Cecil Twp Violates Court Order re MarkWest Compressor Permit

MDN first started tracking the issue of MarkWest Energy’s desire/application to build a compressor station in Cecil Township (Washington County), PA all the way back in May 2011–four years ago (see MarkWest, Range Resources File Legal Appeal Over Denial of Permit for Gas Compressor Station in Cecil, PA). The case goes back even further to the fall of 2010 when MarkWest first filed for the permit. Since that time, Cecil has steadfastly denied MarkWest a permit to build the compressor. It took nearly four years of lawsuits (see our many stories here), but last fall a judge ruled that Cecil could not disallow the MarkWest compressor in an area zoned industrial (see MarkWest Wins Court Case to Build Compressor Station in Cecil, PA). The Cecil Town Board decided not to appeal the decision, but the zoning board has kept it bottled up since last October. The town has now exhausted all legal options and the court, in April, told the town they have 45 days to grant the permit. The clock is ticking and yet the zoning board is still dragging its feet and intends to violate the 45-day court order…

Antis’ Zoning Appeal re Mariner East Pump Stn in Lebanon “Moot”

Back in November MDN told you about anti-drillers in Lebanon County, PA who had succumbed to shiny object syndrome and transferred their irrational hatred of fossil fuels from the Williams Atlantic Sunrise pipeline project to the already-in-the-ground but getting repurposed Sunoco Logistics Mariner East pipeline (see New Target for Lebanon, PA Antis: Mariner East Pipeline). As part of converting Mariner East from an oil pipeline to flow natural gas liquids, including propane and ethane, from western PA to the Philadelphia area, some 31 pump and valve stations need to be constructed–one of them in West Cornwall in Lebanon County. Three local residents and an anti-drilling group called Concerned Citizens of Lebanon County filed an appeal with the zoning board to force the town to rescind permits they granted to allow the pump station (see Sunoco Presents on Mariner East Pump Station in Lebanon, PA). Josh Fox Among 21 Arrested at Crestwood Facility in Upstate NY

Thank God we get some comic relief every now and again by the bizarre antics of anti-drillers. Covering the miracle of wholesome, safe and good hydraulic fracturing and the many benefits to society of natural gas is rewarding, but what makes it fun is to point out the hypocrisy and stupid behavior of those who oppose it. On Wednesday a group of mostly old upstate NY hippies staged yet another protest and illegally blocked the entrance of the future underground propane storage facility near Watkins Glen, NY owned and operated by Crestwood Midstream. Getting arrested in front of the Seneca Lake facility to gain media attention is a regular occurrence (see 10 Antis Arrested for Blocking Crestwood Facility at Seneca Lake and NY Protesters Arrested for Blocking NatGas Storage Facility). The anti-drilling StateImpact Pennsylvania, an initiative of taxpayer-funded PBS, recently published an “expose” on the race for Philadelphia mayor and how fossil fuel companies–namely the Marcellus Shale industry–are corrupting the race with huge donations to candidates. We mean, it’s just so unbelievable that, well, we don’t believe it! Huge. Money corrupts. Bags and bags of money from those evil, nasty frackers meant to buy off the mayor’s race in the liberal bastion of Philly. It’s absolutely sinister. Oh. How much money is being donated by frackers? Because he’s a state senator, only one of the dozen or so running is required to file financial statements–State Senator Anthony Hardy Williams. So we have the best data on Tony. By the way, Tony’s wife Shari (a fine lady whom we are privileged to have as an acquaintance) works for the enemy–the Marcellus Shale Coalition. Environmentalists & Government Collude in “Sue and Settle” Cases

There is a practice called “sue and settle” being used by our federal government–financed by us, by taxpayers–that will make your blood boil. It’s not new. It’s been going on for years and is now refined into an art form. MDN first heard about this practice at the Oil & Gas Awards in Oklahoma City last fall when Oklahoma’s excellent Attorney General Scott Pruitt gave the assembled crowd a rundown of how the Environmental Protection Agency (EPA) and the U.S. Fish and Wildlife Service (USFWS) is attempting to screw the oil and gas industry by using this tactic. Here’s how it works: a far-left radical environmental group like Earthjustice sues a government agency, like the EPA or USFWS to force the agency enact a new rule or regulation supposedly to comply with an existing law. The government agency actually WANTS the lawsuit (colluding with the extremist group to invite it), so they can get a court order “forcing” them to take a certain action. Earthjustice and the government agency, behind closed doors, work out what the action will be. At the conclusion of the lawsuit, the court awards the “winning” party compensation from the “losing” party to cover legal fees. Using that strategy, from 1995 to 2010, Earthjustice received $4,655,425 of taxpayer money. Question: Why hasn’t Earthjustice been exposed as frauds and shut down?…

PA Anti-Driller Scroggins Indicted with Felony Counts for Illegal Taping

A little-known (outside of northeast Pennsylvania) anti-driller, Vera Scroggins, was fined $1,000 last month in Susquehanna County court and the judge told her she’s going to jail if she doesn’t pay it (see PA Anti-Driller Fined $1K for Trespassing on Cabot O&G Site, Jail?). This month she was permanently banned from trespassing on Cabot Oil & Gas property in the county (see PA Fracktivist Permanently Banned from Cabot Property). It seems Vera’s legal problems are not over yet. Sham Air Study: “Unsafe Exposure” for Those Near OH Frack Sites

