Landowners’ Countersuit Against Martians Tossed by Obama Judge
NOTE: MDN received a note from a subscriber (and lawyer) who has appeared before Judge Horan several times and believes our characterization is unfair and unwarranted. Indeed, the lawyer says Horan is “certainly not a radical” and has rendered industry-favorable decisions on several occasions. We appreciate it when subscribers take time to point out when our gut reaction, usually spot on, may not be. We want to be fair and not impugn someone’s reputation without cause.
Once again justice has been corrupted in a corrupt Pennsylvania court. It’s A.O.K. for four local residents (Martians) and two tax-exempt non-profit groups from the opposite side of the state to bring lawsuits to stop legal Marcellus drilling in Butler County, PA, costing Butler County taxpayers in excess of $35,000 in legal fees (see ACLU Asks County Judge to Toss Lawsuit Against Litigious Martians). The Martians have children in the Mars School District located 3/4 of a mile away from the proposed Rex Energy drilling site. Never mind other school districts in the state have allowed drilling ON CAMPUS. A dozen landowners in Middlesex and Adams Townships that want drilling to commence counter-sued the Martians and the Big Green groups for holding up a legal process (see Shoe Now on Other Foot: Landowners Sue Martian Anti-Drillers). Butler County Judge Marilyn J. Horan (Democrat) has tossed the landowners’ counter-suit out of the nearest ivory tower window. That’s “justice” for you in Butler County, PA. THE Delaware Riverkeeper, Maya van Rossum, and a bunch of her anti-fossil fuel pals delivered a letter on Wednesday to America’s most liberal governor, PA Gov. Tom Wolf, asking him to immediately suspend all further Marcellus drilling in the state and while he’s at it, stop building any new pipelines. The PennFuture Secretary of the Pennsylvania Dept. of Environmental Protection, John Quigley, continues to promote a hard-left agenda inside a once-great agency. Any time a Democrat like Quigley pairs the word “justice” with another word, like “environmental”, you know it’s a bad idea. Quigley is promoting the concept of creating an “office of environmental justice” within the DEP. What does that even mean? Is Quigley implying we currently have environmental “injustice” running rampant through the Commonwealth? Quigley also wants to use revenue raised from an obscenely high severance tax on Marcellus Shale drilling to fund more DEP inspectors to hang out at drill pads. Must be Quigley didn’t get the memo from Wolf that ALL of the severance tax money, if Wolf is lucky enough to get such a tax passed (very much in doubt), has already been promised in a quid pro quo agreement to teachers’ unions that helped get him elected…

These people are true professionals who care about the work they do–and they want to do it right. They care about the environment. They want to protect the land and our natural resources. Obama, asking the Dear Leader to keep all fossil fuels in the ground. Sensing that their time grows short while Dear Leader is still in office, the nutjobs, wackos and ne’er do wells in the most extreme part of the environmental movement (which is pretty much all of it) are pressing their advantage while they have a sympathetic ear in the White House. The letter, delivered yesterday (a copy is embedded below) predictably uses man-made global warming as the excuse to choke off all further fossil fuel extraction on U.S. owned or controlled land. In good liberal fashion they’ve created a catchy phrase for their effort: “Keep it in the ground.” They’re starting with federally controlled land first–then they’ll go after private land next. Love it, love it, love it! What would it actually be like without fossil fuels in our lives? We hear it all the time–global warming nutters “demanding” we end the use of fossil fuels. Read today’s related story about a group of 400 people who wrote to Obama demanding that he “keep it [fossil fuels] in the ground.” The Western Energy Alliance (WEA) is calling their bluff. The WEA is challenging those who profess to want to end the use of fossil fuels to participate in a Fossil Fuel Free Challenge for five days–so they can see for themselves just what life would be like without the miracle of fossil fuels. The dirty little secret is, they can’t do it, because they can’t live without fossil fuels in their lives. It’s impossible.
