities don’t have piles of cash laying around, the utilities (in some cases, not all cases) want to pass along some of the cost of the proposed pipelines to electric rate payers. That is, electric customers. You and me. The response from anti-drillers is, “Hey–since a lot of this gas will get exported anyway, not benefiting the state, why should electric rate payers bear the cost of building the pipeline?” And so some anti-drilling state legislators have introduced a bill that would prevent any pipeline cost from being passed on to Massachusetts rate payers if ANY of the gas in that pipeline eventually gets exported.     MSC Devastating Critique of “Low Birth Weight Near Fracking” Study

    Yesterday MDN told you about a new anti-drilling-backed so-called “study” by students at the University of Pittsburgh making wild claims about babies born near Marcellus Shale fracking sites having lower birth weights than those not born near frack sites (see Study Tries to Link Marcellus Fracking to Low Birth Weight Babies). We outlined the link between bought-and-paid for “science” that gets amplified by mainstream media. The Marcellus Shale Coalition also published their own criticism, saying, “A new non-peer reviewed paper – funded by the Heinz Endowments and posted on a pay-for-play website – fails by virtually every measure to demonstrate basic and sound research principles.     Study Tries to Link Marcellus Fracking to Low Birth Weight Babies

    Junk ScienceHere’s how it works in anti-drilling land. Students who want to make a name for themselves and earn some cashola accept “funding” (i.e. a bribe) from an anti-drilling organization. The “funder” (i.e. briber) determines the topic and result they want the “research” to report. The students, from a prestigious school, then doctor up the research with enough surface credibility to fool stupid mainstream media types. The students then publish that “research” in an online journal with very low standards. What do you get? Researchers at the University of Pittsburgh Graduate School of Public Health accepting money from the Heinz Endowments to publish a study claiming mommies who live close to Marcellus Shale wells have babies with low birth weights (copy of the study below), published in the online journal PLOS ONE, now being picked up by the likes of CBS and other news outlets who are reporting what the authors themselves say is research that doesn’t prove anything. News headlines are then generated linking fracking to a negative health condition. The low-information, headline-only reading crowd reads the headline and never bothers to question whether or not it’s true (which it isn’t), and voila–we have another case of public brainwashing, assisted by students prostituting themselves for money and fame, and damaging the reputation of the University of Pittsburgh.     Anti-Drilling Groups File to Defend BLM’s New Federal Lands Frack Rule

    The “sue and settle” gang is back. A group of six virulently anti-drilling, fossil fuel-hating organizations, calling them (don’t laugh) “conservation groups” (nothing of the sort) have filed to intervene in two lawsuits brought by the individual states and the oil and gas industry against the federal government over the new fracking rules released by the federal Bureau of Land Management (see BLM Introduces “Final” Fracking Rules for Fed Lands – 3 Yrs Late). Here’s how it works with sue and settle: the federal government gets Big Green groups (with lots of money) to bring lawsuits against a department, like the EPA or BLM. The government agency then promulgates new restrictive and jobs-crushing rules that have the force of law because “the lawsuit and judge made us do it.” And unless those “rules” are challenged in court to get them repealed, we end up with laws created by government agencies and judges instead of the legislature, the way the Founders intended. So when the good guys sue to overturn these overreaching “rules”, the sue and settle gang with lots of Big Green money comes back to try and stop it. The groups are once again being led (by the nose) by Earthjustice and include the Sierra Clubbers, Earthworks, The Wilderness Society, Conservation Colorado Education Fund, Southern Utah Wilderness Alliance and Western Resource Advocates.     Two Thumbs Down on John Quigley as Sec of PA DEP

    2 thumbs downYesterday Pennsylvania Gov. Tom Wolf’s pick to head the all-important Dept. of Environmental Protection (DEP), John Quigley, faced a confirmation hearing in the PA Senate. Quigley sparred with Republican Senators who challenged him over his two-year stint at the anti-drilling organization PennFuture. He also assured the Senators that if Gov. Wolf’s insidious severance tax is passed, the “industry’s not going anywhere” he said. In other words, we have them by the short hairs and they have no other options. Au contraire, Mr. Quigley. Au contraire. We’ve made no bones about our disdain for Quigley. He shouldn’t be the next Secretary of the DEP. But we’re under no illusion. He’ll likely get approved. What was interesting, however, is that at the conclusion of the hearing, the Senators on the panel voted to refer Quigley’s appointment to the full Senate–without recommendation. That’s extremely rare. It was a vote of no confidence by the senators, as in “here, we’ll let ya’ll vote on him any which way you want to, we wash our hands of it.” It will be interesting to see how many vote against his confirmation. It’s good to know we’re not a lone voice crying in the wilderness. There is someone else–a very important someone else–who also doesn’t think Quigley should be confirmed.     Earthjustice Asks Court to Stop Construction at Cove Point LNG

    Three weeks ago MDN told you about the frivolous lawsuit filed by Earth[in]justice attempting to stop the Cove Point, Maryland LNG export plant from being built (see DOE Grants Cove Point LNG Final Approval, Earthjustice Sues). Earth[in]justice sued on behalf of themselves (they are a small group of Washington, DC lawyers backed by Big Green money), and on behalf of Chesapeake Climate Action Network, Patuxent Riverkeeper, and the Sierra Clubbers. Meanwhile, Dominion, the owner of the project, has pushed forward with construction at the site. Dominion is about to begin construction on the foundation of the new facility sometime in June, so Earth[in]justice has just filed another lawsuit–a request for a cease and desist order to stop Dominion from constructing the foundation until after their frivolous lawsuit has a chance to get in front of a sympathetic judge…