We frankly don’t believe the studies being published in so-called peer reviewed journals anymore. These journals have proven, repeatedly, that they are biased and frankly have prostituted themselves out to Big Green causes. It’s not science that gets published–it’s propaganda and advocacy that’s now published. Here’s the latest example: a so-called study of air samples near shale drilling in Carroll County, OH finds that air pollution from fracking operations is deadly. It sneaks in the “c” word–cancer–implying those who live close to fracking operations “may have” an increased chance of getting cancer. The published paper is titled “Impact of Natural Gas Extraction on PAH Levels in Ambient Air” published in Environmental Science & Technology and written by researchers from Oregon State University. Yes, Oregon–a long way from home, no? There was also a single researcher on the team from the University of Cincinnati. Here’s what the authors themselves admit about their “research”: They hung a “small number” of air samplers (23 total) in “non-random” locations, and had homeowner “volunteers” pack up the samples and ship them to Oregon for study. Reversal: Media Discredits Penn State Water Contamination Study

VA Newspaper Takes AG to Task for Decision Allowing Fracking Bans

Earlier this week MDN told you about Virginia’s far-left Democrat Attorney General Mark Herring giving local municipalities the “right” to regulate and ban fracking (see Virginia AG Says Localities Can “Regulate” & “Prohibit”). What we didn’t know is that Herring’s “opinion” which is taken as law completely contradicts and undoes an opinion issued by his Republican predecessor, Ken Cuccinelli, who wrote that while municipalities can limit drilling to areas zoned for it, they can’t outright ban it. Herring, bowing to pressure from the kook fringe of his party, aims to change it. What gives us comfort is that we’re not the only ones to notice that Herring has stepped WAY over the line on this. Lunacy: NH Group Votes Against Pipeline Because of Global Warming

It’s maddening. It makes one want to scream, “You idiots! Can’t you see the utter hypocrisy?” But it happens more than we’d like to admit. A group of “volunteers” who advise the Select Board in the New Hampshire community of Wilton have unanimously voted to oppose Kinder Morgan’s proposed expansion of the Tennessee Gas Pipeline that would run through Hillsborough County. The reason they oppose it? Natural gas is not a “renewable” energy source. They don’t oppose it because pipelines are unsafe or in any way threaten the environment. Nope. They oppose it because they cling to the belief that mankind is causing catastrophic global warming by using fossil fuels. Meanwhile, everything in their lives is made possible by the very fossil fuels they profess to loathe. And they don’t see it–don’t understand it–don’t seem to comprehend it. The Fight to Build the PennEast Pipeline: Arguments For & Against

About a month ago MDN editor Jim Willis granted an interview with Kevin Mooney, on assignment writing for The Daily Signal, a publication of arguably the top conservative think tank in the country–the Heritage Foundation. Kevin wanted to talk about the PennEast Pipeline and the controversy surrounding what should be a straightforward and non-controversial project. These days anything to do with fossil fuels is being opposed by the likes of the Sierra Club and (in the case of the PennEast), regional anti-drilling groups like THE Delaware Riverkeeper–a group now being investigated by pro-drillers for possible violations of ethics laws in their dealings with the Delaware River Basin Commission. Ohio Univ to Get New Natgas Pipeline from Columbia Gas This Year

Here’s a fact: So-called “sustainable” forms of energy like solar, wind and geothermal cannot, by themselves, provide all of the electric needs for a huge university like Ohio University, situated on an 1,850 acre campus in Athens, OH. Right now OU uses coal to meet its electric generating needs. They want to replace it with natural gas. But get this, ninny nanny “environmentalists” don’t like that idea. They’d rather have OU continue to burn dirty coal rather than build a pipeline to the campus and have the campus change over to natural gas. NY DEC Signals Support for Seneca Lake Propane Storage Project

A little good news coming from New York State for a change. The state’s Dept. of Environmental Conservation (DEC) has “quietly” given its support to the Crestwood Midstream plan to use a depleted salt cavern along the shores of Seneca Lake to be used as a propane storage facility. We’ve written about this before–about the very safe plan to use it in this manner, and about protesters like Sandra Steingraber who seem to enjoy trips to the county jail for blocking the facility, repeatedly (see Steingraber, 2 Others Sent to Jail for Refusing to Pay Fine). In February an “issues conference” was held before an administrative law judge where testimony was given by both sides–Crestwood Midstream and anti-drillers. The anti-drilling side is being funded by the odious Earthjustice and National Resources Defense Council (NRDC). The DEC has sent a brief (full copy below) saying, in essence, (a) those against the project haven’t proven this facility would bring about environmental Armageddon, as they say it would, (b) some of the loonies opposing it don’t even have standing to oppose it, and (c) no more hearings are required. The only continuing reservation we have, and the reason we’re not celebrating just yet, is that the person who will make the ultimate decision is the head of the DEC, the anti-drilling Joe Martens, a man deeply in the pocket of Big Green…

Penn State Uses Anti-Drilling Trout Unlimited for Marcellus Monitoring

PA Fracktivist Permanently Banned from Cabot Property

Study: If You’s Po’ and Lives in Rural PA, You’s Gettin’ Fracked

If you’s po’ and lives in Penns’vania, ‘hio or West Gini, you’s gettin’ polluted by that evil, nasty frackin’. And chances are, you’s too stupid to knows it.” That’s the essential conclusion of a highly discriminatory and inaccurate “study” called “Spatial distribution of unconventional gas wells and human populations in the Marcellus Shale in the United States: Vulnerability analysis,” recently published in the so-called journal Applied Geography by so-called researchers from Clark University. The “researchers” don’t bother with fundamental research, like reviewing health records of people who live near active Marcellus Shale drilling areas. That would take waaaay too much work. Instead, they just assume that if you live near drilling, you’re getting polluted. The focus of the “research” is on the cockamamie theory of environmental justice. The “researchers” found that people living out in the country–where this activity typically takes place–by and large are poorer than those living in towns and cities (and on elite college campi). Wow–such a brilliant insight! “Because they po’, they don’t read all that much…they can’t figure out theys gettin’ polluted.” Yes, its disgustingly prejudiced–but that’s what passes for scholarship these days…