    Anti Group “NOPE” Opposes Spectra Energy New England Pipeline

    Both Spectra Energy and Kinder Morgan have competing pipeline projects to move Marcellus Shale gas to New England where it’s desperately needed. Spectra Energy’s project is called Access Northeast and has a number of regional utility partners–companies that want to buy cheap, abundant and clean-burning Marcellus Shale gas–to sell to New Englanders. Spectra Energy’s project will expand several existing pipeline systems and join them together, running from New York through Connecticut and into Massachusetts. Kinder Morgan’s project is called Northeast Energy Direct (NED), which builds a new extension of the mighty Tennessee Gas Pipeline system from New York across Massachusetts, into New Hampshire and back into Massachusetts. Both projects face resistance from nutty fossil fuel haters. The reality for both projects is that although they will deliver an abundance of new supplies of natural gas, which is good during the winter, there will be an oversupply in the summer. You don’t just turn the spigot off on a pipeline. So the plan is to put some of that natural gas on the Maritimes & Northeast pipeline and send it on up to Canada where it can be used by Canadians and/or exported. Yes, exported. Export is not a dirty word, nor will it raise the prices here at home–at least not appreciably (by more than a few cents per Mcf). A new group of anti-drillers has sprung up to oppose the Spectra Energy project. They call themselves DOPE…oops, that’s NOPE (No Pipeline Expansion). NOPE is all up in arms because a little bit of natural gas may get exported, and they think they have the smoking gun to prove it…

    Anti-Drilling Martians Running for School Board in November

    My Favorite MartianWho knew that Martians are Democrats? Well, to be honest, we had guessed as much. A small group of Mars School parents who object to fossil fuels have formed a group to oppose Rex Energy’s plan to drill five wells on a pad about 3/4 of a mile from the Mars School in Middlesex Township (Butler County), PA. We’ve chronicled the fight over the past year or so (see our Martian stories here). Three of the parents from the anti-drilling group ran in a primary for the school board. All three, as it turns out, are Democrats. Surprised? No, neither are we. Fracking and drilling is, largely, a partisan issue. The good news is that all three were among the lowest vote-getters in the primary–and one of them flunked off and won’t be on the ballot in November. The other two will run as Dems in a district where Republicans handily outnumber them…

Because mainstream media outlets like the ABC affiliate in Harrisburg is manufacturing a false controversy about who’s behind the ads–quoting anti-drillers like Jan Jarrett from the non-transparent partisan group called the Pennsylvania Budget and Policy Center–to distract people from the effectiveness of the ad.     As MDN reported last week, Maryland’s new Republican Governor, Larry Hogan–missing an important piece of his male anatomy–allowed a Maryland bill to become law that bans fracking in Maryland for another two years (see Maryland’s Pusillanimous Gov Allows Frack Moratorium to Become Law). That now gives non-Maryland anti-fracking groups another two years in which to lock down a total and permanent ban on fracking–which is their stated goal.     Park Foundation Resolution Defeated by ExxonMobil Shareholders

    happy dance - SnoopyIt’s not often (enough) that the odious and disgusting Park Foundation suffers a total defeat–so we do a happy dance when it happens. It happened yesterday at ExxonMobil’s annual meeting where shareholders handed the Park Foundation (of Ithaca, NY) a humiliating defeat of their resolution that Exxon compose a cockamamie report every year detailing the so-called “risks” involved with unconventional drilling. Apparently the self-loathing Park Foundation wants Exxon to become self-loathing too–to produce a report that essentially says they’re creeps destroying Mother Earth by fracking. Three-fourths of Exxon shareholders said “no thanks.” Shareholders also voted down an idiotic proposal by a group of Catholic priests from Milwaukee who have lost their first love (Jesus Christ) in favor of a new love (Global Warming) to put a global warming expert on the board of directors. Ah, excuse us Fathers, whatever happened to your vow of poverty? Seems the priests of Milwaukee now have more money than the Lord Himself and want to throw their weight around at shareholder meetings rather than save souls…

    Maryland’s Pusillanimous Gov Allows Frack Moratorium to Become Law

    Gov Larry HoganWhat a disappointment Maryland’s new Republican governor, Larry Hogan, has turned out to be. On his way out of office, Maryland’s previous governor, Martin O’Malley (Democrat), created strict drilling regulations that would allow fracking in Maryland THIS YEAR (see Maryland Gets Ready to Frack! Gov O’Malley Files New Regulations). O’Malley was a disaster as Maryland’s governor, and even though he lobbed new fracking regs over the wall in a sleazy political move (he’s running for president), we tipped our hat to him for doing the right thing–even if he did it for his own personal reasons. The prospect of any fracking was too much for the environmentally insane that belong to Maryland’s legislature. They passed a two-year moratorium bill and sent it to Hogan for his signature (see Maryland Closer to a 2-Year Fracking Ban, Will Gov have Guts?). Looks like the pusillanimous Gov. Hogan doesn’t have guts after all. He’s already defeated just a few months into his first term. Last Friday the Baltimore Sun quotes his office as saying Hogan, who supposedly supports shale drilling, will let the bill become law without his signature–a cop out if ever we’ve seen one…
